Contracts Consider the award or rejection of contracts for highway construction and maintenance, and construction and rehabilitation of buildings (Presentation) These proposed minute orders contain information concerning the receipt of bids for highway improvement contracts. The department may reschedule receipt of bids for those projects where the commission rejects all bids. Those bids accepted by the commission will result in conditional contract awards to the low bidders. Contract award conditions may involve securing funding from other sources, the contractor's ability to satisfy federal DBE subcontracting requirements, or other requirements as outlined in the project bid proposal. Development of the 2020 Unified Transportation Program (UTP) candidate projects list (Presentation) The UTP is a 10-year statewide plan for transportation project development. The purpose of this presentation is to facilitate a discussion of the draft 2020 UTP planning targets and preliminary list of candidate projects for funding in Categories 2, 4, and 12.
Public Transportation Various Counties - Consider the award of federal §5311 Formula Grants for Rural Areas Program funds for FY 2019 (MO) The awards identified in this minute order reflect the formula allocation of federal grant funds from the Federal Transit Administration (FTA) §5311 Formula Grants for Rural Areas Program to rural public transportation providers for the fiscal year 2019 program of projects. The awards are anticipated to be a combination of prior year funds and funds contingent upon the availability of FY 2019 FTA apportionments to be published in the Federal Register.
Promulgation of Administrative Rules Under Title 43, Texas Administrative Code, and the Administrative Procedure Act, Government Code, Chapter 2001: Proposed Adoption Chapter 15 - Financing and Construction of Transportation Projects §§15.50 - 15.53, and §15.55 relating to Federal, State, and Local Participation (MO) The proposed changes to Chapter 15 replace the standard funding type for joint participation agreements between the department and local agencies with conditions under which the use of fixed price or specified percentage funding types are recommended based on characteristics of the highway improvement or other transportation project. The updates include revised criteria to be considered in determining fixed price amounts and in determining local agency performance of project activities. The proposed changes also move the chart with standard federal, state, and local funding participation ratios out of §15.55 and into department manuals.
Purchase of Right of Way Dallas County - SL 12 from Singleton Blvd to Union Bower Rd, and SH 114 from east of International Parkway to SP 348 - Consider authorizing the negotiation and acquisition by purchase of right of way for highway expansion while ensuring no funds from sources commonly known as Proposition 1 and Proposition 7 will be used (MO) The department desires to purchase property on SL 12 and SH 114 in Dallas County for possible use in or in connection with a transportation facility.
Travis County - I-35 - Consider authorizing the negotiation and advance acquisition by purchase of right of way for possible use in, or in connection with, a transportation facility before a final decision has been made as to whether the transportation facility will be located on that property or environmental clearance has been issued for the transportation facility by the appropriate federal or state authority while ensuring no funds from sources commonly known as Proposition 1 and Proposition 7 will be used (MO) State law authorizes the commission to acquire real property before a final decision is made as to the location of a transportation facility. The department desires to purchase property on I-35 in Travis County for possible use in, or in connection with, a transportation facility.
Eminent Domain Proceedings Various Counties - Consider the authorization of the filing of condemnation proceedings to acquire real property by eminent domain for non-controlled and controlled access highways (see attached itemized list) (MO) Commission findings, determinations, and authorizations for the state, by motion made in accordance with Senate Bill 18 (82nd Legislature), to acquire by eminent domain, upon the payment of adequate and just compensation, various ownership interests in specific parcels of real property that are needed to develop or improve both non-controlled and controlled access state highways, to include requesting the state attorney general to bring and pursue condemnation suits relating to those specific parcels of real property described in the attached itemized list.

It must also approve, accept, and acknowledge donations to the state of real property that is valued at $500 or more. (1) Bexar County - SS 53 - Consider the transfer of the tract and transfer of control, jurisdiction, and maintenance to the City of San Antonio and rescind Minute Order 114171 (MO) The district has determined that the land is no longer needed for highway purposes. The City of San Antonio (City) has agreed to assume control, jurisdiction, and maintenance. The tract may be transferred to the City. (2) Denton County - SL 288 - Consider the release of easement to Denton County (MO) The district has determined that the easement is no longer needed for highway purposes. The easement may be released to the owner of the underlying fee interest. (3) Harris County - FM 1960 - Consider the sale of right of way to an abutting landowner and rescind Minute Order 115397 (MO) The district has determined that the land is no longer needed for highway purposes. An abutting landowner has requested to purchase the land, and it may be sold to the requester. (4) Montgomery County - FM 830 - Consider the transfer of the tract to Montgomery County (MO) The district has determined that the land is no longer needed for highway purposes. The tract may be transferred to Montgomery County. (5) Nacogdoches County - US 59 at CR 525 - Consider the sale of right of way to an abutting landowner (MO) The district has determined that the land is no longer needed for highway purposes. An abutting landowner has requested to purchase the land, and it may be sold to the requester. (6) Rockwall County - SH 205 - Consider the sale of right of way to an abutting landowner (MO) The district has determined that the land is no longer needed for highway purposes. An abutting landowner has requested to purchase the land, and it may be sold to the requester. (7) Victoria County - US 59 and Hill Road - Consider the sale of right of way to an abutting landowner (MO) The district has determined that the land is no longer needed for highway purposes. Reports Compliance Division report State law requires the commission to establish a compliance program, which must include a Compliance Division to oversee the program. The Compliance Division is responsible for acting to prevent and detect serious breaches of department policy, fraud, waste, and abuse of office, including any acts of criminal conduct within the department. The Compliance Division is required to provide a monthly report to the commission regarding investigations and a summary of information relating to trends and recommendations. d. Transportation Planning Various Counties - Consider the approval of the Fiscal Year 2018 Annual Report on the Economically Disadvantaged Counties Program (MO) State law requires the commission to provide an annual report on the Economically Disadvantaged Counties Program to the governor, the lieutenant governor, and the speaker of the House of Representatives. This report documents the use of matching funds and local incentives as well as the savings to counties participating in the program. e. Designation of Access Control Titus County - US 67 and FM 2348, near Mt Pleasant - Consider the the removal of access denial at one location on the south side of US 67, and the removal of access denial for the entire length of the abutting property along the west side of FM 2348 (MO) The control-of-access line will be removed at one location on the south side of US 67. The district has determined that control-of-access is no longer required at this location, and access will be designated to and from US 67 through the driveway permit process.
