Consider the approval of the Minutes of the February 27, 2020, regular meeting of the Texas Transportation Commission
Contracts Consider the award or rejection of contracts for highway construction and maintenance, and construction and rehabilitation of buildings These proposed minute orders contain information concerning the receipt of bids for highway improvement contracts. The department may reschedule receipt of bids for those projects where the commission rejects all bids. Those bids accepted by the commission will result in conditional contract awards to the low bidders. Contract award conditions may involve securing funding from other sources, the contractor's ability to satisfy federal DBE subcontracting requirements, or other requirements as outlined in the project bid proposal. Public Transportation Various Counties - Consider the award of federal §5311 Formula Grants for Rural Areas Program funds and §5339 Bus and Bus Facilities program funds to rural transit districts (MO) The awards identified in this minute order reflect the allocation of Federal Transit Administration fiscal year 2020 §5311 Formula Grants for Rural Areas Program funds and fiscal years 2019 and 2020 §5339 Bus and Bus Facilities Program funds to rural transit districts. Allocations to rural transit districts are determined by formula as established in Texas Administrative Code, Title 43, Chapter 31.
County Transportation Infrastructure Fund Grant Program Consider authorizing the designation of a period of time for counties to submit applications requesting grants under the County Transportation Infrastructure Fund Grant Program for funding transportation infrastructure projects located in areas of the state affected by increased oil and gas production, and prescribe the conditions that will be applicable to the grant award process (MO) The department is required by Transportation Code, §256.103, to administer the County Transportation Infrastructure Fund to provide funding for transportation infrastructure projects located in areas of the state affected by increased oil and gas production. This minute order will authorize the submission of applications from counties, and designate the period of time for the submission and the estimated total amount of funds available for grants in the designated period.
Eminent Domain Proceedings Various Counties - Consider the authorization of the filing of condemnation proceedings to acquire real property by eminent domain for non-controlled and controlled access highways (see attached itemized list) (MO) Commission findings, determinations, and authorizations for the state, by motion made in accordance with Senate Bill 18, 82nd Legislature, to acquire by eminent domain, upon the payment of adequate and just compensation, various ownership interests in specific parcels of real property that are needed to develop or improve both non-controlled and controlled access state highways, to include requesting the state attorney general to bring and pursue condemnation suits relating to those specific parcels of real property described in the attached itemized list.
Routine Minute Orders and Reports a. Donations to the Department 115710 Various Districts - Consider the acknowledgment of donations with a value of $500 or more, including donations of money, materials, services, or real property, that are made to the department for the purpose of assisting the department in carrying out its functions and duties or for improving access to or from a highway on the state highway system (see attached itemized list) (MO) State statutes require the commission to acknowledge the acceptance of a gift to the department that is valued at $500 or more. By the adoption of this minute order, the commission acknowledges the receipt and acceptance of the property specified in the minute order. b. Real Estate Dispositions The commission must approve the sales, transfers, and exchanges of state rights of way and other real properties that are no longer needed for a state highway purpose. It must also approve, accept, and acknowledge donations to the state of real property that is valued at $500 or more. 115711 (1) Bell County - SH 317 - Consider the removal from the system, transfer of jurisdiction, control, and maintenance, and transfer of right of way to the City of Temple (MO) The district has determined that a portion of the right of way is no longer needed as part of the system. The city has agreed to assume jurisdiction, control, and maintenance and has requested that the right of way be transferred to the city. The right of way may be transferred to the city without cost to remain in use for public road purposes, and it will revert to the state if it ceases to be used for public road purposes. 115712 (2) DeWitt County - SH 72 - Consider the exchange of right of way as part of a transaction to acquire real property needed for a state highway purpose (MO) The district has determined that the land to be conveyed by the State in the exchange is no longer needed for a state highway purpose. The governor, on the recommendation of the commission, may execute a deed exchanging an interest in real property acquired but not needed for a highway purpose as whole or partial consideration for another interest in real property needed for a state highway purpose. 115713 (3) Fort Bend County - US 59 - Consider the removal from the system, transfer of jurisdiction, control, and maintenance, and transfer of right of way to Fort Bend County (MO) The district has determined that a segment of right of way is no longer needed as part of the system. The county has agreed to assume jurisdiction, control, and maintenance and has requested that the right of way be transferred to the county. The right of way may be transferred to the county without cost to remain in use for public road purposes, and it will revert to the state if it ceases to be used for public road purposes. 115714 (4) Rockwall County - SH 205 - Consider the sale of right of way to an abutting landowner (MO) The district has determined that the land is no longer needed for highway purposes. An abutting landowner has requested to purchase the land, and it may be sold to the requester. b. Real Estate Dispositions (continued) 115715 (5) Williamson County - FM 3406 & SS 379 - Consider the removal from the system, transfer of jurisdiction, control, and maintenance, and transfer of right of way to the City of Round Rock (MO) The district has determined that a segment of right of way is no longer needed as part of the system. The city has agreed to assume jurisdiction, control, and maintenance and has requested that the right of way be transferred to the city. The right of way may be transferred to the city without cost to remain in use for public road purposes, and it will revert to the state if it ceases to be used for public road purposes. c. Report Compliance Division Report State law requires the commission to establish a compliance program, which must include a Compliance Division to oversee the program. The Compliance Division is responsible for acting to prevent and detect serious breaches of department policy, fraud, waste, and abuse of office, including any acts of criminal conduct within the department. The Compliance Division is required to provide a monthly report to the commission regarding investigations and a summary of information relating to trends and recommendations. d. Highway Designations 115716 (1) Cameron County - In Brownsville, consider designating a segment of the state highway system as I-169, concurrent with SH 550 (MO) This minute order designates a segment of the state highway system as I-169, concurrent with SH 550 from Old Alice Road to approximately 0.4 mile east of FM 1847 in Brownsville, a distance of approximately 2.5 miles. The Brownsville Metropolitan Planning Organization, American Association of State Highway and Transportation Officials, and the Federal Highway Administration have approved the designation of this segment. 115717 (2) Williamson County - Consider designating multiple segments of SH 195 on new locations, re-designating segments of SH 195 as Business State Highway 195-H, State Highway Spur 376, and State Highway Spur 377, and extending the designation of SH 138 on the state highway system (MO) This minute order designates SH 195 on a new location north of SH 138 southward to south of FM 970 and re-designates the former alignment as BS 195-H; designates SH 195 on a new location from the intersection of County Road 241 southward to the former alignment of SH 195 and re-designates the former alignment as SS 376; designates SH 195 on a new location north of County Road 239 southeastward to the former alignment of SH 195 and re-designates the former alignment as SS 377; and, extends the designation of SH 138 from the former alignment of SH 195 eastward to the new alignment of SH 195. e. Speed Zones 115718 Various Counties - Consider the establishment or alteration of regulatory and construction speed zones on various sections of highways in the state (MO) This minute order establishes or alters regulatory and construction speed zones on various sections of highways in the state.
