Consider the approval of the Minutes of the March 28, 2017, regular meeting of the Texas Transportation Commission
Aviation Various Counties - Consider the award of federal non-primary entitlement grant funding for airport improvement projects at various locations (MO) Federal law authorizes the award of federal non-primary entitlement grant funding to preserve and improve the state's general aviation system. The airports listed in the exhibit to the minute order are eligible for award of these grant funds and the department seeks the approval of the awards.
Public Transportation Various Counties - Consider the award of transportation development credits to the Capital Area Rural Transportation System (MO) The proposed minute order awards transportation development credits to assist with the match of federal funds for public transit projects in the rural area. A delay of federal funds has reduced the availability of local funds for match. TDC will be used in place of local funds to mitigate impacts caused by the delay of federal funds.
Financial Assistance for Projects Cameron County - Cameron County Regional Mobility Authority - Consider granting preliminary approval of a request from the Cameron County Regional Mobility Authority for financial assistance in the form of a grant of up to $2,000,000 to be used for construction of a controlled access toll facility on SH 550 from .53 mi East of Old Alice Road to .48 mi West of FM 1847 called the SH 550 Gap I project (MO) The SH 550 Gap I project is a controlled access toll facility on SH 550 from .53 mi East of Old Alice Road to .48 mi West of FM 1847 consisting of four main lanes, two in each direction. The commission has previously approved financial assistance for the SH 550 Gap I project in the form of a grant in the amount of up to $6,000,000, in Minute Order 114648, dated July 28, 2016, and Minute Order 114686, dated August 25, 2016. Cameron County Regional Mobility Authority has submitted an additional request for financial assistance in the form of a grant in the amount of $2,000,000 to be used for construction of the project.
Financial Assistance for Projects (continued) Dallas County - Consider approving the selection of the proposer that submitted the best value proposal to develop, design, construct, and potentially maintain the Southern Gateway Project, including improvements to I-35E from south of the I-35E/US 67 interchange to Colorado Boulevard, with transition work extending north to Reunion Boulevard and improvements to US 67 from the I-35E/US 67 interchange to I-20 in Dallas County and consider authorizing the executive director of the department to negotiate and execute a Design-Build Agreement and associated Capital Maintenance Agreement with the selected proposer (MO) (Presentation) On November 10, 2016, the department issued a request for proposals to develop, design, construct, and potentially maintain the Southern Gateway Project, including improvements to I-35E from south of the I-35E/US 67 interchange to Colorado Boulevard, with transition work extending north to Reunion Boulevard and improvements to US 67 from the I-35E/US 67 interchange to I-20 in Dallas County. The department has completed its review and evaluation of proposals and is presenting its best value recommendation to the commission.
State Infrastructure Bank Montgomery County - City of Magnolia - Consider final approval of a request from the City of Magnolia for a State Infrastructure Bank loan in the amount of up to $1,000,000 to pay the costs of utility relocation necessary for a highway improvement project on FM 1774 (MO) The SIB loan will be secured by a pledge of ad valorem taxes. The loan will be used to pay the costs of utility relocation necessary for a highway improvement project on FM 1774 from FM 1486 to 0.109 mile North of FM 1488 for a total length of 0.969 miles.
Minute Order Review Consider rescinding Minute Order 108851 (MO) As a result of a review of the commission’s minute orders, the department determined that the substance of Minute Order 108851, adopted March 28, 2002 and relating to bid guaranties for certain highway improvement contracts, should be added to the department rules. To accomplish that purpose amendments to Title 43, Texas Administrative Code §9.14 were finally adopted on March 28, 2017. Because those amendments are now effective, Minute Order 108851 should be rescinded.
Purchase Order Amendment Consider the approval for an amendment to extend time to a purchase order awarded under Chapter 2155 of the Texas Government Code for the administration of sponsorship programs that acknowledge donations supporting various highway maintenance and operation activities at no cost to the department. The terms of the purchase order allow the amendment being proposed. (MO) Section 2155.088, Government Code, requires that the governing body of a state agency, at a meeting, consider a material change to the contract for goods or services awarded under Chapter 2155, Government Code, and consider why that change is necessary. The proposed amendment is a material change under Chapter 2155.
Contracts Consider the award or rejection of contracts for highway construction and maintenance, and construction and rehabilitation of buildings. These proposed minute orders contain information concerning the receipt of bids for highway improvement contracts. The department may reschedule receipt of bids for those projects where the commission rejects all bids. Those bids accepted by the commission will result in conditional contract awards to the low bidders. Contract award conditions may involve securing funding from other sources, the contractor's ability to satisfy federal DBE subcontracting requirements, or other requirements as outlined in the project bid proposal. Clay County - Concur with or reject the award of Oklahoma highway improvement project contract on SH 79 at the Texas/Oklahoma border (see attached itemized list) (MO) The proposed minute order will concur with the award of contract in the State of Oklahoma pursuant to an agreement signed by the State of Texas and the State of Oklahoma in 2013. The Texas Transportation Commission is authorized by the authority of the governor to contract with an adjoining state to provide for the improvement of a road or highway that crosses the state boundary.

Eminent Domain Proceedings Various Counties - Consider the authorization of the filing of condemnation proceedings to acquire real property by eminent domain for non-controlled and controlled access highways (see attached itemized list) (MO) Commission findings, determinations, and authorizations for the state, by motion made in accordance with Senate Bill 18 (82nd Legislature), to acquire by eminent domain, upon the payment of adequate and just compensation, various ownership interests in specific parcels of real property that are needed to develop or improve both non-controlled and controlled access state highways, to include requesting the state attorney general to bring and pursue condemnation suits relating to those specific parcels of real property described in the attached itemized list.
Routine Minute Orders and Reports a. Donations to the Department (1) Various Districts - Consider the acknowledgment of donations made to the department to include: (a) donations in any form, including realty, personalty, money, materials, or services, which are made to the department for the purpose of carrying out its functions and duties; and (b) donations from landowners, with land adjacent to a highway that is part of the state highway system, to construct an improvement on the highway right-of-way that is directly related to improving access to or from the owner’s land (see attached itemized list) (MO) (2) Dallas District - Consider the acknowledgement of the acquisition by gift/donation of required right of way accepted by the department for the purposes of constructing, maintaining, widening, straightening, or extending the state highway system (see attached itemized list) (MO) The property being donated to the department is necessary for the improvement of the state highway system. The real property to be donated is valued at more than $500. b. Real Estate Dispositions The commission must approve the sales, transfers, and exchanges of state rights of way and other real properties that are no longer needed for a state highway purpose. It must also approve, accept and acknowledge donations to the state of real property that is valued at $500 or more. (1) Angelina County - SH 103 at US 69 in Lufkin - Consider the sale of right of way to the abutting landowner (MO) The district has determined that the land is no longer needed for highway purposes and may be sold to the abutting landowner. (2) Brazoria County - FM 524 between SH 35 and SS 419 in Old Ocean - Consider the removal from the system and transfer of control, jurisdiction, and maintenance to Brazoria County (county), and consider the quitclaim of right of way to the county (MO) The district has determined that a segment of the highway is no longer needed as part of the system. The county has requested the removal and has agreed to assume control, jurisdiction and maintenance. The right of way is held in the county’s name and may be quitclaimed to the county. (3) Dallas County - SS 366 at Pearl Street in Dallas - Consider the quitclaim of right of way to honor a reversionary clause and the release of access restrictions (MO) The district has determined that the land is no longer needed for highway purposes. The acquisition instrument provides that if the land is no longer needed for state highway purposes, it reverts to the city. In addition, the city has requested the release of access restrictions. (4) Hall County - FM 1547 in Memphis - Consider the removal from the system and transfer of control, jurisdiction and maintenance to the City of Memphis (city), designation on a new location, and transfer of right of way to the city (MO) Construction was completed on a new location, and the district has determined that a segment of the highway is no longer needed as part of the system and should be designated on the new location. The city has agreed to assume control, jurisdiction and maintenance on the old location. The right of way may be transferred to the city at no cost to remain in use for public road purposes. (5) Kerr County - SH 16 at G Street West in Kerrville - Consider the sale of right of way to the abutting landowner (MO) The district has determined that the land is no longer needed for highway purposes and may be sold to the abutting landowner. (6) McLennan County - FM 1637 from W. Lake Shore Drive to US 84 (W. Waco Drive) in Waco - Consider the removal from the system and transfer of control, jurisdiction, and maintenance to the City of Waco (city) and the transfer and quitclaim of right of way to the city (MO) The district has determined that a segment of the highway is no longer needed as part of the system. The city has agreed to assume control, jurisdiction and maintenance. The state-owned land may be transferred to the city to remain in use for public road purposes, and the land to which there is no title in the state’s name may be quitclaimed to the city. (7) McLennan County - FS 434 from I-35 to FM 434, and FM 434 from I-35 to BU 77 (La Salle Avenue) in Waco - Consider the removal from the system and transfer of control, jurisdiction, and maintenance to the City of Waco (city) and the transfer and quitclaim of right of way to the city (MO) The district has determined that a segment of the highway is no longer needed as part of the system. The city has agreed to assume control, jurisdiction and maintenance. The state-owned land may be transferred to the city to remain in use for public road purposes, and land to which there is no record title in the state’s name may be quitclaimed to the city. (8) Titus County - SH 49, old alignment southeast of Mount Pleasant - Consider the sale and quitclaim of right of way to the abutting landowner (MO) The district has determined that the land is no longer needed for highway purposes. Portions of the land are owned by the state and may be sold to the abutting landowner. There is no record title to another portion, and it may be quitclaimed to the abutting landowner at the request of the county. c. Reports (1) Compliance Division report State law requires the commission to establish a compliance program, which must include a Compliance Division to oversee the program. The Compliance Division is responsible for acting to prevent and detect serious breaches of department policy, fraud, waste, and abuse of office, including any acts of criminal conduct within the department. The Compliance Division is required to provide a monthly report to the commission regarding investigations and a summary of information relating to trends and recommendations. (2) Obligation Limit Report Quarterly status report on the FY 2017 Obligation Limit, the actual obligations utilized through the current month, proposed remaining highway maintenance and construction contract letting for the fiscal year and an update on motor fuel tax receipts (Report) This report will provide the current overall obligation status, by district and metropolitan planning organization, of the FY 2017 Obligation Limit and will also provide the anticipated effect on the obligation limit of remaining proposed highway maintenance and construction letting. The report will also provide an update on motor fuel tax receipts, including estimated versus actual receipts fiscal year to date, and any potential impact on letting volume. (3) Quarterly report on FY 2017 State Highway Fund 6 cash status (Report) This report updates the commission on the year-to-date cash balance and activity of Fund 6. The report will include original projections and actual revenues/inflows and expenditures/outflows on a cash basis. d. Finance (1) Quarterly Investment Report (MO) This minute order recognizes the presentation and commission’s acceptance of the quarterly investment report for the investment of funds held by the Bank of New York Mellon, as trustee, under the Central Texas Turnpike System master trust indenture; funds for the Pre-paid TxTag account held by the Bank of New York Mellon, acting as custodian; and funds related to obligations issued for the IH 35E Project under a Trust Agreement by and between Amegy Bank, a Division of ZB, National Association, as trustee, and the department. (2) Travis and Williamson Counties - Consider the acceptance of the report of Actual Traffic and Revenue for the Central Texas Turnpike System (MO) Report of actual traffic and revenue for the CTTS as of February 28, 2017. e. Transportation Planning (1) Various Counties - Consider the approval of the Fiscal Year 2016 Annual Report on the Economically Disadvantaged Counties Program (MO) This report documents the use of matching funds and local incentives as well as the savings to counties participating in the Economically Disadvantaged Counties Program. State law requires the commission to provide an annual report on the program to the governor, the lieutenant governor, and the speaker of the House of Representatives. (2) Various Counties - Consider concurrence with the Regional Transportation Council of the North Central Texas Council of Governments' funding of construction and other project development costs of projects to be advanced through the use of payments received from the North Texas Tollway Authority in accordance with the SH 121 Toll Project Agreement (MO) The department has established a separate fund to account for and track projects and project costs funded with the SH 121 payments. This minute order authorizes the funding of additional projects costs and changes to the list of previously-approved projects. The project costs to be funded were selected through a cooperative process with the Regional Transportation Council. (3) Various Counties - Consider concurrence with the Regional Transportation Council of the North Central Texas Council of Governments' funding of construction and other project development costs of projects to be advanced through the use of payments received from the North Texas Tollway Authority in accordance with the SH 161 Toll Project Agreement (MO) The department has established a separate fund to account for and track projects and project costs funded with the SH 161 payments. This minute order authorizes changes to the list of previously-approved projects. f. Speed Zones Various Counties - Consider the establishment or alteration of regulatory and construction speed zones on various sections of highways in the state (MO) This minute order establishes or alters regulatory and construction speed zones on various sections of highways in the state

Transportation Planning (1) Various Counties - Consider the approval of the Fiscal Year 2016 Annual Report on the Economically Disadvantaged Counties Program (MO) This report documents the use of matching funds and local incentives as well as the savings to counties participating in the Economically Disadvantaged Counties Program. State law requires the commission to provide an annual report on the program to the governor, the lieutenant governor, and the speaker of the House of Representatives. (2) Various Counties - Consider concurrence with the Regional Transportation Council of the North Central Texas Council of Governments' funding of construction and other project development costs of projects to be advanced through the use of payments received from the North Texas Tollway Authority in accordance with the SH 121 Toll Project Agreement (MO) The department has established a separate fund to account for and track projects and project costs funded with the SH 121 payments. This minute order authorizes the funding of additional projects costs and changes to the list of previously-approved projects. The project costs to be funded were selected through a cooperative process with the Regional Transportation Council. At the conclusion of all other agenda items, the commission will allow an open comment period, not to exceed one hour, to receive public comment on any other matter that is under the jurisdiction of the department. No action will be taken. Each speaker will be allowed a maximum of three minutes. Speakers must be signed up prior to the beginning of the open comment period.
