Unified Transportation Program Consider the approval of an addition to the 2021 Unified Transportation Program (UTP) (MO) (Presentation) The UTP is a 10-year statewide plan for transportation project development. The commission approved the 2021 UTP in August of 2020. This minute order allocates funding previously granted by a prior Commission and Administration for the 365 Tollway Project in the Pharr District.
Discussion Item Texas - Mexico Border Transportation Master Plan (Presentation) Staff will provide an overview of the Texas - Mexico Border Transportation Master Plan (BTMP) development process and contents of the plan. The BTMP is a comprehensive, multimodal, binational plan that identifies transportation issues and needs, as well as the challenges of moving people and goods through the Texas-Mexico border, the border regions, and beyond. The plan outlines policy, program, and project recommendations to facilitate the continued efficient and safe movement of people and goods through the 29 border crossings and the multimodal transportation system. The plan also lays out a framework for implementing the recommendations that will support the continued economic competitiveness of the border regions, Texas, the U.S., and Mexico.
Aviation Various Counties - Consider the award of federal non-primary entitlement grant funding, federal apportionment grant funding, and state grant funding for airport improvement projects at various locations (MO) Federal law authorizes the award of federal non-primary entitlement grant funding and federal apportionment grant funding to preserve and improve the state's general aviation system. State law authorizes the award of state grant funding for capital improvement projects.
Promulgation of Administrative Rules Under Title 43, Texas Administrative Code, and the Administrative Procedure Act, Government Code, Chapter 2001: Rules Proposals Chapter 1 - Management Amendments to §1.85, Department Advisory Committees (Advisory Committees) (MO) In Minute Order 115565, the commission charged the Bicycle Advisory Committee (BAC) to review and make recommendations on expanding the charge of the BAC to address a wider range of related transportation service options, including pedestrian options and personal mobility devices. The rule amendments expand the scope of the BAC based on the BAC’s recommendations in response to the commission’s charge.
Chapter 9 - Contract and Grant Management Amendments to §9.130 and §9.131, Repeal of §§9.132 - 9.139, and new §§9.132 - 9.135 (Grant Sanctions) (MO) This minute order proposes amendments to department rules regarding imposing grant sanctions on a subgrantee for failure to comply with federal or state law or grant requirements. Proposed amendments replace language regarding grant sanctions with remedies for noncompliance to align with federal regulations and other department rules.
Final Rule Adoptions Chapter 11 - Design Amendments to §§11.403 - 11.406 and 11.411 (Transportation Alternatives Set-Aside Program) (MO) This minute order amends current Transportation Alternatives Set-Aside Program rules to encourage and improve project proposals from areas under 50,000 in population, reduce the department’s risk of federal funds lapsing in the nonurban funding category, streamline project delivery, and improve the likelihood of successful completion of awarded projects. Changes to the rules regarding eligible activities, allowable costs, local match, and MPO and department project selection are proposed.
Chapter 27 - Toll Projects New §27.86, Veteran Discount Program (Operation of Department Toll Projects) (MO) S.B. 1091, 86th Legislature, Regular Session, 2019, amended Transportation Code, §372.053, related to the Veteran Discount Program. The amendments provide that a toll project entity may limit to no more than two the number of transponders (tags) issued to a participant in the entity’s program. A toll project entity that adopts a limit shall allow a participant to be issued one extra transponder on a demonstration of hardship by the participant, as determined by the entity. New §27.86 describes the method by which the department will implement the statutory changes, including the number of tags that will be issued to eligible customers and the process for issuance of an additional tag based on financial hardship.
Eminent Domain Proceedings Various Counties - Consider the authorization of the filing of condemnation proceedings to acquire real property by eminent domain for non-controlled and controlled access highways (see attached itemized list) (MO) Commission findings, determinations, and authorizations for the state, by motion made in accordance with Senate Bill 18, 82nd Legislature, to acquire by eminent domain, upon the payment of adequate and just compensation, various ownership interests in specific parcels of real property that are needed to develop or improve both non-controlled and controlled access state highways, to include requesting the state attorney general to bring and pursue condemnation suits relating to those specific parcels of real property described in the attached itemized list.
Routine Minute Orders and Reports a. Donations to the Department Various Districts - Consider the acknowledgment of donations with a value of $500 or more, including donations of money, materials, services, or real property, that are made to the department for the purpose of assisting the department in carrying out its functions and duties or for improving access to or from a highway on the state highway system (see attached itemized list) (MO) State statutes require the commission to acknowledge the acceptance of a gift to the department that is valued at $500 or more. By the adoption of this minute order, the commission acknowledges the receipt and acceptance of the property specified in the minute order. b. Real Estate Dispositions The commission must approve the sales, transfers, and exchanges of state rights of way and other real properties that are no longer needed for a state highway purpose. (2) Bexar County - FM 1518 - Consider a recommendation to the governor regarding the execution and delivery of a quitclaim deed, correction deed, or other conveyance instrument necessary to resolve an ambiguity or error that conveyed an interest in real property to the state for a highway right of way and which resulted in the acquisition of an interest in real property not intended to be included and not needed for a highway purpose (MO) The district has determined that the execution and delivery of a corrective instrument is necessary. The City of Lubbock (city) has agreed to assume jurisdiction, control, and maintenance and has requested that the right of way be transferred to the city. The right of way may be transferred to the city without cost to remain in use for public road purposes and will revert to the state if it ceases to be used for public road purposes. The Compliance Division is required to provide a monthly report to the commission regarding investigations and a summary of information relating to trends and recommendations. (2) Environmental Impact Statement Positive, Negative, or Neutral Public Comments Report Consider the acceptance of the Environmental Impact Statement Positive, Negative, or Neutral Public Comments Report for the North Houston Highway Improvement Project in Harris County (Report) Per Transportation Code §201.811(b) and 43 TAC §2.107(f)(2), this report lists the number of positive, negative, and neutral public comments received from the public hearing and meeting held in connection with release of the draft environmental impact statement for the referenced project. (3) Environmental Report Consider the acceptance of the report on projects being processed under the procedures of Transportation Code, Chapter 201, Subchapter I-1 (Report) The report identifies projects with a local government sponsor being processed under the environmental review procedures set forth in Transportation Code, Chapter 201, Subchapter I-1. A report must be submitted twice a year to the commission, as required by Transportation Code, §201.762(a). d. Highway Designations (1) Denton County - In the cities of Denton and Corinth, consider extending the designation of FM 2499 (MO) This minute order extends the designation of FM 2499 from FM 2181 northward along Barrel Strap Lane and State School Road to I-35E, a distance of approximately 3.1 miles. (2) Fannin County - Near Dodd City, consider extending the designation of FM 897 and realigning and designating a segment of FM 897 on a new location concurrent with US 82 (MO) This minute order extends the designation of FM 897 from FM 1396 southward along a new location, CR 2650, and CR 2945 to the current northern limit of FM 897, a distance of approximately 5.6 miles, and realigns and designates FM 897 from its current northern limit southwestward along a new location to US 82 and eastward concurrent with US 82 to the current intersection of FM 897 and US 82, a distance of approximately 1.4 miles. e. Designation of Access Control (1) Dallas County - SH 161, in the City of Irving - Consider the designation of one location on the SH 161 northbound frontage road at which access will be permitted to the abutting property (MO) The designation of one 35-foot break in the control-of-access line will allow the abutting landowner to open one commercial driveway for access to and from the SH 161 northbound frontage road. The district has determined that access may be permitted at the designated location. (2) Montgomery County - SH 99, near the community of Porter - Consider the designation of one location on the SH 99 eastbound exit ramp at FM 1314 at which access will be permitted to the abutting property (MO) The designation of one 50.77-foot break in the control-of-access line will allow the abutting landowner to open one commercial driveway for access to and from the SH 99 eastbound exit ramp. Funds for the purchase of these properties were appropriated by the 86th Legislature, General Appropriations Act for the 2020-21 Biennium. The department requests the commission’s authorization to enter into purchase contracts and related documents to complete the acquisition of the listed properties. g.
