Regional Mobility Authority Various Counties - Consider authorizing Camp and Cass Counties to become part of the North East Texas Regional Mobility Authority (MO) The commission authorized the creation of the North East Texas Regional Mobility Authority (NET RMA) in October 2004. Under the department’s rules, one or more counties may request commission approval to become part of an existing regional mobility authority. The department has received a petition from Camp and Cass Counties requesting to join NET RMA. The board of directors of NET RMA has adopted a resolution agreeing to the addition.
Promulgation of Administrative Rules Under Title 43, Texas Administrative Code, and the Administrative Procedure Act, Government Code, Chapter 2001: Proposed Adoption Chapter 1 - Management New §1.90, Advisory Committees for Ports-to-Plains Corridor (MO) H.B. 1079, 86th Legislature, requires the department to establish a Ports-to-Plains Advisory Committee and corridor segment committees to assist the department in conducting a comprehensive study of the Ports-to-Plains Corridor. Government Code, Sec. 2110.005 requires a state agency to adopt rules that state the purpose and tasks of an advisory committee and that describe the way that the committee will report to the agency. This new rule provides the information required by Sec. 2110.005 and establishes sunset dates for the committees.
Chapter 15 - Financing and Construction of Transportation Projects Amendments to §15.51, Definitions, and §15.55 Construction Cost Participation (Federal, State, and Local Participation) (MO) S.B. 2168, 86th Legislature, expanded the Economically Disadvantaged Counties Program to include a county that meets the statutory eligibility criteria within the past six years and been included in no less than five federally declared disasters within that same time period. The proposed amendments conform the administrative rules to the revised statute.
Chapter 1 - Management Amendments to §1.82 and §§1.85 - 1.87; Repeal of §1.88 and New §1.88 (Advisory Committees) (MO) The proposed amendments extend the sunset dates for statutory and department advisory committees and repeal, as executed, a rule that required a one-time report by each advisory committee.
Eminent Domain Proceedings Various Counties - Consider the authorization of the filing of condemnation proceedings to acquire real property by eminent domain for non-controlled and controlled access highways (see attached itemized list) (MO) Commission findings, determinations, and authorizations for the state, by motion made in accordance with S.B. 18, 82nd Legislature, to acquire by eminent domain, upon the payment of adequate and just compensation, various ownership interests in specific parcels of real property that are needed to develop or improve both non-controlled and controlled access state highways, to include requesting the state attorney general to bring and pursue condemnation suits relating to those specific parcels of real property described in the attached itemized list.
Aviation (Presentation) Routine Airport Maintenance Program Consider the approval of the Routine Airport Maintenance Program (MO) State law authorizes the award of state funding for routine airport maintenance projects. Historically, approximately $4 million per year has been allocated through the Routine Airport Maintenance Program for grants to eligible airports. The recommended airports are eligible for award of these grant funds and the department seeks approval of the listed airports for awards.
Aviation (continued) Aviation Capital Improvement Program Consider the approval of the Aviation Capital Improvement Program (MO) The department is required to prepare and update annually a multi-year aviation facilities capital improvement program. The department is seeking commission approval of this program.
Various Counties - Consider the award of federal discretionary grant funding, federal supplemental funding, federal non-primary entitlement grant funding, federal apportionment grant funding, and state grant funding for airport improvement projects at various locations (MO) Federal law authorizes the award of federal discretionary grant funding, federal supplemental funding, federal non-primary entitlement grant funding, and federal apportionment grant funding through the Consolidated Appropriations Acts, 2018, to preserve and improve the state's general aviation system. State law authorizes the award of state grant funding for capital improvement projects.

Prohibition Order Various Counties - Consider issuing an order prohibiting the operation of certain motor vehicles on Texas Department of Transportation toll projects (MO) Transportation Code, Section 372.110, authorizes the commission to issue an order prohibiting the operation of a motor vehicle on a department toll project if the registered owner of the vehicle has been finally determined to be a habitual violator, subject to certain notice requirements. A person commits an offense if the person operates a motor vehicle on a toll project in violation of the order. Subsequent offenses may result in impoundment of the vehicle.

Donations to the Department Various Districts - Consider the acknowledgment of donations with a value of $500 or more, including donations of money, materials, services, or real property, that are made to the department for the purpose of assisting the department in carrying out its functions and duties or for improving access to or from a highway on the state highway system (see attached itemized list) (MO) State statutes require the commission to acknowledge the acceptance of a gift to the department that is valued at $500 or more. Real Estate Dispositions The commission must approve the sales, transfers, and exchanges of state rights of way and other real properties that are no longer needed for a state highway purpose. It must also approve, accept, and acknowledge donations to the state of real property that is valued at $500 or more. (1) Collin County - SH 289 - Consider an easement release to the underlying fee owner Celina Preston 2016 Partners LLC (MO) The district has determined that the easement is no longer needed for highway purposes. The easement may be released to the underlying fee owner. (2) Denton County - US 377 - Consider the exchange of right of way as part of the settlement of eminent domain litigation in the matter of State of Texas v. Peterson/Coleman Family Partnership, a Texas Limited Partnership, et al., Cause No. PR-2016-00515 (MO) The district has determined that the land to be conveyed by the state in the exchange is no longer needed for a state highway purpose. The governor, on the recommendation of the commission, may execute a deed exchanging an interest in real property acquired but not needed for a highway purpose as whole or partial consideration for another interest in real property needed for a state highway purpose. (3) Randall County - SL 48 - Consider the removal from the system, and transfer of ownership, jurisdiction, control, and maintenance of right of way to the City of Canyon (MO) The district has determined that SL 48 is no longer needed as part of the state highway system. The City of Canyon (city) has agreed to assume jurisdiction, control, and maintenance and has requested that the right of way be transferred to the city. Minute Order 115523, dated June 27, 2019, recommending the execution of a proper instrument conveying all of the state’s right, title, and interest in SS 48 to the City of Canyon is rescinded and replaced by this order. 13. (5) Winkler County - SH 18/SH 302 - Consider an easement release to the underlying fee owner Pizza Properties, LLC, a Delaware Limited Liability Company doing business in Texas as Louisiana Pizza Properties, LLC (MO) The district has determined that the easement is no longer needed for highway purposes. The easement may be released to the underlying fee owner. c. Report Compliance Division Report State law requires the commission to establish a compliance program, which must include a Compliance Division to oversee the program. The Compliance Division is responsible for acting to prevent and detect serious breaches of department policy, fraud, waste, and abuse of office, including any acts of criminal conduct within the department. The Compliance Division is required to provide a monthly report to the commission regarding investigations and a summary of information relating to trends and recommendations. d. Finance (1) Consider the annual review and approval of the investment policy and investment strategies applicable to all funds of the commission not otherwise required to be invested by the comptroller; consider adopting investment strategies for funds to be held under the trust agreement securing a loan from the United States Department of Transportation pursuant to the Transportation Infrastructure Finance and Innovation Act of 1998 to pay a portion of the eligible project costs of the SH 183 Managed Lanes Project (Midtown Express) in Dallas and Tarrant counties (MO) This minute order approves the commission’s investment policy and investment strategies. The Public Funds Investment Act requires the commission to review the investment policy and investment strategies on an annual basis, and to approve by order any modifications to the investment policy and investment strategies. This minute order also adopts investment strategies for funds to be held under the trust agreement for the Transportation Infrastructure Finance and Innovation Act of 1998 loan for the SH 183 Managed Lanes Project (Midtown Express), which will be added to the investment policy. (2) Consider the annual review of debt management policy and derivative management policy for financing programs of the commission (MO) This minute order approves the debt management policy which establishes parameters for the commission's financing programs considering acceptable levels of risk, minimizing interest costs, and optimizing future flexibility with consideration to achieving and maintaining the best possible credit ratings. Additionally, this minute order approves the derivative management policy which establishes responsibilities, objectives and guidelines for use of derivatives such as interest rate swaps and similar products to efficiently and prudently manage the commission's asset/liability profile. 13. Finance (continued) (3) Dallas and Denton Counties - Consider the approval of the I-35E Managed Lanes Project annual budget of revenues, operating and maintenance expenses, and capital expenditures, and acceptance of the annual inspection report (MO) This minute order approves the annual budget of revenues, operating and maintenance expenses, and capital expenditures for the I-35E Managed Lanes Project in Dallas and Denton counties. The commission financed a portion of the costs of the I-35E Project with a TIFIA loan. The trust agreement for the loan stipulates that the commission will adopt an annual budget by the business day preceding the first day of each fiscal year. In addition, the trust agreement requires that the general engineering consultant perform an annual inspection on or before the 90th day prior to the end of each fiscal year and to submit an inspection report to the commission. (4) Montgomery and Grimes Counties - Consider the acceptance of the Quarterly Construction Progress Report for the State Highway 249 System (MO) Report of construction progress for the State Highway 249 System (system) as of May 31, 2019. The commission financed a portion of the costs of the system with obligations issued pursuant to a trust agreement dated February 1, 2019, between the commission and U.S. Bank National Association (trustee). Section 407 of the trust agreement requires the commission to cause the general engineering consultant to prepare a construction progress report at least quarterly and to file the report with the trustee and the commission. (5) Travis and Williamson Counties - Consider the approval of the Central Texas Turnpike System annual operating, maintenance, and capital budgets (MO) This minute order approves the annual operating, maintenance, and capital budgets for the Central Texas Turnpike System (CTTS) which consists of SH 130 Segments 1-4, SH 45N, SH 45SE, and Loop 1 extension. Some costs of the CTTS were financed with debt obligations. The Indenture of Trust stipulates that the commission will adopt annual budgets by August 31 of the preceding fiscal year. e. Transportation Planning Gregg County - In Longview, consider extending the designation of FM 2087 (MO) This minute order extends the designation of FM 2087 from SL 281 eastward along Toledo Circle, then southwestward along Sabine Street to SL 281, a distance of approximately 0.5 mile. f. Access Control Travis County - US 290, just east of Austin - Consider the designation of one location on the eastbound frontage road of US 290 at which access will be permitted to the abutting property (MO) The designation of one 75.24-foot break in the control-of-access line will allow the abutting landowner to open one multi-family residential driveway for access to and from the eastbound frontage road of US 290. The district has determined that access may be permitted at the designated location. g. Speed Zones Various Counties - Consider the establishment or alteration of regulatory and construction speed zones on various sections of highways in the state (MO) This minute order establishes or alters regulatory and construction speed zones on various sections of highways in the state.

The Compliance Division is responsible for acting to prevent and detect serious breaches of department policy, fraud, waste, and abuse of office, including any acts of criminal conduct within the department. The Compliance Division is required to provide a monthly report to the commission regarding investigations and a summary of information relating to trends and recommendations. d. Finance (1) Consider the annual review and approval of the investment policy and investment strategies applicable to all funds of the commission not otherwise required to be invested by the comptroller; consider adopting investment strategies for funds to be held under the trust agreement securing a loan from the United States Department of Transportation pursuant to the Transportation Infrastructure Finance and Innovation Act of 1998 to pay a portion of the eligible project costs of the SH 183 Managed Lanes Project (Midtown Express) in Dallas and Tarrant counties (MO) This minute order approves the commission’s investment policy and investment strategies. The Public Funds Investment Act requires the commission to review the investment policy and investment strategies on an annual basis, and to approve by order any modifications to the investment policy and investment strategies. This minute order also adopts investment strategies for funds to be held under the trust agreement for the Transportation Infrastructure Finance and Innovation Act of 1998 loan for the SH 183 Managed Lanes Project (Midtown Express), which will be added to the investment policy. (2) Consider the annual review of debt management policy and derivative management policy for financing programs of the commission (MO) This minute order approves the debt management policy which establishes parameters for the commission's financing programs considering acceptable levels of risk, minimizing interest costs, and optimizing future flexibility with consideration to achieving and maintaining the best possible credit ratings. Additionally, this minute order approves the derivative management policy which establishes responsibilities, objectives and guidelines for use of derivatives such as interest rate swaps and similar products to efficiently and prudently manage the commission's asset/liability profile. 13. Finance (continued) (3) Dallas and Denton Counties - Consider the approval of the I-35E Managed Lanes Project annual budget of revenues, operating and maintenance expenses, and capital expenditures, and acceptance of the annual inspection report (MO) This minute order approves the annual budget of revenues, operating and maintenance expenses, and capital expenditures for the I-35E Managed Lanes Project in Dallas and Denton counties. The commission financed a portion of the costs of the I-35E Project with a TIFIA loan. The trust agreement for the loan stipulates that the commission will adopt an annual budget by the business day preceding the first day of each fiscal year. In addition, the trust agreement requires that the general engineering consultant perform an annual inspection on or before the 90th day prior to the end of each fiscal year and to submit an inspection report to the commission. (4) Montgomery and Grimes Counties - Consider the acceptance of the Quarterly Construction Progress Report for the State Highway 249 System (MO) Report of construction progress for the State Highway 249 System (system) as of May 31, 2019. The commission financed a portion of the costs of the system with obligations issued pursuant to a trust agreement dated February 1, 2019, between the commission and U.S. Bank National Association (trustee). Section 407 of the trust agreement requires the commission to cause the general engineering consultant to prepare a construction progress report at least quarterly and to file the report with the trustee and the commission. (5) Travis and Williamson Counties - Consider the approval of the Central Texas Turnpike System annual operating, maintenance, and capital budgets (MO) This minute order approves the annual operating, maintenance, and capital budgets for the Central Texas Turnpike System (CTTS) which consists of SH 130 Segments 1-4, SH 45N, SH 45SE, and Loop 1 extension. Some costs of the CTTS were financed with debt obligations. The Indenture of Trust stipulates that the commission will adopt annual budgets by August 31 of the preceding fiscal year. e. Transportation Planning Gregg County - In Longview, consider extending the designation of FM 2087 (MO) This minute order extends the designation of FM 2087 from SL 281 eastward along Toledo Circle, then southwestward along Sabine Street to SL 281, a distance of approximately 0.5 mile. f. Access Control Travis County - US 290, just east of Austin - Consider the designation of one location on the eastbound frontage road of US 290 at which access will be permitted to the abutting property (MO) The designation of one 75.24-foot break in the control-of-access line will allow the abutting landowner to open one multi-family residential driveway for access to and from the eastbound frontage road of US 290. The district has determined that access may be permitted at the designated location. g. Speed Zones Various Counties - Consider the establishment or alteration of regulatory and construction speed zones on various sections of highways in the state (MO) This minute order establishes or alters regulatory and construction speed zones on various sections of highways in the state.
