Contracts Consider the award or rejection of contracts for highway construction and maintenance, and construction and rehabilitation of buildings (Presentation) These proposed minute orders contain information concerning the receipt of bids for highway improvement contracts. The department may reschedule receipt of bids for those projects where the commission rejects all bids. Those bids accepted by the commission will result in conditional contract awards to the low bidders. Contract award conditions may involve securing funding from other sources, the contractor's ability to satisfy federal DBE subcontracting requirements, or other requirements as outlined in the project bid proposal. Aviation Various Counties - Consider the award of federal non-primary entitlement grant funding, federal apportionment grant funding, and state grant funding for airport improvement projects at various locations (MO) (Presentation) Federal law authorizes the award of federal non-primary entitlement grant funding and federal apportionment grant funding to preserve and improve the state's general aviation system. State law authorizes the award of state grant funding for capital improvement projects.
Maritime (Presentation) Consider the approval of the Gulf Intracoastal Waterway Report (MO) The Gulf Intracoastal Waterway (GIWW) is an important component of the Texas multimodal transportation system. The department is the non-federal sponsor of the GIWW and works closely with the U.S. Army Corps of Engineers on the GIWW and other Texas waterways issues. State law requires the commission to continually evaluate the impact of the GIWW on the state and to publish and present a report to each regular session of the legislature.
Cameron County - Brownsville Navigation District - Consider approval of participation by the state in the form of a grant in the amount of up to $1,532,868 to the Brownsville Navigation District (Port of Brownsville) for the payment of a portion of the costs of construction of a port access public roadway project generally described as a direct connector roadway beginning at SH 4 to Ostos Road in Cameron County (MO) This minute order will authorize the department to participate in the form of a grant to the Brownsville Navigation District, operating as the Port of Brownsville, to pay a portion of the costs of construction of a port access public roadway project, to construct a direct connector roadway beginning at SH 4 to Ostos Road. Rider 45 in the General Appropriations Act, 85th Legislature, Regular Session, 2017, allocates up to $20,000,000 in each fiscal year of the 2018-2019 biennium from any available source of revenue and/or balances in the Texas Mobility Fund No. 365 for public roadway projects selected by the Port Authority Advisory Committee and approved by the commission to improve connectivity to Texas ports.
Galveston County - The Galveston Wharves (Port of Galveston) - Consider approval of participation by the state in the form of a grant in the amount of up to $1,088,471 to the Galveston Wharves (Port of Galveston) for the payment of a portion of the costs of construction of a port access public roadway project generally described as Old Port Industrial Road Improvements in Galveston County, Texas (MO) This minute order will authorize the department to participate in the form of a grant to the Galveston Wharves (Port of Galveston) to pay a portion of the costs of construction of a port access public roadway project to improve access and traffic circulation to the cruise terminal complex on Galveston Island by providing a variety of improvements, which include repaving 33rd St. North to Old Port Industrial Road, improving the at-grade rail crossings at 33rd St. and Old Port Industrial Road, widening Old Port Industrial Road to add an additional turn lane, reconfiguring the median at 28th St. and Harborside Dr., and installing directional signs on Old Port Industrial Road. Rider 48 in the General Appropriations Act, 84th Legislature, Regular Session, 2015, allocates up to $20,000,000 for the 2016-2017 biennium from any available source of revenue or proceeds in the Texas Mobility Fund No. 365 for port capital improvement projects selected by the Port Authority Advisory Committee and approved by the commission.
Eminent Domain Proceedings Various Counties - Consider the authorization of the filing of condemnation proceedings to acquire real property by eminent domain for non-controlled and controlled access highways (see attached itemized list) (MO) Commission findings, determinations, and authorizations for the state, by motion made in accordance with Senate Bill 18 (82nd Legislature), to acquire by eminent domain, upon the payment of adequate and just compensation, various ownership interests in specific parcels of real property that are needed to develop or improve both non-controlled and controlled access state highways, to include requesting the state attorney general to bring and pursue condemnation suits relating to those specific parcels of real property described in the attached itemized list.
Routine Minute Orders and Reports a. Donations to the Department Various Districts - Consider the acknowledgment of donations with a value of $500 or more, including donations of money, materials, services, or real property, that are made to the department for the purpose of assisting the department in carrying out its functions and duties or for improving access to or from a highway on the state highway system (see attached itemized list) (MO) State statutes require the commission to acknowledge the acceptance of a gift to the department that is valued at $500 or more. By the adoption of this minute order, the commission acknowledges the receipt and acceptance of the property specified in the minute order. b. Real Estate Disposition The commission must approve the sales, transfers, and exchanges of state rights of way and other real properties that are no longer needed for a state highway purpose. Lamar County - SL 286, .54 miles east of FM 195 in Paris - Consider the exchange of drainage easements (MO) The owners of a tract upon which the department owns a drainage easement have built and improved an alternate drainage facility. They have requested the release of the department's current drainage easement in exchange for one over the new drainage facility. The district has determined that this is a superior drainage solution and supports the exchange. c. Reports (1) Compliance Division report State law requires the commission to establish a compliance program, which must include a Compliance Division to oversee the program. The Compliance Division is responsible for acting to prevent and detect serious breaches of department policy, fraud, waste, and abuse of office, including any acts of criminal conduct within the department. The Compliance Division is required to provide a monthly report to the commission regarding investigations and a summary of information relating to trends and recommendations. (2) Letting allocation status report Quarterly status report on the FY 2018 letting allocation, the actual allocation utilized through the current month, and proposed remaining highway maintenance and construction contract letting for the fiscal year (Report) This report will provide the current overall allocation status, by district and metropolitan planning organization, of the FY 2018 letting allocation and will also provide the anticipated effect on the letting allocation of remaining proposed highway maintenance and construction letting. (3) Quarterly report on FY 2018 State Highway Fund 6 cash status (Report) This report updates the commission on the year-to-date cash balance and activity of Fund 6. The report will include original projections and actual revenues/inflows and expenditures/outflows on a cash basis. d. Finance (1) Quarterly investment report (MO) This minute order recognizes the presentation and commission’s acceptance of the quarterly investment report for the investment of funds held by the Bank of New York Mellon, as trustee, under the Central Texas Turnpike System master trust indenture; funds for the Pre-paid TxTag account held by the Bank of New York Mellon, acting as custodian; and funds related to obligations issued for the IH 35E Project under a Trust Agreement by and between Amegy Bank, a Division of ZB, National Association, as trustee, and the department. (2) Various Counties - Consider the acceptance of the annual escalated toll rates for portions of SH 99 (Grand Parkway) consisting of the tolled portion of Segment D in Harris County, Segments E, F-1, F-2, G, H, I-1, and I-2B, and for the existing tolling points on the portion of Segment I-2 from I-10 to Fisher Road (Segment I-2A), as calculated on the toll escalation determination date (MO) This minute order accepts the annual escalated toll rates for the tolled portion of Grand Parkway Segment D in Harris County and for Segments E, F-1, F-2, G, H, I-1, and I-2B, and for the existing tolling points on Segment I-2A, replacing the current toll rate tables previously set by the commission with toll rate tables that escalate the toll rates on January 1, 2019, based on the annual toll rate escalation percentage.
