Discussion Item Draft December update of the Unified Transportation Program (UTP) (Presentation) The UTP is a 10-year statewide plan for transportation project development. The commission approved the 2018 UTP in August of 2017. Staff will provide an overview of the proposed December updates to the program.
Financial Assistance for Projects Bexar County - Alamo Regional Mobility Authority - Consider granting final approval of a request from the Alamo Regional Mobility Authority to receive a grant of up to $17,000,000 to be used to pay for project development of the Loop 1604 Managed Lanes Project, which includes the addition of two tolled managed lanes in each direction along Loop 1604 from SH 16 to I-35 while ensuring that funding from sources designated for non-tolled purposes will not be used on the tolled managed lanes of the Project. (MO) The Loop 1604 Managed Lanes Project consists of tolled and non-tolled improvements, including the addition of two tolled managed lanes in each direction along Loop 1604 from SH 16 to I-35, and the addition of eight direct connectors at the Loop 1604 and I-10 interchange. Additional improvements to Loop 1604 are planned as part of the project and include: (1) mill, overlay, and re-striping of the existing mainlanes; and (2) improvements to the non-tolled portions of the roadway, including frontage roads, ramps, intersections, and bicycle and pedestrian facilities.
Aviation Various Counties - Consider the award of federal and state grant funding, and federal non-primary entitlement grant funding for airport improvement projects at various locations (MO) (Presentation) Federal law authorizes the award of federal state apportionment grant funding and federal non-primary entitlement grant funding to preserve and improve the state's general aviation system. State law authorizes the award of state grant funding for capital improvement projects.
Public Transportation Various Counties - Consider the award of state funds and federal §5304 grant funds to locally designated lead agencies and fiscal agents in planning regions across the state (MO) The awards identified in this minute order are to support the continuation of regionally coordinated public transportation planning in FY 2018. Awards will be financed with state funds and federal §5304 grant funds from the Federal Transit Administration.
Various Counties - Consider the award of federal funding for projects submitted in the department's 2017 Transportation Alternatives Set-Aside call for projects (MO) (Presentation) Fixing America’s Surface Transportation Act authorized the Transportation Alternatives Set-Aside (TASA) program to reserve funds equal to 2 percent of the total amount authorized from the Highway Account of the Highway Trust Fund for Federal-Aid highways each year. The TASA program administered by the department provides funding to construct a variety of alternative transportation projects that improve mobility for non-motorized users and provide safer accommodations for all roadway users. This minute order approves federal TASA funds for selected bicycle and pedestrian projects in population areas of 5,000 or less and in population areas between 5,001 and 200,000. Projects include construction of on- and off-road pedestrian and bicycle accommodations, Safe Routes to School infrastructure, and improvements to access to public transportation.
Promulgation of Administrative Rules Under Title 43, Texas Administrative Code, and the Administrative Procedure Act, Government Code, Chapter 2001: Final Adoption Chapter 9 - Contract and Grant Management Amendments to §9.32, Selection Processes, Contract Types, Selection Types, and Projected Contracts (Contracting For Architectural, Engineering, and Surveying Services) (MO) These amendments are necessary for more effective management of indefinite deliverable contracting resources. The amendments increase the limit on the period of time that initial work authorizations may be issued and it streamlines the process by eliminating a step that was required when additional time is needed.
Design-Build Contract Travis and Williamson Counties - Consider authorizing the Central Texas Regional Mobility Authority (CTRMA) to use state owned right of way as necessary to operate the tolled managed lanes portion of the US 183 North Mobility Project from SH 45 North/RM 620 to Loop 1 in Travis and Williamson Counties (Project); consider approving the connection of the CTRMA’s tolled managed lanes portion of the Project to the State Highway System; consider authorizing the executive director to enter into a project development agreement with the CTRMA pursuant to which the department will develop, design, construct, and potentially maintain the tolled managed lanes on behalf of the CTRMA; and, contingent upon execution of a project development agreement between the department and the CTRMA concerning the Project, consider authorizing the department to issue a request for qualifications to design, develop, construct, and potentially maintain the US 183 North Mobility Project from SH 45 North/RM 620 to Loop 1 in Travis and Williamson Counties, which includes the construction of two tolled managed lanes in each direction, and an additional general purpose (non-tolled) lane in each direction, while ensuring that funding from sources designated for non-tolled purposes will not be used on the tolled managed lanes of the Project. (MO) (Presentation) Transportation Code § 370.187 provides that a regional mobility authority may not begin construction of a transportation project that will connect to the state highway system without the approval of the Texas Transportation Commission. Transportation Code § 223.242 authorizes the department to enter into, in each fiscal year, up to three design-build contracts for highway projects with a construction cost estimate of $150 million or more. The US 183 North Mobility Project is a crucial element to providing system continuity and improving safety and mobility in the area and meets the requirements for design-build delivery.
Appointment to El Paso County Stormwater Control and Recapture Planning Authority (MO) House Bill 2725, 85th Legislature, Regular Session, requires the commission to appoint a representative of the department to the board of the El Paso County Stormwater Control and Recapture Planning Authority.
Contracts Consider the award or rejection of contracts for highway construction and maintenance, and construction and rehabilitation of buildings. These proposed minute orders contain information concerning the receipt of bids for highway improvement contracts. The department may reschedule receipt of bids for those projects where the commission rejects all bids. Those bids accepted by the commission will result in conditional contract awards to the low bidders. Contract award conditions may involve securing funding from other sources, the contractor's ability to satisfy federal DBE subcontracting requirements, or other requirements as outlined in the project bid proposal. (1) Brazos County - FM 974, old Hearne Road in Bryan - Consider the transfer of right of way to the City of Bryan (MO) The district has determined that the land is no longer needed for a state highway purpose. The City of Bryan (city) has agreed to assume control, jurisdiction, and maintenance, and has requested that the land be transferred to the city. The land may be transferred to the city without cost and will revert to the state if it ceases to be used for public road purposes. (2) Brazos County - SH 6 at Raintree Drive in College Station - Consider the sale of a drainage easement (MO) The district has determined that the easement is no longer needed for highway drainage purposes and may be sold to the fee owner of the property. (3) Harris County - US 290 at Mason Road in Cypress - Consider the sale of right of way to the abutting landowner (MO) The district has determined that the land is no longer needed for a state highway purpose. The abutting landowner has requested to purchase the land, and it may be sold to the abutting landowner. (4) McLennan County - I-35 at BU 77 in Lacy Lakeview - Consider the sale of right of way to the abutting landowner (MO) The district has determined that the land is no longer needed for a state highway purpose. The abutting landowner has requested to purchase the land, and it may be sold to the abutting landowner. b. Real Estate Dispositions (continued) (5) Navarro County - US 287, old location on Richland-Chambers Reservoir at County Road 3310 - Consider the transfer of right of way to Navarro County to remain in use for public road purposes (MO) The highway was realigned on a new location when Richland-Chambers Reservoir was created, and the district has determined that the land on the old alignment is no longer needed for a state highway purpose. Navarro County (county) will assume control, jurisdiction, and maintenance and has requested the land to be transferred to the county for use as a county road. The land may be transferred to the county with the provision that it reverts to the state if it ceases to be used for public road purposes. c. Reports (1) Compliance Division report State law requires the commission to establish a compliance program, which must include a Compliance Division to oversee the program. The Compliance Division is responsible for acting to prevent and detect serious breaches of department policy, fraud, waste, and abuse of office, including any acts of criminal conduct within the department. The Compliance Division is required to provide a monthly report to the commission regarding investigations and a summary of information relating to trends and recommendations. (2) Letting Allocation status report Quarterly status report on the FY 2017 Letting Allocation, the actual allocation utilized through the current month, proposed remaining highway maintenance and construction contract letting for the fiscal year (Report) This report will provide the current overall allocation status, by district and metropolitan planning organization, of the FY 2017 Letting Allocation and will also provide the anticipated effect on the letting allocation of remaining proposed highway maintenance and construction letting. (3) Quarterly report on FY 2017 State Highway Fund 6 cash status (Report) This report updates the commission on the year-to-date cash balance and activity of Fund 6. The report will include original projections and actual revenues/inflows and expenditures/outflows on a cash basis. d. Finance (1) Harris, Montgomery, and Chambers Counties - Consider the acceptance of the annual escalated toll rates for portions of SH 99 (Grand Parkway) consisting of the tolled portion of Segment D in Harris County, Segments E, F-1, F-2, G, H, I-1, and I-2B, and for the existing tolling points on the portion of Segment I-2 from I-10 to Fisher Road (Segment I-2A), as calculated on the toll escalation determination date (MO) This minute order accepts the annual escalated toll rates for the tolled portion of Grand Parkway Segment D in Harris County and for Segments E, F-1, F-2, G, H, I-1, and I-2B, and for the existing tolling points on Segment I-2A, replacing the current toll rate tables previously set by the commission with toll rate tables that escalate the toll rates on January 1, 2018, based on the annual toll rate escalation percentage. Highway Designations Henderson County - Consider designating US 175 along a new location in the City of Poynor and redesignating the old alignment of US 175 as Business US Highway 175-H (MO) This minute order designates US 175 along a new location from approximately 0.5 miles west of FM 315 to approximately 0.5 miles east of FM 315, a distance of approximately 1.0 mile; and redesignates the old alignment of US 175 as BU 175-H from approximately 0.5 miles west of FM 315 to approximately 0.5 miles east of FM 315, a distance of approximately 1.0 mile. f. Designation of Access Control (1) Denton County - SH 114, east of Double Eagle Boulevard - Consider the designation of one location on the frontage road at which access will be permitted to the abutting property (MO) The designation of one 34-foot break in the control-of-access line will allow the abutting landowner to remove an encroachment of an existing driveway on the access denial line. The existing access provides access to and from the westbound SH 114 frontage road. The district has determined that access may be permitted at the designated location. (2) Parker County - I-20, West of Cinema Drive - Consider the redesignation of one location on the westbound frontage road at which access will be permitted to the abutting property and the designation of one location on the westbound frontage road at which access will be permitted for ingress only (MO) This minute order provides for the redesignation of one existing 100-foot break in the control-of-access line with one new 100-foot break in the control-of-access line that will allow the abutting landowner to open one local street location for access to and from the westbound frontage road. In addition, the minute order designates one 42.24-foot break in the control-of-access line that will allow the abutting property owner ingress only access from the westbound frontage road. The district has determined that access may be permitted at the designated locations. g. Highway Designations Henderson County - Consider designating US 175 along a new location in the City of Poynor and redesignating the old alignment of US 175 as Business US Highway 175-H (MO) This minute order designates US 175 along a new location from approximately 0.5 miles west of FM 315 to approximately 0.5 miles east of FM 315, a distance of approximately 1.0 mile; and redesignates the old alignment of US 175 as BU 175-H from approximately 0.5 miles west of FM 315 to approximately 0.5 miles east of FM 315, a distance of approximately 1.0 mile. f. Designation of Access Control (1) Denton County - SH 114, east of Double Eagle Boulevard - Consider the designation of one location on the frontage road at which access will be permitted to the abutting property (MO) The designation of one 34-foot break in the control-of-access line will allow the abutting landowner to remove an encroachment of an existing driveway on the access denial line. The existing access provides access to and from the westbound SH 114 frontage road. The district has determined that access may be permitted at the designated location. (2) Parker County - I-20, West of Cinema Drive - Consider the redesignation of one location on the westbound frontage road at which access will be permitted to the abutting property and the designation of one location on the westbound frontage road at which access will be permitted for ingress only (MO) This minute order provides for the redesignation of one existing 100-foot break in the control-of-access line with one new 100-foot break in the control-of-access line that will allow the abutting landowner to open one local street location for access to and from the westbound frontage road. In addition, the minute order designates one 42.24-foot break in the control-of-access line that will allow the abutting property owner ingress only access from the westbound frontage road. The district has determined that access may be permitted at the designated locations. g.
