Discussion Item System Performance Targets (Presentation) Staff will discuss the strategic performance targets that are incorporated into all of the department's planning and policy documents. The discussion will focus on strategic performance targets that drive the funding allocations in the Unified Transportation Program.
Aviation Various Counties - Consider the award of federal non-primary entitlement grant funding for airport improvement projects at various locations (MO) Federal law authorizes the award of federal non-primary entitlement grant funding to preserve and improve the state's general aviation system. The airports listed in the exhibit to the minute order are eligible for award of these grant funds and the department seeks the approval of the awards.

Transportation development credits will be utilized for capital projects and to support connecting service between Midland and Odessa.
Financial Assistance for Projects Cameron County - Cameron County Regional Mobility Authority - Consider granting final approval of a request from the Cameron County Regional Mobility Authority to receive financial assistance in the form of a grant of up to $2,000,000 to be used for construction of a controlled access toll facility on SH 550 from .53 mi East of Old Alice Road to .48 mi West of FM 1847 called the SH 550 Gap I project (MO) The SH 550 Gap I project is a controlled access toll facility on SH 550 from .53 mi East of Old Alice Road to .48 mi West of FM 1847 consisting of four main lanes, two in each direction. The commission has previously approved financial assistance for the SH 550 Gap I project in the form of a grant in the amount of $6,000,000, in Minute Order 114648, dated July 28, 2016, and Minute Order 114686, dated August 25, 2016. Cameron County Regional Mobility Authority has submitted an additional request for financial assistance in the form of a grant in the amount of $2,000,000 to be used for the costs of construction of the project. Because the project GAP I project is a toll facility, the source of the funds for the financial assistance may not come from Proposition 1 or Proposition 7 funds. In addition, the source of funds for the financial assistance may not come from money in the State Highway Fund which is available to the department for projects as a result of the enactment of House Bill 20 (84th Legislature, Regular Session), which amended Transportation Code §222.001(a) to discontinue the use of State Highway Fund money by the Department of Public Safety.
State Infrastructure Bank Ellis County - City of Glenn Heights - Consider final approval of a request from the City of Glenn Heights for a State Infrastructure Bank loan in the amount of up to $1,500,000 to pay the costs of utility relocation necessary for a state highway improvement project on FM 664 (MO) The SIB loan will be secured by a pledge of ad valorem taxes. The loan will be used to pay the costs associated with utility relocation necessary for a highway improvement project on FM 664 from 450 feet west of Cinnamon Springs to Uhl Road for a total length of approximately 1.45 miles.
Purchase Order Amendment Consider the approval of a material change to a purchase order awarded under Chapter 2155 of the Texas Government Code for the provision of staffing services for the Modernization Portfolio and Project Management Project (MO) This minute order proposes an amendment to a purchase order awarded under Government Code, Chapter 2155 for the provision of staffing services for the Modernization Portfolio and Project Management Project. The terms of the purchase order allow the amendment being proposed. Section 2155.088, Government Code, requires that the governing body of a state agency, at a meeting, consider a material change to the contract for goods or services awarded under Chapter 2155, Government Code, and consider why that change is necessary. The proposed amendment is a material change under Chapter 2155.
Contracts Consider the award or rejection of contracts for highway construction and maintenance, and construction and rehabilitation of buildings. These proposed minute orders contain information concerning the receipt of bids for highway improvement contracts. The department may reschedule receipt of bids for those projects where the commission rejects all bids. Those bids accepted by the commission will result in conditional contract awards to the low bidders. Contract award conditions may involve securing funding from other sources, the contractor's ability to satisfy federal DBE subcontracting requirements, or other requirements as outlined in the project bid proposal. Eminent Domain Proceedings Various Counties - Consider the authorization of the filing of condemnation proceedings to acquire real property by eminent domain for non-controlled and controlled access highways (see attached itemized list) (MO) Commission findings, determinations, and authorizations for the state, by motion made in accordance with Senate Bill 18 (82nd Legislature), to acquire by eminent domain, upon the payment of adequate and just compensation, various ownership interests in specific parcels of real property that are needed to develop or improve both non-controlled and controlled access state highways, to include requesting the state attorney general to bring and pursue condemnation suits relating to those specific parcels of real property described in the attached itemized list.
Routine Minute Orders and Reports a. Donations to the Department Various Districts - Consider the acknowledgment of donations made to the department to include: (a) donations in any form, including realty, personalty, money, materials, or services, which are made to the department for the purpose of carrying out its functions and duties; and (b) donations from landowners, with land adjacent to a highway that is part of the state highway system, to construct an improvement on the highway right-of-way that is directly related to improving access to or from the owner’s land (see attached itemized list) (MO) b. Real Estate Dispositions The commission must approve the sales, transfers, and exchanges of state rights of way and other real properties that are no longer needed for a state highway purpose. It must also approve, accept and acknowledge donations to the state of real property that is valued at $500 or more. (1) Collin County - US 75, southwest corner at Eldorado Parkway in McKinney - Consider the sale of right of way to the abutting landowner (MO) The district has determined that the land is no longer needed for highway purposes and may be sold to the abutting landowner. (2) El Paso County - I-10, southwest corner at Darrington Road in El Paso - Consider the quitclaim of right of way to the county (MO) The district has determined that the right of way is no longer needed for highway purposes. The land was acquired in the county’s name, and the state’s interest may be quitclaimed to the county. (3) El Paso County - SL 375, north side, east of US 85 (Paisano Drive) and west of I-10 in El Paso - Consider the exchange and relocation of electric line easements (MO) El Paso Electric Company (EPE) owns and controls distribution and transmission lines across property owned by the state and desires to relocate the easements on the property. The district has determined that the easements may be moved to the new locations. In accordance with a written agreement, the state will grant the new easements to EPE in consideration of EPE’s release of the existing easements. (4) Kaufman County - FM 1641 in Forney - Consider the sale of right of way to the abutting landowner (MO) The district has determined that the land is no longer needed for highway purposes and may be sold to the abutting landowner. (5) Orange County - I-10, southeast corner at FM 3247 in Orange - Consider the sale of right of way to the abutting landowner (MO) The district has determined that the land is no longer needed for highway purposes and may be sold to the abutting landowner. Dallas Road in Grapevine - Consider the sales of right of way to the abutting landowners (MO) (MO) The district has determined that two tracts of land are no longer needed for highway purposes and may be sold to the respective abutting landowners. c. Reports (1) Compliance Division report State law requires the commission to establish a compliance program, which must include a Compliance Division to oversee the program. The Compliance Division is responsible for acting to prevent and detect serious breaches of department policy, fraud, waste, and abuse of office, including any acts of criminal conduct within the department. The Compliance Division is required to provide a monthly report to the commission regarding investigations and a summary of information relating to trends and recommendations. (2) Travis and Williamson Counties - Annual Inspection Report for the Central Texas Turnpike System (Report) The General Engineering Consultant's annual Inspection Report relates to the 2002 Project of the CTTS, a toll project composed of the SH 130, SH 45N, Loop 1, and SH 45SE project elements, and is required under the CTTS bond indenture. This report must be submitted to the commission following each inspection and on or before the 90th day prior to the end of each fiscal year. d. Traffic Operations (1) Bastrop and Travis Counties - Consider authorization of temporary one-way or reversible operations on FM 812 between US 183 and SH 21 for Circuit of The Americas events during the period 2017-2022 (MO) The implementation of this traffic control plan will facilitate the orderly flow of traffic and ensure the safety of the attendees and traveling public. (2) Travis County - Consider authorization of temporary one-way or reversible operations on FM 973 between SH 71 and FM 812 for Circuit of The Americas events during the period 2017-2022 (MO) The implementation of this traffic control plan will facilitate the orderly flow of traffic and ensure the safety of the attendees and traveling public. e. Speed Zones Various Counties - Consider the establishment or alteration of regulatory and construction speed zones on various sections of highways in the state (MO) This minute order establishes or alters regulatory and construction speed zones on various sections of highways in the state.
At the conclusion of all other agenda items, the commission will allow an open comment period, not to exceed one hour, to receive public comment on any other matter that is under the jurisdiction of the department. No action will be taken. Each speaker will be allowed a maximum of three minutes. Speakers must be signed up prior to the beginning of the open comment period.

The department requests the commission’s authorization to enter into a contract for purchase with the seller of such property, and to authorize the executive director to execute and perform such contract, consistent with the terms included within the MO.
