Legislative Appropriations Request (LAR) Consider the adoption of the Texas Department of Transportation's Fiscal Year 2022-2023 Legislative Appropriations Request (MO) (Presentation) Every two years the department is required to submit a Legislative Appropriations Request (LAR) for the upcoming biennium to be considered by the Texas Legislature. The proposed LAR describes the level of funding, method of finance, and FTEs associated with the department's strategies for the fiscal year 2022-2023 biennium. State law requires the department to deliver the LAR to the commission in an open meeting not later than the 30th day before the date the department submits the LAR to the Legislative Budget Board and the Governor’s Office.
Texas Transportation Plan 2050 Consider the adoption of the Texas Transportation Plan (TTP) 2050 (MO) (Presentation) Federal and state law require the department to develop a performance-based, statewide, multimodal, and intermodal plan for passengers and freight. This minute order adopts the TTP 2050 as the department’s updated statewide long-range transportation plan.
Unified Transportation Program (UTP) Consider the approval of the 2021 Unified Transportation Program (MO) (Presentation) The Unified Transportation Program (UTP) is a 10-year statewide plan for transportation project development. The Project Selection Process (PSP) is approved annually and describes the funding categories and process for selecting transportation projects. This minute order approves the 2021 UTP for fiscal years 2021-2030 as well as the PSP for the 2021 UTP.
Project Development Agreement - 183A Phase III Project Williamson County Consider (i) authorizing the Central Texas Regional Mobility Authority (CTRMA) to use state owned right of way to develop, construct, and operate an approximately 6.6 mile extension of 183A from Hero Way to just north of SH 29 in Williamson County (183A Phase III Project), comprised of CTRMA’s toll project consisting of two tolled main lanes in each direction (Authority Improvements) and non-tolled improvements to the existing US 183 from approximately the junction of the existing 183A and US 183 northward to just north of SH 29, along with general purpose lane extensions of US 183 north of SH 29 (TxDOT Improvements); (ii) approving the connection of the Authority Improvements with a segment of the state highway system; (iii) authorizing CTRMA to develop, design, and construct improvements to the state highway system in connection with the funding, design, and construction of the non-tolled TxDOT Improvements; and (iv) authorizing the executive director to enter into a project development agreement and take all actions necessary to carry out the provisions of the minute order (MO) This minute order approves CTRMA’s 183A Phase III Project and its connection to a segment of the state highway system. No state funds will be used for the 183A Phase III Project.
Various Counties - Consider the award of federal non-primary entitlement grant funding, federal apportionment grant funding, and state grant funding for airport improvement projects at various locations (MO) Federal law authorizes the award of federal non-primary entitlement grant funding and federal apportionment grant funding to preserve and improve the state's general aviation system. State law authorizes the award of state grant funding for capital improvement projects.
Aviation Capital Improvement Program Consider the approval of the Aviation Capital Improvement Program (MO) The department is required to prepare and update annually a multi-year aviation facilities capital improvement program. The department is seeking commission approval of this program.
Routine Airport Maintenance Program Consider the approval of the Routine Airport Maintenance Program (MO) State law authorizes the award of state funding for routine airport maintenance projects. The recommended airports are eligible for award of these grant funds and the department seeks approval of the awards.
Advisory Committee Appointments Aviation Advisory Committee Consider the appointment of members to the Aviation Advisory Committee (MO) The commission shall appoint each member for a term not to exceed three years. This minute order approves the appointment of three members to the Aviation Advisory Committee to fill the vacated terms.
Bicycle Advisory Committee Consider the appointment of members to the Bicycle Advisory Committee (MO) The Bicycle Advisory Committee advises the commission on bicycle issues and matters of mutual coBy involving representatives of the public, including bicyclists and other interested parties, the department helps ensure effective communication with the bicycling community, and that the bicyclist's perspective will be considered in the development of departmental policies related to bicycle use, including the design, construction, and maintenance of highways.ncern between the department and the bicycling community.
Border Trade Advisory Committee Consider the appointment of members to the Border Trade Advisory Committee (MO) This minute order appoints members to the Border Trade Advisory Committee. The purpose of the committee, created in 2001 by the 77th Legislature, is to define and develop a strategy and make recommendations to the commission and the governor, in order to address the highest priority border trade transportation challenges.
Veteran Discount Program Various Counties - Consider the approval of costs for fiscal year 2021 associated with the Veteran Discount Program on the Central Texas Turnpike System, to be funded with payments received from SH 130 Concession Company, LLC in accordance with the SH 130, Segments 5&6 Facility Concession Agreement, and interest earned on those payments (SH 130 payments), and the allocation of funds from the SH 130 payments to that program and project (MO) The department has established a separate fund to account for and track projects and project costs funded with the SH 130 payments. This minute order authorizes certain program costs on the CTTS to be funded with those payments.
El Paso County - El Paso County - Consider preliminary approval of a request from El Paso County for a State Infrastructure Bank loan in the amount of up to $4,600,000 to pay for the costs of construction necessary for a non-tolled, off-system project to widen Pellicano Drive, add bike lanes, pedestrian walkways, and landscaping, and connect to Loop 375 in El Paso County, Texas (MO) El Paso County (County) will secure the loan with a pledge of ad-valorem tax revenues. The loan will be used to pay the County’s costs associated with the construction of a non-tolled, off-system project to widen Pellicano Drive, add bike lanes, pedestrian walkways, and landscaping, and connect to Loop 375 in El Paso County, Texas.
Bexar County - City of Shavano Park - Consider final approval of a request from the City of Shavano Park for a State Infrastructure Bank loan in the amount of up to $925,000 for a contribution to the department to pay for the costs of utility relocation necessary for a non-tolled state highway improvement project on FM 1535 in Bexar County, Texas (MO) The City of Shavano Park (City) will secure the loan with a pledge of water fund revenues and a backstop of general fund revenues. The loan will be used to pay the City’s contribution to the department for utility relocation necessary for a non-tolled state highway improvement project on FM 1535 in Bexar County, Texas.
Purchase Order Amendment Consider the approval of a material change to a purchase order awarded under Chapter 2155 of the Texas Government Code for the development, implementation, and operations support of the Toll Operations Division back office system. This system provides transaction processing, numerous interfaces to 3rd party systems, customer account maintenance, integration with a call center and customer support system, website services, and a general accounting system. (MO) This minute order proposes an amendment to a purchase order awarded under Government Code, Chapter 2155 for the development, implementation and operations support of the Toll Operations Division back office system. The terms of the purchase order allow the amendment being proposed. Section 2155.088, Government Code, requires that the governing body of a state agency, at a meeting, consider a material change to the contract for goods or services awarded under Chapter 2155, Government Code, and consider why that change is necessary. The proposed amendment is a material change as defined under Chapter 2155.
Eminent Domain Proceedings Various Counties - Consider the authorization of the filing of condemnation proceedings to acquire real property by eminent domain for non-controlled and controlled access highways (see attached itemized list) (MO) Commission findings, determinations, and authorizations for the state, by motion made in accordance with Senate Bill 18, 82nd Legislature, to acquire by eminent domain, upon the payment of adequate and just compensation, various ownership interests in specific parcels of real property that are needed to develop or improve both non-controlled and controlled access state highways, to include requesting the state attorney general to bring and pursue condemnation suits relating to those specific parcels of real property described in the attached itemized list.
Routine Minute Orders and Reports a. Donations to the Department Various Districts - Consider the acknowledgment of donations with a value of $500 or more, including donations of money, materials, services, or real property, that are made to the department for the purpose of assisting the department in carrying out its functions and duties or for improving access to or from a highway on the state highway system (see attached itemized list) (MO) State statutes require the commission to acknowledge the acceptance of a gift to the department that is valued at $500 or more. By the adoption of this minute order, the commission acknowledges the receipt and acceptance of the property specified in the minute order. b. Real Estate Dispositions The commission must approve the sales, transfers, and exchanges of state rights of way and other real properties that are no longer needed for a state highway purpose. It must also approve, accept, and acknowledge donations to the state of real property that is valued at $500 or more. (1) Bell County - SL 363 - Consider the removal from the system, transfer of jurisdiction, control, and maintenance, and transfer of right of way to the City of Temple, Texas (MO) The district has determined that a segment of roadway is no longer needed as part of the state highway system. The City of Temple (City) has agreed to assume jurisdiction, control, and maintenance and has requested that the right of way be transferred to the City. The right of way may be transferred to the City without cost to remain in use for public road purposes and will revert to the state if it ceases to be used for public road purposes. (2) Dallas County - I-30 - Consider the sale of right of way to an abutting landowner (MO) The district has determined that the land is no longer needed for highway purposes. An abutting landowner has requested to purchase the land, and it may be sold to the requester. (3) Dallas County - I-30 - Consider the sale of right of way to an abutting landowner (MO) The district has determined that the land is no longer needed for highway purposes. An abutting landowner has requested to purchase the land, and it may be sold to the requester. (4) Dallas County - I-30 - Consider the sale of right of way to an abutting landowner (MO) The district has determined that the land is no longer needed for highway purposes. (5) Denton County - FM 544 - Consider an exchange of right of way (MO) The district has determined that a portion of existing right of way is no longer needed for a state highway purpose. (6) Galveston County - I-45 - Consider the sale of right of way to an abutting landowner (MO) The district has determined that the land is no longer needed for highway purposes. An abutting landowner has requested to purchase the land, and it may be sold to the requester. (7) Lubbock County - SL 289 - Consider the sale of right of way to an abutting landowner (MO) The district has determined that the land is no longer needed for highway purposes. An abutting landowner has requested to purchase the land, and it may be sold to the requester. (8) Williamson County - RM 1431 - Consider the sale of real property to the successful bidder (MO) The district has determined that the land is no longer needed for highway purposes. The local governmental entities declined to purchase the land, and legal notice was posted for sale by sealed bid. A successful bidder has been identified, and the land may be sold to the successful bidder. c. Reports (1) Compliance Division Report State law requires the commission to establish a compliance program, include a Compliance Division to oversee the program. The Compliance Division is responsible for acting to prevent and detect serious breaches of department policy, fraud, waste, and abuse of office, including any acts of criminal conduct within the department. The Compliance Division is required to provide a monthly report to the commission regarding investigations and a summary of information relating to trends and recommendations. (2) Grimes and Montgomery Counties - Quarterly Construction Progress Report for the State Highway 249 System (Report) The commission financed a portion of the costs of the system with obligations issued pursuant to a trust agreement. In accordance with Section 407 of the trust agreement, the commission caused the general engineering consultant to prepare a construction progress report by the last day of the second month after the prior fiscal quarter and to submit the report to the commission. A copy of the report shall also be filed with the trustee and the Municipal Securities Rulemaking Board, through its Electronic Municipal Markets Access System. d. Finance (1) Investment Policy and Investment Strategies Consider the annual review and approval of the investment policy and investment strategies applicable to all funds of the commission not otherwise required to be invested by the comptroller (MO) This minute order approves the commission’s investment policy and investment strategies. The Public Funds Investment Act requires the commission to review the investment policy and investment strategies on an annual basis, and to approve by order any modifications to the investment policy and investment strategies. (2) Debt and Derivative Management Policies Consider the annual review of the debt management policy and derivative management policy for financing programs of the commission (MO) This minute order approves the debt management policy which establishes parameters for the commission's financing programs considering acceptable levels of risk, minimizing interest costs, and optimizing future flexibility with consideration to achieving and maintaining the best possible credit ratings. Additionally, this minute order approves the derivative management policy which establishes responsibilities, objectives, and guidelines for use of derivatives such as interest rate swaps and similar products to efficiently and prudently manage the commission's asset/liability profile. (3) Dallas and Denton Counties - Consider the approval of the I-35E Managed Lanes Project annual budget of revenues, operating and maintenance expenses, and capital expenditures (MO) This minute order approves the annual budget of revenues, operating and maintenance expenses, and capital expenditures for the I-35E Managed Lanes Project in Dallas and Denton counties. The commission financed a portion of the costs of the I-35E Project with a TIFIA loan. The trust agreement for the loan stipulates that the commission will adopt an annual budget by the business day preceding the first day of each fiscal year. (4) Travis and Williamson Counties - Consider the approval of the Central Texas Turnpike System annual operating, maintenance, and capital budgets (MO) This minute order approves the annual operating, maintenance, and capital budgets for the Central Texas Turnpike System (CTTS) which consists of SH 130 Segments 1-4, SH 45N, SH 45SE, and Loop 1 extension. Some costs of the CTTS were financed with debt obligations. The Indenture of Trust stipulates that the commission will adopt annual budgets by August 31 of the preceding fiscal year. e. Highway Designations (1) Culberson County - Consider redesignating the entirety of FM 3541 as FM 2185 and extending the designation of FM 2185 (MO) This minute order redesignates the entirety of FM 3541 as FM 2185 from the intersection of RM 652 southward to the terminus of FM 3541, a distance of approximately 6.3 miles, and extends the designation of FM 2185 from the terminus of the current FM 3541 southward along Smileys Road, Weatherby Road, County Road 501, Nevel Road, and Rustler Springs Road to the intersection of Looney Spur Road and the current FM 2185, a distance of approximately 30.0 miles. (2) Lubbock County - Near the city of Lubbock, consider designating a segment of US 84 along proposed SL 88 and redesignating a segment of US 84 as BU 84-D (MO) Minute Order 115000, dated July 27, 2017, designated SL 88 on a new location from US 84 northwest of Lubbock to US 84 southeast of Lubbock, a distance of approximately 36.9 miles. Upon completion of SL 88, this minute order designates a segment of US 84 along SL 88 from the intersection of FM 2641 southeastward to the intersection of CR 9657, a distance of approximately 36.9 miles thereby making SL 88 concurrent with US 84, and redesignates a segment of US 84 as BU 84-D from the intersection of US 84 and FM 2641 southeastward to the intersection of US 84 and CR 9657, a distance of approximately 36.0 miles. f. Land Acquisitions for Facilities Various Counties - Consider the grant of authority to the department to acquire real property for facilities (MO) The department is in the process of acquiring real property for the construction of new facilities and the expansion of existing facility sites. Funds for the purchase of these properties were appropriated by the 86th Legislature, General Appropriations Act for the 2020-21 Biennium. The department requests the commission’s authorization to enter into purchase contracts and related documents to complete the acquisition of the listed properties. g. Designation of Access Control Caldwell County - SH 130, in the city of Lockhart - Consider the redesignation of one location on the southbound frontage road of SH 130 at which access will be permitted to the abutting property (MO) The redesignation of one 60-foot break in the control-of-access line with one proposed 60-foot break in the control-of-access line will allow the abutting landowners to open one agricultural / commercial driveway for access to and from the southbound frontage road of SH 130. The district has determined that access may be permitted at the designated location. h. Prohibition Order Various Counties - Consider issuing an order prohibiting the operation of certain motor vehicles on Texas Department of Transportation toll projects (MO) Transportation Code, Section 372.110, authorizes the commission to issue an order prohibiting the operation of a motor vehicle on a department toll project if the registered owner of the vehicle has been finally determined to be a habitual violator, subject to certain notice requirements. A person commits an offense if the person operates a motor vehicle on a toll project in violation of the order. Subsequent offenses may result in impoundment of the vehicle. i. Speed Zones Various Counties - Consider the establishment or alteration of regulatory and construction speed zones on various sections of highways in the state (MO) This minute order establishes or alters regulatory and construction speed zones on various sections of highways in the state.

This system provides transaction processing, numerous interfaces to 3rd party systems, customer account maintenance, integration with a call center and customer support system, website services, and a general accounting system. (MO) This minute order proposes an amendment to a purchase order awarded under Government Code, Chapter 2155 for the development, implementation and operations support of the Toll Operations Division back office system. The terms of the purchase order allow the amendment being proposed. Section 2155.088, Government Code, requires that the governing body of a state agency, at a meeting, consider a material change to the contract for goods or services awarded under Chapter 2155, Government Code, and consider why that change is necessary. The proposed amendment is a material change as defined under Chapter 2155.
Eminent Domain Proceedings Various Counties - Consider the authorization of the filing of condemnation proceedings to acquire real property by eminent domain for non-controlled and controlled access highways (see attached itemized list) (MO) Commission findings, determinations, and authorizations for the state, by motion made in accordance with Senate Bill 18, 82nd Legislature, to acquire by eminent domain, upon the payment of adequate and just compensation, various ownership interests in specific parcels of real property that are needed to develop or improve both non-controlled and controlled access state highways, to include requesting the state attorney general to bring and pursue condemnation suits relating to those specific parcels of real property described in the attached itemized list.
Routine Minute Orders and Reports a. Donations to the Department Various Districts - Consider the acknowledgment of donations with a value of $500 or more, including donations of money, materials, services, or real property, that are made to the department for the purpose of assisting the department in carrying out its functions and duties or for improving access to or from a highway on the state highway system (see attached itemized list) (MO) State statutes require the commission to acknowledge the acceptance of a gift to the department that is valued at $500 or more. By the adoption of this minute order, the commission acknowledges the receipt and acceptance of the property specified in the minute order. b. Real Estate Dispositions The commission must approve the sales, transfers, and exchanges of state rights of way and other real properties that are no longer needed for a state highway purpose. It must also approve, accept, and acknowledge donations to the state of real property that is valued at $500 or more. (1) Bell County - SL 363 - Consider the removal from the system, transfer of jurisdiction, control, and maintenance, and transfer of right of way to the City of Temple, Texas (MO) The district has determined that a segment of roadway is no longer needed as part of the state highway system. The City of Temple (City) has agreed to assume jurisdiction, control, and maintenance and has requested that the right of way be transferred to the City. The right of way may be transferred to the City without cost to remain in use for public road purposes and will revert to the state if it ceases to be used for public road purposes. (2) Dallas County - I-30 - Consider the sale of right of way to an abutting landowner (MO) The district has determined that the land is no longer needed for highway purposes. An abutting landowner has requested to purchase the land, and it may be sold to the requester. (3) Dallas County - I-30 - Consider the sale of right of way to an abutting landowner (MO) The district has determined that the land is no longer needed for highway purposes. An abutting landowner has requested to purchase the land, and it may be sold to the requester. (4) Dallas County - I-30 - Consider the sale of right of way to an abutting landowner (MO) The district has determined that the land is no longer needed for highway purposes. An abutting landowner has requested to purchase the land, and it may be sold to the requester. (5) Denton County - FM 544 - Consider an exchange of right of way (MO) The district has determined that a portion of existing right of way is no longer needed for a state highway purpose. (6) Galveston County - I-45 - Consider the sale of right of way to an abutting landowner (MO) The district has determined that the land is no longer needed for highway purposes. An abutting landowner has requested to purchase the land, and it may be sold to the requester. (7) Lubbock County - SL 289 - Consider the sale of right of way to an abutting landowner (MO) The district has determined that the land is no longer needed for highway purposes. An abutting landowner has requested to purchase the land, and it may be sold to the requester. (8) Williamson County - RM 1431 - Consider the sale of real property to the successful bidder (MO) The district has determined that the land is no longer needed for highway purposes. The local governmental entities declined to purchase the land, and legal notice was posted for sale by sealed bid. A successful bidder has been identified, and the land may be sold to the successful bidder. c. Reports (1) Compliance Division Report State law requires the commission to establish a compliance program, include a Compliance Division to oversee the program. The Compliance Division is responsible for acting to prevent and detect serious breaches of department policy, fraud, waste, and abuse of office, including any acts of criminal conduct within the department. The Compliance Division is required to provide a monthly report to the commission regarding investigations and a summary of information relating to trends and recommendations. (2) Grimes and Montgomery Counties - Quarterly Construction Progress Report for the State Highway 249 System (Report) The commission financed a portion of the costs of the system with obligations issued pursuant to a trust agreement. In accordance with Section 407 of the trust agreement, the commission caused the general engineering consultant to prepare a construction progress report by the last day of the second month after the prior fiscal quarter and to submit the report to the commission. A copy of the report shall also be filed with the trustee and the Municipal Securities Rulemaking Board, through its Electronic Municipal Markets Access System. d. Finance (1) Investment Policy and Investment Strategies Consider the annual review and approval of the investment policy and investment strategies applicable to all funds of the commission not otherwise required to be invested by the comptroller (MO) This minute order approves the commission’s investment policy and investment strategies. The Public Funds Investment Act requires the commission to review the investment policy and investment strategies on an annual basis, and to approve by order any modifications to the investment policy and investment strategies. (2) Debt and Derivative Management Policies Consider the annual review of the debt management policy and derivative management policy for financing programs of the commission (MO) This minute order approves the debt management policy which establishes parameters for the commission's financing programs considering acceptable levels of risk, minimizing interest costs, and optimizing future flexibility with consideration to achieving and maintaining the best possible credit ratings. Additionally, this minute order approves the derivative management policy which establishes responsibilities, objectives, and guidelines for use of derivatives such as interest rate swaps and similar products to efficiently and prudently manage the commission's asset/liability profile. (3) Dallas and Denton Counties - Consider the approval of the I-35E Managed Lanes Project annual budget of revenues, operating and maintenance expenses, and capital expenditures (MO) This minute order approves the annual budget of revenues, operating and maintenance expenses, and capital expenditures for the I-35E Managed Lanes Project in Dallas and Denton counties. The commission financed a portion of the costs of the I-35E Project with a TIFIA loan. The trust agreement for the loan stipulates that the commission will adopt an annual budget by the business day preceding the first day of each fiscal year. (4) Travis and Williamson Counties - Consider the approval of the Central Texas Turnpike System annual operating, maintenance, and capital budgets (MO) This minute order approves the annual operating, maintenance, and capital budgets for the Central Texas Turnpike System (CTTS) which consists of SH 130 Segments 1-4, SH 45N, SH 45SE, and Loop 1 extension. Some costs of the CTTS were financed with debt obligations. The Indenture of Trust stipulates that the commission will adopt annual budgets by August 31 of the preceding fiscal year. e. Highway Designations (1) Culberson County - Consider redesignating the entirety of FM 3541 as FM 2185 and extending the designation of FM 2185 (MO) This minute order redesignates the entirety of FM 3541 as FM 2185 from the intersection of RM 652 southward to the terminus of FM 3541, a distance of approximately 6.3 miles, and extends the designation of FM 2185 from the terminus of the current FM 3541 southward along Smileys Road, Weatherby Road, County Road 501, Nevel Road, and Rustler Springs Road to the intersection of Looney Spur Road and the current FM 2185, a distance of approximately 30.0 miles. (2) Lubbock County - Near the city of Lubbock, consider designating a segment of US 84 along proposed SL 88 and redesignating a segment of US 84 as BU 84-D (MO) Minute Order 115000, dated July 27, 2017, designated SL 88 on a new location from US 84 northwest of Lubbock to US 84 southeast of Lubbock, a distance of approximately 36.9 miles. Upon completion of SL 88, this minute order designates a segment of US 84 along SL 88 from the intersection of FM 2641 southeastward to the intersection of CR 9657, a distance of approximately 36.9 miles thereby making SL 88 concurrent with US 84, and redesignates a segment of US 84 as BU 84-D from the intersection of US 84 and FM 2641 southeastward to the intersection of US 84 and CR 9657, a distance of approximately 36.0 miles. f. Land Acquisitions for Facilities Various Counties - Consider the grant of authority to the department to acquire real property for facilities (MO) The department is in the process of acquiring real property for the construction of new facilities and the expansion of existing facility sites. Funds for the purchase of these properties were appropriated by the 86th Legislature, General Appropriations Act for the 2020-21 Biennium. The department requests the commission’s authorization to enter into purchase contracts and related documents to complete the acquisition of the listed properties. g. Designation of Access Control Caldwell County - SH 130, in the city of Lockhart - Consider the redesignation of one location on the southbound frontage road of SH 130 at which access will be permitted to the abutting property (MO) The redesignation of one 60-foot break in the control-of-access line with one proposed 60-foot break in the control-of-access line will allow the abutting landowners to open one agricultural / commercial driveway for access to and from the southbound frontage road of SH 130. The district has determined that access may be permitted at the designated location. h. Prohibition Order Various Counties - Consider issuing an order prohibiting the operation of certain motor vehicles on Texas Department of Transportation toll projects (MO) Transportation Code, Section 372.110, authorizes the commission to issue an order prohibiting the operation of a motor vehicle on a department toll project if the registered owner of the vehicle has been finally determined to be a habitual violator, subject to certain notice requirements. A person commits an offense if the person operates a motor vehicle on a toll project in violation of the order. Subsequent offenses may result in impoundment of the vehicle. i. Speed Zones Various Counties - Consider the establishment or alteration of regulatory and construction speed zones on various sections of highways in the state (MO) This minute order establishes or alters regulatory and construction speed zones on various sections of highways in the state.

Executive Session Pursuant to Government Code, Chapter 551 Section 551.071 - Consultation with and advice from legal counsel regarding any item on this agenda, pending or contemplated litigation, or other legal matters.
