Toll Operations Travis and Williamson Counties - Establish temporary toll rate tables on the SH 130 (Segments 1-4) and SH 45 Southeast elements of the Central Texas Turnpike System to charge a discounted rate for certain large trucks, utilizing a two-phased approach with different discounts that will apply during each phase between 7:00 AM and 7:00 PM during weekdays, for a combined period beginning April 18, 2016 and ending no later than August 31, 2017 (MO) This minute order authorizes a temporary truck toll discount program and establishes temporary toll rates for Segments 1-4 of SH 130 and SH 45 SE. The temporary program will be applied in two phases. During the Phase I temporary period, April 18, 2016 to October 31, 2016, truck toll rates for trucks with more than three axles will be the same as the applicable three-axle rate for a continuous twelve (12) hour period, 7:00 AM to 7:00 PM, during weekdays only. During the Phase II temporary period, November 1, 2016 to no later than August 31, 2017, toll rates for trucks with a valid transponder will be the same as the two-axle rate for a continuous twelve (12) hour period, 7:00 AM to 7:00 PM, during weekdays only. During Phase II, toll rates for trucks with more than three axles and no transponder will be charged the three-axle PBM rate. The purpose of the program is to provide discounts to large trucks in accordance with 2015 House Bill 1, Rider 49.B.

Legislative Appropriations Request (LAR) Discussion regarding the development of the Texas Department of Transportation's Fiscal Year 2018-2019 LAR (Presentation) Staff will discuss the development of the LAR with the commission and seek direction on components of the LAR which include overall funding and FTE levels.
Energy Sector Program (Presentation) Staff will discuss a potential Energy Sector Program in active drilling areas of the state to armor major corridor pavement structures and enhance safety.
Aviation Various Counties - Award federal and state grant funding for airport improvement projects at various locations (MO) Federal law authorizes the award of federal funding to preserve and improve the state's general aviation system. State law authorizes the award of state funding for capital improvement projects. The airports listed in Exhibit A are eligible for award of these grant funds and the department seeks approval of the awards.
Various Counties - Award state funds to public transportation providers as appropriated by the 84th Texas Legislature (MO) Award state funding to transit agencies to address impacts of the 2010 Census beyond the formula-based awards previously awarded by the Texas Transportation Commission in June 2015.
Various Counties - Award federal and state funds to Ark-Tex Council of Governments, Public Transit Services, Rolling Plains Management Corporation, and SPAN, Inc. (MO) The awards identified in this minute order reflect a distribution of funds to rural transit districts assuming service on a temporary basis in the Texoma Area Paratransit System, Inc (TAPS) service area. TAPS has temporarily halted services in its six county area, and neighboring rural transit districts are providing service in the interim. Existing balances from TAPS grants need to be awarded to the rural transit districts to temporarily provide service in the six counties served by TAPS.
Various Counties - Award federal funds for Rural Areas Intercity Bus Transportation program (MO) The award identified in this minute order provides federal §5311(f) Formula Grants for Rural Areas Intercity Bus Transportation program funds to Greyhound Lines, Inc., in response to a coordinated program request for proposal.
Final Adoption (1) Chapter 9 - Contract and Grant Management Amendments to §9.102, §9.107, §9.111, §9.113, and §9.114 (Highway Improvement Contract Sanctions) (MO) These amendments modify the definition of an “affiliated entity” with regard to highway improvement contract sanction rules and create sanctions for a contractor’s failure to timely complete projects. (2) Chapter 21 - Right of Way Amendments to §21.31, §21.33, §21.41, and new §21.57 (Utility Accommodation), and §§21.962-21.963 (Leasing of Right of Way to Saltwater Pipeline Operators) (MO) These amendments revise Subchapter R to 43 TAC Chapter 21 to expand the definition and leasing requirements for saltwater pipeline facilities to implement House Bill 497 of the 84th Regular Session, which expanded the authorized placement of saltwater pipeline facilities within the right of way. In addition, changes are made to Chapter 21, Subchapter C, Utility Accommodations, to add a definition and terms of location for temporary saltwater pipeline facilities in conformance with House Bill 497 provisions, and modify design values for overhead electric and communication horizontal clearances.
Proposed Adoption (1) Chapter 2 - Environmental Review of Transportation Projects Amendments to §§2.1, 2.3, 2.5, 2.11, and 2.14 (General Provisions), §§2.44, 2.48, 2.49, and 2.50 (Environmental Review Process for Highway Projects), §§2.81, 2.83, 2.84, and 2.85 (Requirements for Classes of Projects), §§2.102, 2.104, 2.105, 2.106, 2.107, 2.108, and 2.110 (Public Participation), and §2.131 (Requirements for Specific Types of Projects and Programs) (MO) These amendments add additional flexibility in certain areas of and clarity to the environmental review process, and further streamline and improve the environmental review process. (2) Chapter 6 - State Infrastructure Bank Repeal of §6.24, Suspension of Applications (Procedures), and Amendments to §6.31, Department Action, and §6.32, Commission Action (Department and Commission Action) (MO) The proposed rulemaking implements new procedures for the commission’s consideration of applications so that the department may more effectively manage the available funds in the state infrastructure bank in accordance with the policies of the commission. (3) Chapter 7 - Rail Facilities Amendments to §§7.31, 7.33, 7.34, and 7.36, (Rail Safety) (MO) The proposed amendments clarify department policy in regard to obtaining a waiver of provisions for the clearance of structures over and alongside railway tracks. The proposed amendments also add references to the governing statutes and update department contact information. (4) Chapter 9 - Contract and Grant Management Amendments to §§9.31, 9.32, 9.34, 9.35, 9.37, and 9.41 (Contracting for Architectural, Engineering, and Surveying Services) (MO) These amendments implement changes to the procurement process to be consistent with recently adopted federal regulations, 23 CFR Part 172, which include the addition of a request for proposal in the federal procurement process and the limiting of the contract term of an indefinite deliverable contract, including a new multi-phase contract type. The amendments also correct citation errors and certain terminology used in the rules.
Grand Parkway Transportation Corporation Appoint director to the Grand Parkway Transportation Corporation (MO) The commission authorized the creation of the corporation and appointed three directors to the corporation’s board in March 2012. After that initial appointment, vacancies on the board have required subsequent appointments. There is now a vacancy on the board.
Private Activity Bond Surface Transportation Corporation Appoint director to the Texas Private Activity Bond Surface Transportation Corporation (MO) The commission authorized the creation of the corporation and appointed three directors to the corporation’s board in October 2008. Contracts Award or reject contracts for maintenance, highway and building construction These proposed minute orders contain information concerning the receipt of bids for highway improvement contracts. The department may reschedule receipt of bids for those projects where the commission rejects all bids. Those bids accepted by the commission will result in conditional contract awards to the low bidders. Contract award conditions may involve securing funding from other sources, the contractor's ability to satisfy federal DBE subcontracting requirements, or other requirements as outlined in the project bid proposal. a. Eminent Domain Proceedings Various Counties - Authorize the filing of condemnation proceedings to acquire real property by eminent domain for non-controlled and controlled access highways (see attached itemized list) (MO) Commission findings, determinations, and authorizations for the state, by motion made in accordance with Senate Bill 18 (82nd Legislature), to acquire by eminent domain, upon the payment of adequate and just compensation, various ownership interests in specific parcels of real property that are needed to develop or improve both non-controlled and controlled access state highways, to include requesting the state attorney general to bring and pursue condemnation suits relating to those specific parcels of real property described in the attached itemized list.
Routine Minute Orders and Reports a. Donations to the Department Various Districts - Consider the acknowledgment of donations made to the department to include: (a) donations in any form, including realty, personalty, money, materials, or services, which are made to the department for the purpose of carrying out its functions and duties; and (b) donations from landowners, with land adjacent to a highway that is part of the state highway system, to construct an improvement on the highway right-of-way that is directly related to improving access to or from the owner’s land. Real Estate Dispositions The commission must approve the sales, transfers, and exchanges of state rights of way and other real properties that are no longer needed for a state highway purpose. (1) Bee County - US 181 south of Skidmore - Consider the sale of right of way to Bee County (MO) The district has determined that the land is no longer needed for highway purposes. The county has requested to purchase the land, and it may be sold to the county. (2) Hays County - FM 967 at Garlic Creek - Consider the sale of a drainage Easement (MO) The district has determined that the easement is no longer needed for highway drainage purposes and may be sold to the fee owner of the property. (3) McLennan County - US 81 at S. Martin Luther King, Jr., Blvd. in Waco - Consider the sale of a drainage easement (MO) The district has determined that the easement is no longer needed for highway drainage purposes and may be sold to the fee owner of the property. (4) Montague County - US 82, south side, east of Hillcrest Drive in Nocona - Consider the transfer of right of way to the City of Nocona (MO) The district has determined that the land is no longer needed for highway purposes. The city has requested to acquire the land. The land may be transferred to the city without cost, since the cost of future maintenance exceeds the value of the land. c. Report Compliance Office Compliance Office report State law requires the commission to establish a compliance program, which must include a compliance office to oversee the program. The compliance office is responsible for acting to prevent and detect serious breaches of department policy, fraud, waste, and abuse of office, including any acts of criminal conduct within the department. The compliance office is required to provide a monthly report to the commission regarding investigations and a summary of information relating to trends and recommendations. d. Transportation Planning (1) Various Counties - Concurrence with the Regional Transportation Council of the North Central Texas Council of Governments' funding of construction and other project development costs of projects to be advanced through the use of payments received from the North Texas Tollway Authority in accordance with the SH 121 Toll Project Agreement (MO) The department has established a separate fund to account for and track projects and project costs funded with the SH 121 payments. This minute order authorizes the funding of additional projects costs with those payments. The project costs to be funded were selected through a cooperative process with the Regional Transportation Council. (2) Various Counties - Concurrence with the Regional Transportation Council of the North Central Texas Council of Governments' funding of construction and other project development costs of projects to be advanced through the use of payments received from the North Texas Tollway Authority in accordance with the SH 161 Toll Project Agreement (MO) The department has established a separate fund to account for and track projects and project costs funded with the SH 161 payments. This minute order authorizes changes to the list of previously-approved projects. e. Highway Designation Camp County - In the city of Pittsburg, redesignate SL 238 as BU 271-H (MO) This minute order redesignates State Loop 238 on the state highway system as BU 271-H from US 271, approximately 0.1 mile south of SL 179 to US 271, 0.4 mile south of FM 556, a distance of approximately 1.8 miles. f. Designation of Access Control (1) Collin County - SH 121, Between Alma Road and Stacy Road in McKinney - Consider the designation of one location on the southbound frontage road at which access will be permitted to the abutting property (MO) The designation of one 31-foot break in the control-of-access line will allow the abutting landowner to open one proposed driveway location for access to and from the southbound frontage road. The district has determined that access may be permitted at the designated location. f. Designation of Access Control (continued) (2) Tarrant County - SH 121, north of Stone Myers Parkway in Grapevine - Consider the redesignation of one location on the northbound frontage road at which access will be permitted to the abutting property (MO) The redesignation of one existing 60-foot break in the control-of-access line with one proposed 60-foot break in the control-of-access line will allow the abutting landowner to open one proposed driveway location for access to and from the northbound frontage road. The district has determined that access may be permitted at the designated location. g. Speed Zones Various Counties - Establish or alter regulatory and construction speed zones on various sections of highways in the state (MO) This minute order establishes or alters regulatory and construction speed zones on various sections of highways in the state.
