Discussion Item Legislative Appropriations Request (LAR) Discuss the Texas Department of Transportation's proposed Fiscal Year 2022-2023 Legislative Appropriations Request (LAR) (Presentation) Every two years the department is required to submit a Legislative Appropriations Request (LAR) for the upcoming biennium to be considered by the Texas Legislature. The proposed LAR describes the level of funding, method of finance, and FTEs associated with the department's strategies for the fiscal year 2022- 2023 biennium. State law requires the department to deliver the LAR to the commission in an open meeting not later than the 30th day before the date the department submits the LAR to the Legislative Budget Board and the Governor’s Office.
Aviation Various Counties - Consider the award of federal non-primary entitlement grant funding, federal apportionment grant funding, and state grant funding for airport improvement projects at various locations (MO) Federal law authorizes the award of federal non-primary entitlement grant funding and federal apportionment grant funding to preserve and improve the state's general aviation system. State law authorizes the award of state grant funding for capital improvement projects.
Public Transportation Various Counties - Consider the award of state funds and federal §5304 Statewide and Non-metropolitan Transportation Planning Program funds to designated lead agencies (MO) The awards identified in this minute order reflect the allocation of state funds and federal §5304 funds to locally designated lead agencies for the Regionally Coordinated Transportation Planning 5 Year Plan update.
Design Build Contracts Dallas County - I-35E Phase 2 Project - Consider authorizing the department to issue a request for proposals to design, construct and maintain the I-35E Phase 2 Project, consisting of the full reconstruction and widening of the I-35E corridor from I-635 to the Denton County line in Dallas County, and “grandfathering” the existing two reversible toll managed lanes with no new toll lanes; and consider approving stipulated amounts as payment for the work product of unsuccessful proposers. The project includes the addition of one general purpose lane and one frontage road lane in each direction. The project will not include funding from either Proposition 1 or Proposition 7. (MO) (Presentation) On April 30, 2020, in Minute Order 115724, the commission authorized the department to issue a request for qualifications to design, construct and maintain the I-35E Phase 2 Project. This minute order continues the procurement process by authorizing the issuance of a request for proposals for the project and approves stipulated amounts for the payment of work product of responsive, unsuccessful proposers.
Debt Management Consider authorizing certain commission representatives, including the chief financial officer and the director of the Project Finance, Debt and Strategic Contracts Division, to act on behalf of the commission to make all disclosure filings and submit reports, including disclosure reports, in relation to the commission’s outstanding debt obligations (MO) This minute order will authorize certain commission representatives, including the chief financial officer and the director of the Project Finance, Debt and Strategic Contracts Division, named in the commission’s various bond resolutions and trust indentures, to make all disclosure filings and submit reports, including continuing disclosure reports, without further action by the commission, in relation to the commission’s debt obligations for the Central Texas Turnpike System, I-35E System, SH 249 System, and Highway Improvement General Obligation, State Highway Fund, and Texas Mobility Fund.
Eminent Domain Proceedings Various Counties - Consider the authorization of the filing of condemnation proceedings to acquire real property by eminent domain for non-controlled and controlled access highways (see attached itemized list) (MO) Commission findings, determinations, and authorizations for the state, by motion made in accordance with Senate Bill 18, 82nd Legislature, to acquire by eminent domain, upon the payment of adequate and just compensation, various ownership interests in specific parcels of real property that are needed to develop or improve both non-controlled and controlled access state highways, to include requesting the state attorney general to bring and pursue condemnation suits relating to those specific parcels of real property described in the attached itemized list.
Routine Minute Orders and Reports a. Donations to the Department Various Districts - Consider the acknowledgment of donations with a value of $500 or more, including donations of money, materials, services, or real property, that are made to the department for the purpose of assisting the department in carrying out its functions and duties or for improving access to or from a highway on the state highway system (see attached itemized list) (MO) State statutes require the commission to acknowledge the acceptance of a gift to the department that is valued at $500 or more. By the adoption of this minute order, the commission acknowledges the receipt and acceptance of the property specified in the minute order. b. Real Estate Dispositions The commission must approve the sales, transfers, and exchanges of state rights of way and other real properties that are no longer needed for a state highway purpose. It must also approve, accept, and acknowledge donations to the state of real property that is valued at $500 or more. (1) Burnet County - FM 1431 - Consider an easement release to the underlying fee owner (MO) The district has determined that the easement is no longer needed for highway purposes. The easement may be released to the underlying fee owner. (4) Harris County - US 90 - Consider the sale of right of way to an abutting landowner (MO) The district has determined that the land is no longer needed for highway purposes. An abutting landowner has requested to purchase the land, and it may be sold to the requester. (5) Harris County - I-10 - Consider an exchange of real property (MO) The district has determined that certain real property is no longer needed for a state highway purpose. Silver Eagle Beverages, LLC has entered into an Exchange Agreement with the department whereby it would acquire the unneeded real property (Tract 1) in exchange for certain land (Parcel A) that is needed for a state highway purpose. Silver Eagle Beverages, LLC will pay the department the $66,440 difference in values at closing. (6) Reeves County - FM 761 - Consider the removal from the system, transfer of jurisdiction, control, and maintenance, and transfer of right of way to the Town of Pecos City (MO) The district has determined that a segment of public road is no longer needed as part of the system. The town has agreed to assume jurisdiction, control, and maintenance and has requested that the right of way be transferred to the town. The right of way may be transferred to the town without cost to remain in use for public road purposes and will revert to the state if it ceases to be used for public road purposes. c. Reports (1) Compliance Division Report State law requires the commission to establish a compliance program, which must include a Compliance Division to oversee the program. The Compliance Division is responsible for acting to prevent and detect serious breaches of department policy, fraud, waste, and abuse of office, including any acts of criminal conduct within the department. The Compliance Division is required to provide a monthly report to the commission regarding investigations and a summary of information relating to trends and recommendations. c. Reports (continued) (2) Letting allocation status report Consider the acceptance of the quarterly status report on the FY 2020 letting allocation, the actual allocation utilized through the current month, proposed remaining highway maintenance and construction contract letting for the fiscal year (Report) This report will provide the current overall allocation status, by district and metropolitan planning organization, of the FY 2020 letting allocation and will also provide the anticipated effect on the letting allocation of remaining proposed highway maintenance and construction letting. (3) State Highway Fund 6 Consider the acceptance of the quarterly report on FY 2020 State Highway Fund 6 cash status (Report) This report updates the commission on the year-to-date cash balance and activity of Fund 6. The report will include original projections and actual revenues/inflows and expenditures/outflows on a cash basis. (4) Quarterly Investment Report Consider the acceptance of the Quarterly Investment Report for all of the funds invested at the direction of the commission (Report) This is a presentation of the quarterly investment report for the investment of: (1) funds held by the Bank of New York Mellon, as trustee, under the Indenture of Trust securing the Central Texas Turnpike System toll revenue obligations; (2) funds for the pre-paid TxTag account held by the Bank of New York Mellon, acting as custodian; (3) funds held by Amegy Bank, a Division of ZB, National Association, as trustee, under the Trust Agreement securing the IH 35E Managed Lanes Project toll revenue obligations; and (4) funds held by U.S. Bank National Association, as trustee, under the Master Trust Agreement securing the SH 249 System toll revenue obligations. d. Any series of refunding bonds must achieve a net present value debt service savings of at least 3% of the bonds refunded. (4) Central Texas Turnpike System Bonds Consider approving the Ninth Supplemental Indenture authorizing the issuance of one or more series of Central Texas Turnpike System (CTTS) revenue refunding bonds to refund all or any portion of the outstanding CTTS bonds, the documents relating to such bonds, the refinancing or remarketing of certain outstanding CTTS bonds without incurring additional debt and without extending the final maturity, if financial market conditions are favorable for refinancing, and the designation of department officials to take all actions necessary to deliver the bonds (MO) This action provides final authorization for the chief financial officer and other designated department officials to move forward with remarketing outstanding CTTS bonds subject to mandatory tender, the issuance of one or more series of CTTS revenue refunding bonds to refund all or any portion of outstanding bonds and approve official statements, bond purchase contracts, escrow agreements, and other related documents as authorized by Government Code Chapters 1207 and 1371.
