Public Transportation Various Counties - Consider the award of state funds to public transportation providers for FY 2018 as appropriated by the 85th Texas Legislature (MO) The awards identified in this minute order reflect the allocation of state grant funds from state appropriations to small urban and to rural public transportation providers.
Annual Highway Safety Plan Consider approval of funding for the 2018 Highway Safety Plan (MO) (Presentation) The department develops and implements an annual Highway Safety Plan (HSP). Federal funds are allocated by the National Highway Traffic Safety Administration and are used for traffic safety projects identified in the HSP. The HSP groups anticipated projects into focus-oriented program areas. This minute order lists the number of projects in each program area and the allocated amounts for FY 2018.
Regional Mobility Authority Various Counties - Consider approval of a request from Fannin County to become part of the Sulphur River Regional Mobility Authority (MO) The commission authorized the creation of the Sulphur River Regional Mobility Authority (SuR RMA) in June 2007. The department has received a petition from Fannin County requesting to join the SuR RMA. The Board of Directors of the SuR RMA has adopted a resolution agreeing to the addition of Fannin County to the SuR RMA.
Travis County - Central Texas Regional Mobility Authority (CTRMA) - Consider approval of a toll project consisting of two direct connectors at the intersection of SH 130 and 290 Toll (Manor Expressway) to be constructed by the CTRMA as part of 290 Toll (290E PH3 Project) and its connection to the state highway system; consider approval to expend available Central Texas Turnpike System (CTTS) revenues for the actual costs of the development and construction of a third direct connector at the intersection of SH 130 and 290 Toll and associated improvements, as an expansion of a portion of the SH 130 element of the CTTS (E-S DC); consider authorizing the executive director to contract with CTRMA to make improvements to the state highway system through the construction of the E-S DC on behalf of the department pursuant to Transportation Code §370.033(f); and consider approval of the department’s determination to exercise its option to develop, finance, construct, and operate the E-S DC as an expansion of a portion of the SH 130 element of the CTTS (MO) This minute order will approve the CTRMA’s 290E PH3 Project and its connection to the State Highway System, which includes construction of two direct connectors (DCs) at the SH 130/US 290 intersection for the following movements: southbound SH 130 to westbound 290 Toll (S-W), and northbound SH 130 to westbound 290 Toll (N-W). Toll Project Grimes and Montgomery Counties - Consider designating the extension of SH 249, from FM 1774 in Pinehurst, Texas to FM 1774 in Todd Mission, Texas as a toll project on the state highway system (MO) Segment 1 of the SH 249 Extension project, from FM 1774 in Pinehurst, Texas to FM 1774 in Todd Mission, Texas, was environmentally cleared through the department’s issuance of a record of decision for Segment 1 on January 12, 2016. This minute order designates Segment 1 of the SH 249 Extension as a toll project on the state highway system.
Financial Assistance for Projects Grimes and Montgomery Counties - Consider approving the selection of the proposer who submitted the best value proposal to develop, design, construct, and maintain the SH 249 Extension, from FM 1774 in Pinehurst, Texas to SH 105 near Navasota, Texas; and consider authorizing the executive director of the department to negotiate and execute a Design-Build Agreement and associated Capital Maintenance Agreement with the selected proposer (MO) (Presentation) On September 28, 2016, the department issued a request for proposals to develop, design, construct and maintain the SH 249 Extension. The department has completed its review and evaluation of proposals and is presenting its best value recommendation to the commission.
Toll Operations Consider authorizing the department to enter into an agreement with other governmental entities related to the interoperability of toll collection systems (MO) MAP-21 requires that all toll facilities on federal-aid highways implement technologies or business practices that provide for the interoperability of electronic toll collection programs. This minute order authorizes the execution of an agreement between the department and the North Texas Tollway Authority, Harris County, the Central Texas Regional Mobility Authority, the Fort Bend Grand Parkway Toll Road Authority, the Kansas Turnpike Authority, the Oklahoma Turnpike Authority, and the Florida Turnpike Enterprise. The agreement will address the interoperability of toll collection transponders through the use of the Southeast US Interoperability Hub and the Central US Interoperability Hub.
Webb County - In view of the interruption of normal traffic through the Laredo International Bridge System due to severe storm damage, consider authorizing and directing the executive director of the department to authorize free passage for any vehicle using State Highway 255 in Webb County until July 31, 2017 (MO) In Minute Order 110911, dated April 26, 2007, the commission adopted a policy concerning free passage on toll projects on the state highway system. Section 37 of Senate Bill 312, effective September 1, 2017, adds Section 228.201(d), Transportation Code, providing that the department may not operate any part of State Highway 255 in Webb County as a toll project. Severe storm damage recently closed parts of the Laredo International Bridge System, with traffic diverted to the Colombia Solidarity Bridge that connects to State Highway 255. This minute order authorizes and directs the executive director of the department to authorize free passage for any vehicle using State Highway 255 in Webb County until July 31, 2017.
Contracts Consider the award or rejection of contracts for highway construction and maintenance, and construction and rehabilitation of buildings. These proposed minute orders contain information concerning the receipt of bids for highway improvement contracts. The department may reschedule receipt of bids for those projects where the commission rejects all bids. Those bids accepted by the commission will result in conditional contract awards to the low bidders. Contract award conditions may involve securing funding from other sources, the contractor's ability to satisfy federal DBE subcontracting requirements, or other requirements as outlined in the project bid proposal. Eminent Domain Proceedings Various Counties - Consider the authorization of the filing of condemnation proceedings to acquire real property by eminent domain for non-controlled and controlled access highways (see attached itemized list) (MO) Commission findings, determinations, and authorizations for the state, by motion made in accordance with Senate Bill 18 (82nd Legislature), to acquire by eminent domain, upon the payment of adequate and just compensation, various ownership interests in specific parcels of real property that are needed to develop or improve both non-controlled and controlled access state highways, to include requesting the state attorney general to bring and pursue condemnation suits relating to those specific parcels of real property described in the attached itemized list.

The Compliance Division is responsible for acting to prevent and detect serious breaches of department policy, fraud, waste, and abuse of office, including any acts of criminal conduct within the department. The Compliance Division is required to provide a monthly report to the commission regarding investigations and a summary of information relating to trends and recommendations. (2) Report on projects being processed under the department’s environmental review process (Report) The report identifies projects being processed under the department’s environmental review process. A report must be submitted twice a year to the commission, as required by Transportation Code, §201.762(a). (3) Grimes and Montgomery Counties - Report on public comment on Environmental Impact Statement - State Highway 249 Extension (Report) The report lists the number of positive, negative, and neutral public comments received on a project for which an environmental impact statement was prepared. The report concerns the State Highway 249 Extension in Grimes and Montgomery Counties (CSJ's 3635-01-001 and 3635-02-001), and is required by Transportation Code §201.811(b) and 43 TAC §2.107(e)(2). d. Highway Designations (1) Dallas and Ellis Counties - Consider designating State Loop 9 along a new location between I-35E and I-45 (MO) This minute order designates State Loop 9 along a new location between I-35E and I-45, a distance of approximately 11.4 miles.
