Discussion Items Texas Freight Mobility Plan Update (Presentation) Staff will present an overview of the Texas Freight Mobility Plan Update 2017. The plan outlines key freight transportation challenges and key policy and program recommendations, as well as five-year fiscally constrained project recommendations and fiscally unconstrained strategic project recommendations.
Unified Transportation Program (UTP) (Presentation) Staff will discuss a proposed planning target reduction due to action by the 85th legislature that will impact the 2018 UTP funding categories, as well as other items that will impact the 2018 UTP.
Aviation Advisory Committee Consider the appointment of members to the Aviation Advisory Committee (MO) (Presentation) The Aviation Advisory Committee provides a direct link for general aviation users' input into the Texas Airport System through exchange of information concerning the users' view of the needs and requirements for the economic development of the aviation system. The commission appoints each member for a term not to exceed three years. This minute order approves the appointment of two members to the Aviation Advisory Committee.
Border Trade Advisory Committee Consider the appointment of members to the Border Trade Advisory Committee (MO) (Presentation) This minute order appoints members to the Border Trade Advisory Committee. The purpose of the committee, created in 2001 by the 77th Legislature, is to define and develop a strategy and make recommendations to the commission and the governor, to address the highest priority border trade transportation challenges.
Bicycle Advisory Committee Consider the appointment of members to the Bicycle Advisory Committee (MO) (Presentation) The Bicycle Advisory Committee advises the commission on bicycle issues and matters of mutual concern between the department and the bicycling community. By involving representatives of the public, including bicyclists and other interested parties, the department helps ensure effective communication with the bicycle community, and that the bicyclist's perspective will be considered in the development of departmental policies affecting bicycle use, including the design, construction, and maintenance of highways.
Public Transportation Various Counties - Consider the award of FY 2018 state funds, federal §5310 Formula Grants for the Enhanced Mobility of Seniors and Individuals with Disabilities Program funds, and federal §5311(b)(3) Rural Transportation Assistance Program funds (MO) The awards identified in this minute order reflect the allocation of state grant funds from state FY 2018 appropriations to urban public transportation providers, federal §5310 funds to various public transportation providers, and federal §5311(b)(3) funds to Southwest Area Regional Transit District.
Promulgation of Administrative Rules Under Title 43, Texas Administrative Code, and the Administrative Procedure Act, Government Code, Chapter 2001: Proposed Adoption Chapter 1 - Management Amendments to §1.82, §§1.84 - 1.87 and new §1.88 (Advisory Committees) (MO) The amendments extend the sunset dates for statutory and department advisory committees and add a new activity reporting requirement for each advisory committee. The amendments also change the rules relating to the membership of the port authority advisory committee in accordance with statutory amendments made by Senate Bill 28, 85th Legislature, Regular Session.
Chapter 27 - Toll Projects Amendments to §27.82, Toll Operations (Operation of Department Toll Projects) (MO) The proposed amendments set the amount of the administrative fee to be charged for failure to pay the amount due for the use of a toll project and provide for a toll assessment review process, in accordance with Senate Bill 312, 85th Legislature, Regular Session.
Chapter 28 - Oversize and Overweight Vehicles and Loads Amendments to §28.102, Authority’s Powers and Duties (Hidalgo County Regional Mobility Authority Permits) (MO) The amendments authorize the Hidalgo County Regional Mobility Authority to issue oversize/overweight permits for an additional portion of a state highway within HCRMA’s jurisdiction.
State Infrastructure Bank Hockley County - City of Levelland - Consider final approval of a request from the City of Levelland for a State Infrastructure Bank loan in the amount of up to $890,000 to pay the costs of utility relocation necessary for a state highway improvement project on US 385 (MO) The SIB loan will be secured by a pledge of water and sewer system revenues. The loan will be used to pay the costs of utility relocation necessary for a state highway improvement project on US 385 from FM 300 to 1.86 miles south of FM 300.
Financial Assistance for Projects Bexar County - Alamo Regional Mobility Authority - Consider granting preliminary approval of a request from the Alamo Regional Mobility Authority to receive a grant of up to $17,000,000 to be used to pay for project development of the Loop 1604 Managed Lanes Project, which includes the addition of two tolled managed lanes in each direction along Loop 1604 from SH 16 to I-35 (MO) The Loop 1604 Managed Lanes Project consists of tolled and non-tolled improvements, including the addition of two tolled managed lanes in each direction along Loop 1604 from SH 16 to I-35, and the addition of eight direct connectors at the Loop 1604 and Interstate Highway 10 interchange. Additional improvements to Loop 1604 are planned as part of the project and include: (1) mill, overlay, and re-striping of the existing mainlanes; and (2) improvements to the non-tolled portions of the roadway, including frontage roads, ramps, intersections, and bicycle and pedestrian facilities.
Audit and Compliance Consider the approval of the Internal Audit Work Plan and the Compliance Work Plan for Fiscal Year 2018 and determine whether adequate resources have been dedicated to the internal audit and the compliance programs (MO) (Presentation) State law requires the internal auditor to create an annual audit plan that is prepared using risk assessment techniques and that identifies the individual audits to be conducted during the year. The audit plan must be approved by the commission. Contracts Consider the award or rejection of contracts for highway construction and maintenance, and construction and rehabilitation of buildings. These proposed minute orders contain information concerning the receipt of bids for highway improvement contracts. The department may reschedule receipt of bids for those projects where the commission rejects all bids. Those bids accepted by the commission will result in conditional contract awards to the low bidders. Contract award conditions may involve securing funding from other sources, the contractor's ability to satisfy federal DBE subcontracting requirements, or other requirements as outlined in the project bid proposal. (2) Denton County - FM 407, old alignment at Hilltop Road in Bartonville - Consider the sale of right of way to the abutting landowner (MO) The district has determined that the land is no longer needed for a state highway purpose. The abutting landowner has requested to purchase the land, and it may be sold to the abutting landowner. (3) El Paso County - SL 375, northwest corner at I-10 in El Paso - Consider the sale of right of way to the abutting landowner (MO) The district has determined that the land is no longer needed for a state highway purpose. The abutting landowner has requested to purchase the land, and it may be sold to the abutting landowner. Reports Compliance Division report State law requires the commission to establish a compliance program, which must include a Compliance Division to oversee the program. The Compliance Division is responsible for acting to prevent and detect serious breaches of department policy, fraud, waste, and abuse of office, including any acts of criminal conduct within the department. The Compliance Division is required to provide a monthly report to the commission regarding investigations and a summary of information relating to trends and recommendations. d. Highway Designation Hidalgo County - Consider extending the designation of FM 676 near the cities of Edinburg and McAllen (MO) This minute order extends the designation of FM 676 from 0.3 mile east of N. Taylor Road along Auburn Avenue to FM 2220 (Ware Road), a distance of approximately 1.0 mile. e. Designation of Access Control (1) Coryell County - US 190, east of FM 3046 in Copperas Cove - Consider the redesignation of one location on the eastbound frontage road at which access will be permitted to the abutting property (MO) The redesignation of one existing 126.48-foot break in the control-of-access line with one proposed 120.41-foot break in the control-of-access line will allow the abutting landowner to open one proposed driveway location for access to and from the eastbound frontage road. The district has determined that access may be permitted at the designated location. (2) Guadalupe County - I-10, approximately 300 feet west of SH 80 - Consider the designation of two locations on the highway at which access will be permitted to the abutting property (MO) The designation of one 50.58-foot break and one 47.07-foot break in the control-of-access line will allow the abutting landowner to open two proposed driveway locations for access to the eastbound frontage road. (5) McLennan County - I-35, south of New Road - Consider the designation of one location on the frontage road at which access will be permitted to the abutting property (MO) The designation of one 80-foot break in the control-of-access line will allow the abutting landowner to open one proposed driveway location for access, permitting access to and from the southbound frontage road. The district has determined that access may be permitted at the designated location. (6) Reeves County - I-20, approximately 200 feet west of US 285 - Consider the designation of one location on the highway at which access will be permitted to the abutting property (MO) The designation of one 25-foot break in the control-of-access line will allow the abutting landowner to open one proposed driveway location for access to the westbound frontage road. Reports Compliance Division report State law requires the commission to establish a compliance program, which must include a Compliance Division to oversee the program. The Compliance Division is responsible for acting to prevent and detect serious breaches of department policy, fraud, waste, and abuse of office, including any acts of criminal conduct within the department. The Compliance Division is required to provide a monthly report to the commission regarding investigations and a summary of information relating to trends and recommendations. d. Highway Designation Hidalgo County - Consider extending the designation of FM 676 near the cities of Edinburg and McAllen (MO) This minute order extends the designation of FM 676 from 0.3 mile east of N. Taylor Road along Auburn Avenue to FM 2220 (Ware Road), a distance of approximately 1.0 mile. e. Designation of Access Control (1) Coryell County - US 190, east of FM 3046 in Copperas Cove - Consider the redesignation of one location on the eastbound frontage road at which access will be permitted to the abutting property (MO) The redesignation of one existing 126.48-foot break in the control-of-access line with one proposed 120.41-foot break in the control-of-access line will allow the abutting landowner to open one proposed driveway location for access to and from the eastbound frontage road. The district has determined that access may be permitted at the designated location. (2) Guadalupe County - I-10, approximately 300 feet west of SH 80 - Consider the designation of two locations on the highway at which access will be permitted to the abutting property (MO) The designation of one 50.58-foot break and one 47.07-foot break in the control-of-access line will allow the abutting landowner to open two proposed driveway locations for access to the eastbound frontage road. (6) Reeves County - I-20, approximately 200 feet west of US 285 - Consider the designation of one location on the highway at which access will be permitted to the abutting property (MO) The designation of one 25-foot break in the control-of-access line will allow the abutting landowner to open one proposed driveway location for access to the westbound frontage road. Transportation Planning Various Counties - Consider the certification of eligible counties for the 2018 Economically Disadvantaged Counties Program and establish local match adjustments for each county and certain cities (MO) This minute order certifies the counties to participate in the Economically Disadvantaged Counties Program for Fiscal Year 2018 and sets forth the local match adjustment for each county and certain cities participating in the program. State law requires the commission to annually certify economically disadvantaged counties as soon as possible after the comptroller reports on the relevant economic indicators. g.
