Regional Mobility Authority Webb County - Approve the City of Laredo's request for an exception to the requirements of 43 TAC §26.51(b)(1)(A), concerning eligibility to serve as a director or chief administrative officer of a regional mobility authority, in connection with the City of Laredo's appointment of a new member of the Board of Directors of the Webb County-City of Laredo Regional Mobility Authority (MO) Under 43 TAC §26.51(b)(1)(A), a person is not eligible to serve as a director or chief administrative officer of a regional mobility authority (RMA) if the person or the person’s spouse is employed by or participates in the management of a business entity or other organization that is regulated by or receives funds from the department, the RMA, or a member county. The City of Laredo recently appointed Douglas B. Howland to the Webb County-City of Laredo RMA Board of Directors. Mr. Howland currently serves on the Board of Directors of the South Texas Food Bank, which receives funding from Webb County, and Mr. Howland's spouse serves on the Board of Directors of the Children's Advocacy Center of Laredo-Webb County, a non-profit agency that receives funding from the City of Laredo and Webb County.
Promulgation of Administrative Rules Under Title 43, Texas Administrative Code, and the Administrative Procedure Act, Government Code, Chapter 2001: Final Adoption Chapter 28 - Oversize and Overweight Loads New §28.110, Purpose, §28.111, Definition, and §28.112, Districts Powers and Duties, §28.113, Permit Eligibility, §28.114, Permit Issuance Requirements and Procedures, §28.115, Permit Weight Limits for Axles, §28.116, Movement Requirements and Restrictions, §28.117, Records (Port of Harlingen Authority Permits) (MO) These new sections provide authority for Port of Harlingen Authority to issue permits for the operation of oversize and overweight vehicles on certain roads specified by Transportation Code, Section 623.219(a). The sections also establish the guidelines for the agreement between the Authority and the department and requirements the Authority must follow for the issuance of permits
Proposed Adoption Chapter 9 - Contract and Grant Management Amendments to §9.31, Definitions, §9.33, Precertification, and §9.34, Comprehensive Process, (Contracting for Architectural, Engineering, and Surveying Services) (MO) These amendments modify administrative qualification requirements for professional services contracts by providing a timeframe for department review of audit reports or self-certifications and establishing rejection and resubmittal requirements for a provider’s failure to return additional information within 30 days following the department’s request. The amendments also harmonize administrative qualification requirements of the state-funded procurement process with the federal procurement process by changing the focus to the type of service to be provided rather than the type of firm providing the service. Additionally, these amendments provide the department flexibility to modify standard work categories used for precertification without commission approval. Finally, the amendments will allow the department, during the procurement process, to accept at the department’s discretion a current employee of the provider or a subprovider as a replacement task leader if that task leader meets the requirements provided in the solicitation.
Rule Review In accordance with Government Code, §2001.039, Readoption of Title 43 Texas Administrative Code Chapter 2, Environmental Review of Transportation Projects; Chapter 7, Rail Facilities; Chapter 26, Regional Mobility Authorities; Chapter 28, Oversize and Overweight Vehicles and Loads; Chapter 30, Aviation; and Chapter 31, Public Transportation (MO) State law requires a state agency to review each of its rules not later than every four years. After the review, the agency must readopt the rule, readopt the rule with amendments, or repeal the rule. The department reviews its rules on a rotating basis.
Finance and Financial Assistance for Projects Texas Mobility Fund Harris County - Harris County - Consider approving a grant in the amount of up to $10,191,050 to Harris County for participation by the State in the payment of a portion of the costs of construction of a public transportation project to provide improvements to expand Jacintoport Boulevard and Peninsula Street in Harris County, Texas, with funding from the Texas Mobility Fund established pursuant to Section 49-k, Article III, Texas Constitution (MO) This minute order will award a Texas Mobility Fund grant for participation by the state in the payment of a portion of the costs of constructing a public transportation project to expand Peninsula Street to four lanes and Jacintoport Boulevard to five lanes with associated curb and gutter/storm sewer improvements; and installation of rail gate arms at six rail crossings.
Nueces County - Port of Corpus Christi - Consider approving a grant in the amount of up to $1,675,000 to the Port of Corpus Christi for participation by the State in the payment of a portion of the costs of construction of a public transportation project to widen a section of the Joe Fulton International Trade Corridor near mile marker 5 in Nueces County, Texas, with funding from the Texas Mobility Fund established pursuant to Section 49-k, Article III, Texas Constitution (MO) This minute order will award a Texas Mobility Fund grant for participation by the state in the payment of a portion of the costs of constructing a public transportation project to widen a section of the Joe Fulton International Trade Corridor near mile marker 5 to add turning lanes to a new intersection and entrance road to provide access to M&G Group plant; add signage, striping, pavement, drainage, and automated rail signal/gate, and street lights.
Victoria County - Victoria County - Consider approving a grant in the amount of up to $2,856,668 to Victoria County for participation by the state in the payment of a portion of the costs of construction of a public transportation project to provide improvements to rehabilitate and widen McCoy Road, Canal Road, and Old Bloomington Road in Victoria County, Texas, with funding from the Texas Mobility Fund established pursuant to Section 49-k, Article III, Texas Constitution (MO) This minute order will award a Texas Mobility Fund grant for participation by the state in the payment of a portion of the costs of constructing a public transportation project to rehabilitate and widen McCoy Road from Hwy 185 to 1.5 miles west, Canal Road from Old Bloomington Road to Victoria Barge Canal, and Old Bloomington Road from FM 1432 to FM 1686.
Approval of new liquidity provider and liquidity agreement in connection with the commission’s outstanding State of Texas General Obligation Mobility Fund Bonds, Series 2006-B (Multi-Modal Bonds) and approval of amendments to various agreements in connection therewith (MO) The Series 2006-B Bonds are variable rate bonds for which the commission maintains a liquidity agreement which expires December 13, 2016. This minute order approves entering into a new liquidity agreement to support the Series 2006-B Bonds and also approves the chief financial officer executing certain agreements and amendments to existing agreements to effectuate replacement of the existing liquidity agreement and provider.
Finance and Financial Assistance for Projects (continued) Brazoria County - Brazoria County - Consider granting preliminary approval of a request from Brazoria County for financial assistance in the form of a grant in the amount of up to $10,000,000, to pay for costs of developing and designing a toll facility in the median of SH 288, from the Brazoria/Harris county line to CR 58 in Brazoria County (MO) Brazoria County and Brazoria County Toll Road Authority are constructing a toll facility in the median of SH 288 from the Brazoria/Harris county line to CR 58, all in Brazoria County, to include two northbound toll lanes and two southbound toll lanes, separated from the general purpose lanes by a hard barrier.
Quarterly Investment Report (MO) This minute order recognizes the presentation and commission’s acceptance of the quarterly investment report for the investment of funds held by the Bank of New York Mellon, as trustee, under the Central Texas Turnpike System master trust indenture; and the investment of funds for the Pre-paid TxTag account held by the Bank of New York Mellon, acting as custodian.
State Infrastructure Bank Harris County - Harris County Municipal Utility District No. 50 - Consider final approval of a request from the Harris County Municipal Utility District No. 50 for a State Infrastructure Bank loan in the amount of up to $500,000 to pay the costs of utility relocation necessary for a state highway improvement project to widen FM 1942 (MO) The SIB loan will be secured by a pledge of net revenues of the water, sewer, and sanitation services provided by Harris County Municipal Utility District No. 50. The loan will be used to pay the costs of utility relocation necessary for the widening of FM 1942 from two lanes to four lanes from US 90 to FM 1942/Crosby Lynchburg Road.
Contracts Award or reject contracts for maintenance, and highway and building construction These proposed minute orders contain information concerning the receipt of bids for highway improvement contracts. The department may reschedule receipt of bids for those projects where the commission rejects all bids. Those bids accepted by the commission will result in conditional contract awards to the low bidders. Contract award conditions may involve securing funding from other sources, the contractor's ability to satisfy federal DBE subcontracting requirements, or other requirements as outlined in the project bid proposal. Eminent Domain Proceedings Various Counties - Authorize the filing of condemnation proceedings to acquire real property by eminent domain for non-controlled and controlled access highways (see attached itemized list) (MO) Commission findings, determinations, and authorizations for the state, by motion made in accordance with Senate Bill 18 (82nd Legislature), to acquire by eminent domain, upon the payment of adequate and just compensation, various ownership interests in specific parcels of real property that are needed to develop or improve both non-controlled and controlled access state highways, to include requesting the state attorney general to bring and pursue condemnation suits relating to those specific parcels of real property described in the attached itemized list.
Routine Minute Orders and Reports a. Donations to the Department Various Districts - Consider the acknowledgment of donations made to the department to include: (a) donations in any form, including realty, personalty, money, materials, or services, which are made to the department for the purpose of carrying out its functions and duties; and (b) donations from landowners, with land adjacent to a highway that is part of the state highway system, to construct an improvement on the highway right-of-way that is directly related to improving access to or from the owner’s land. (See attached itemized list) (MO) The donations will ensure the safety of the traveling public. b. Real Estate Donation Williamson County - Consider for acknowledgement of the acquisition by gift/donation of required right of way accepted by the department for purposes of constructing, maintaining, widening, straightening, or extending the state highway system. (See attached itemized list) (MO) The property being donated to the department is necessary for the improvement of the state highway system. The real property to be donated is valued at more than $500. c. Real Estate Dispositions The commission must approve the sales, transfers, and exchanges of state rights of way and other real properties that are no longer needed for a state highway purpose. It must also approve, accept and acknowledge donations to the state of real property that is valued at $500 or more. (1) Bexar County - I-10 at Fresno in San Antonio - Consider the sale of right of way by sealed bid (MO) The district has determined that the land is no longer needed for highway purposes. The local governmental entities and abutting landowners declined interest in purchasing the land, and it was advertised for sale by sealed bid. There was one bid, and the land may be sold to the bidder. (2) Caldwell County - SH 130, portion of an old county road, formerly part of old SH 29 - Consider the quitclaim of land in the county’s name to the abutting landowner (MO) The district has advised that the land is no longer needed for highway purposes. The abutting landowner has requested to acquire it, and the county has requested that it be quitclaimed to the abutting owner. The land may be quitclaimed to the abutting landowner. (3) El Paso County - I-10 at Paseo del Norte Boulevard. in El Paso - Consider the sale of right of way to the abutting landowner (MO) The district has determined that the land is no longer needed for highway purposes. The abutting landowner has requested to purchase the land, and it may be sold to the abutting owner. (4) Tarrant County - BF 1187C in Crowley - Consider the removal from the system, transfer of control, maintenance, and jurisdiction to the City of Crowley (city), and quitclaim of right of way to the city (MO) The district has determined that a segment of the highway is no longer needed as part of the system. The city has agreed to assume control, jurisdiction, and maintenance and has requested to acquire the right of way. Control, jurisdiction, and maintenance may be transferred to the city, and the right of way may be quitclaimed to the city. (5) Tarrant County - I-30 at Photo Street in Fort Worth - Consider the sale of right of way to the abutting landowner (MO) The district has determined that the land is no longer needed for highway purposes. The abutting landowner has requested to purchase the land, and it may be sold to the abutting owner d. Reports (1) Compliance Division Compliance Division report State law requires the commission to establish a compliance program, which must include a Compliance Division to oversee the program. The Compliance Division is responsible for acting to prevent and detect serious breaches of department policy, fraud, waste, and abuse of office, including any acts of criminal conduct within the department. The Compliance Division is required to provide a monthly report to the commission regarding investigations and a summary of information relating to trends and recommendations. (2) Obligation Limit Report Quarterly status report on the FY 2016 Obligation Limit, the actual obligations utilized through the current month, proposed remaining highway maintenance and construction contract letting for the fiscal year and an update on motor fuel tax receipts (Report) This report will provide the current overall obligation status, by district and metropolitan planning organization, of the FY 2016 Obligation Limit and will also provide the anticipated effect on the obligation limit of remaining proposed highway maintenance and construction letting. The report will also provide an update on motor fuel tax receipts, including estimated versus actual receipts fiscal year to date, and any potential impact on letting volume. (3) Quarterly report on FY 2016 State Highway Fund 6 cash status (Report) This report updates the commission on the year-to-date cash balance and activity of Fund 6. The report will include original projections and actual revenues/inflows and expenditures/outflows on a cash basis. (4) Travis and Williamson Counties - Accept the report of Actual Traffic and Revenue for the Central Texas Turnpike System (CTTS) (MO) Report of actual traffic and revenue for the CTTS as of August 31, 2016. e. Annual Toll Rate Adjustment (1) Travis and Williamson Counties - Accept the annual escalated toll rates for the Central Texas Turnpike System (CTTS), as calculated on each toll escalation determination date (MO) This minute order accepts the annual escalated toll rates for the CTTS, consisting of the SH 130 (Segments 1-4), SH 45N, Loop 1 (from FM 734 to SH 45N), and SH 45SE project elements, replacing the current rate tables previously set by the commission with toll rate tables that escalate the toll rates on January 1, 2017 based on the annual toll rate escalation percentage. (2) Harris, Montgomery, and Chambers Counties - Accept the annual escalated toll rates for portions of SH 99 (Grand Parkway) consisting of the tolled portion of Segment D in Harris County, Segments E, F-1, F-2, and G, and for the existing tolling points on the portion of Segment I-2 from I-10 to Fisher Road (Segment I-2A), as calculated on the toll escalation determination date (MO) This minute order accepts the annual escalated toll rates for the tolled portion of Grand Parkway Segment D in Harris County and for Segments E, F-1, F-2 , and G, and for the existing tolling points on Segment I-2A, replacing the current toll rate tables previously set by the commission with toll rate tables that escalate the toll rates on January 1, 2017, based on the annual toll rate escalation percentage. f. Transportation Planning (1) Various Counties - Concurrence with the Regional Transportation Council of the North Central Texas Council of Governments' funding of construction and other project development costs of projects to be advanced through the use of payments received from the North Texas Tollway Authority in accordance with the SH 121 Toll Project Agreement (MO) The department has established a separate fund to account for and track projects and project costs funded with the SH 121 payments. This minute order authorizes the funding of additional projects costs and changes to the list of previously-approved projects. The project costs to be funded were selected through a cooperative process with the Regional Transportation Council. (2) Various Counties - Concurrence with the Regional Transportation Council of the North Central Texas Council of Governments' funding of construction and other project development costs of projects to be advanced through the use of payments received from the North Texas Tollway Authority in accordance with the SH 161 Toll Project Agreement (MO) The department has established a separate fund to account for and track projects and project costs funded with the SH 161 payments. This minute order authorizes changes to the list of previously-approved projects. (3) Various Counties - Certify eligible counties for the 2017 Economically Disadvantaged Counties Program and establish local match adjustments for each county and certain cities (MO) This minute order certifies the counties to participate in the Economically Disadvantaged Counties Program for Fiscal Year 2017 and sets forth the local match adjustment for each county and certain cities participating in the program. State law requires the commission to annually certify economically disadvantaged counties as soon as possible after the comptroller reports on the relevant economic indicators. g. Designation of Access Control Dallas County - I-30, approximately 0.60 miles east of North Cockrell Hill Road - Consider the designation of one location on the frontage road at which access will be permitted to the abutting property (MO) The designation of one 50-foot break in the control-of-access line will allow the abutting landowner to open one proposed driveway location for access, permitting access to and from the eastbound frontage road. The district has determined that access may be permitted at the designated location. h. Speed Zones Various Counties - Establish or alter regulatory and construction speed zones on various sections of highways in the state (MO) This minute order establishes or alters regulatory and construction speed zones on various sections of highways in the state.

Eminent Domain Proceedings Various Counties - Authorize the filing of condemnation proceedings to acquire real property by eminent domain for non-controlled and controlled access highways (see attached itemized list) (MO) Commission findings, determinations, and authorizations for the state, by motion made in accordance with Senate Bill 18 (82nd Legislature), to acquire by eminent domain, upon the payment of adequate and just compensation, various ownership interests in specific parcels of real property that are needed to develop or improve both non-controlled and controlled access state highways, to include requesting the state attorney general to bring and pursue condemnation suits relating to those specific parcels of real property described in the attached itemized list.
Routine Minute Orders and Reports a. Donations to the Department Various Districts - Consider the acknowledgment of donations made to the department to include: (a) donations in any form, including realty, personalty, money, materials, or services, which are made to the department for the purpose of carrying out its functions and duties; and (b) donations from landowners, with land adjacent to a highway that is part of the state highway system, to construct an improvement on the highway right-of-way that is directly related to improving access to or from the owner’s land. (See attached itemized list) (MO) The donations will ensure the safety of the traveling public. b. Real Estate Donation Williamson County - Consider for acknowledgement of the acquisition by gift/donation of required right of way accepted by the department for purposes of constructing, maintaining, widening, straightening, or extending the state highway system. (See attached itemized list) (MO) The property being donated to the department is necessary for the improvement of the state highway system. The real property to be donated is valued at more than $500. c. Real Estate Dispositions The commission must approve the sales, transfers, and exchanges of state rights of way and other real properties that are no longer needed for a state highway purpose. It must also approve, accept and acknowledge donations to the state of real property that is valued at $500 or more. (1) Bexar County - I-10 at Fresno in San Antonio - Consider the sale of right of way by sealed bid (MO) The district has determined that the land is no longer needed for highway purposes. The local governmental entities and abutting landowners declined interest in purchasing the land, and it was advertised for sale by sealed bid. There was one bid, and the land may be sold to the bidder. (2) Caldwell County - SH 130, portion of an old county road, formerly part of old SH 29 - Consider the quitclaim of land in the county’s name to the abutting landowner (MO) The district has advised that the land is no longer needed for highway purposes. The abutting landowner has requested to acquire it, and the county has requested that it be quitclaimed to the abutting owner. The land may be quitclaimed to the abutting landowner. (3) El Paso County - I-10 at Paseo del Norte Boulevard. in El Paso - Consider the sale of right of way to the abutting landowner (MO) The district has determined that the land is no longer needed for highway purposes. The abutting landowner has requested to purchase the land, and it may be sold to the abutting owner. (4) Tarrant County - BF 1187C in Crowley - Consider the removal from the system, transfer of control, maintenance, and jurisdiction to the City of Crowley (city), and quitclaim of right of way to the city (MO) The district has determined that a segment of the highway is no longer needed as part of the system. The city has agreed to assume control, jurisdiction, and maintenance and has requested to acquire the right of way. Control, jurisdiction, and maintenance may be transferred to the city, and the right of way may be quitclaimed to the city. (5) Tarrant County - I-30 at Photo Street in Fort Worth - Consider the sale of right of way to the abutting landowner (MO) The district has determined that the land is no longer needed for highway purposes. The abutting landowner has requested to purchase the land, and it may be sold to the abutting owner d. Reports (1) Compliance Division Compliance Division report State law requires the commission to establish a compliance program, which must include a Compliance Division to oversee the program. The Compliance Division is responsible for acting to prevent and detect serious breaches of department policy, fraud, waste, and abuse of office, including any acts of criminal conduct within the department. The Compliance Division is required to provide a monthly report to the commission regarding investigations and a summary of information relating to trends and recommendations. (2) Obligation Limit Report Quarterly status report on the FY 2016 Obligation Limit, the actual obligations utilized through the current month, proposed remaining highway maintenance and construction contract letting for the fiscal year and an update on motor fuel tax receipts (Report) This report will provide the current overall obligation status, by district and metropolitan planning organization, of the FY 2016 Obligation Limit and will also provide the anticipated effect on the obligation limit of remaining proposed highway maintenance and construction letting. The report will also provide an update on motor fuel tax receipts, including estimated versus actual receipts fiscal year to date, and any potential impact on letting volume. (3) Quarterly report on FY 2016 State Highway Fund 6 cash status (Report) This report updates the commission on the year-to-date cash balance and activity of Fund 6. The report will include original projections and actual revenues/inflows and expenditures/outflows on a cash basis. (4) Travis and Williamson Counties - Accept the report of Actual Traffic and Revenue for the Central Texas Turnpike System (CTTS) (MO) Report of actual traffic and revenue for the CTTS as of August 31, 2016. e. Annual Toll Rate Adjustment (1) Travis and Williamson Counties - Accept the annual escalated toll rates for the Central Texas Turnpike System (CTTS), as calculated on each toll escalation determination date (MO) This minute order accepts the annual escalated toll rates for the CTTS, consisting of the SH 130 (Segments 1-4), SH 45N, Loop 1 (from FM 734 to SH 45N), and SH 45SE project elements, replacing the current rate tables previously set by the commission with toll rate tables that escalate the toll rates on January 1, 2017 based on the annual toll rate escalation percentage. (2) Harris, Montgomery, and Chambers Counties - Accept the annual escalated toll rates for portions of SH 99 (Grand Parkway) consisting of the tolled portion of Segment D in Harris County, Segments E, F-1, F-2, and G, and for the existing tolling points on the portion of Segment I-2 from I-10 to Fisher Road (Segment I-2A), as calculated on the toll escalation determination date (MO) This minute order accepts the annual escalated toll rates for the tolled portion of Grand Parkway Segment D in Harris County and for Segments E, F-1, F-2 , and G, and for the existing tolling points on Segment I-2A, replacing the current toll rate tables previously set by the commission with toll rate tables that escalate the toll rates on January 1, 2017, based on the annual toll rate escalation percentage. f. Transportation Planning (1) Various Counties - Concurrence with the Regional Transportation Council of the North Central Texas Council of Governments' funding of construction and other project development costs of projects to be advanced through the use of payments received from the North Texas Tollway Authority in accordance with the SH 121 Toll Project Agreement (MO) The department has established a separate fund to account for and track projects and project costs funded with the SH 121 payments. This minute order authorizes the funding of additional projects costs and changes to the list of previously-approved projects. The project costs to be funded were selected through a cooperative process with the Regional Transportation Council. (2) Various Counties - Concurrence with the Regional Transportation Council of the North Central Texas Council of Governments' funding of construction and other project development costs of projects to be advanced through the use of payments received from the North Texas Tollway Authority in accordance with the SH 161 Toll Project Agreement (MO) The department has established a separate fund to account for and track projects and project costs funded with the SH 161 payments. This minute order authorizes changes to the list of previously-approved projects. (3) Various Counties - Certify eligible counties for the 2017 Economically Disadvantaged Counties Program and establish local match adjustments for each county and certain cities (MO) This minute order certifies the counties to participate in the Economically Disadvantaged Counties Program for Fiscal Year 2017 and sets forth the local match adjustment for each county and certain cities participating in the program. State law requires the commission to annually certify economically disadvantaged counties as soon as possible after the comptroller reports on the relevant economic indicators. g. Designation of Access Control Dallas County - I-30, approximately 0.60 miles east of North Cockrell Hill Road - Consider the designation of one location on the frontage road at which access will be permitted to the abutting property (MO) The designation of one 50-foot break in the control-of-access line will allow the abutting landowner to open one proposed driveway location for access, permitting access to and from the eastbound frontage road. The district has determined that access may be permitted at the designated location. h. Speed Zones Various Counties - Establish or alter regulatory and construction speed zones on various sections of highways in the state (MO) This minute order establishes or alters regulatory and construction speed zones on various sections of highways in the state.
