Border Trade Advisory Committee Appoint members to the Border Trade Advisory Committee (MO) This minute order appoints members to the Border Trade Advisory Committee (BTAC). The purpose of the committee, created in 2001 by the 77th Legislature, is to define and develop a strategy and make recommendations to the commission and the governor, in order to address the highest priority border trade transportation challenges.
Texas Freight Mobility Plan Adopt the Texas Freight Mobility Plan (MO) The Texas Freight Mobility Plan (TFMP) fulfills the federal requirement to develop a performance-based, statewide, multimodal freight plan. This minute order adopts the TFMP as the department’s first freight plan.
Authorize the department to enter into an agreement with other governmental entities related to the interoperability of toll collection systems (MO) MAP-21 requires that all toll facilities on federal-aid highways implement technologies or business practices that provide for the interoperability of electronic toll collection programs. This minute order authorizes the execution of an agreement related to interoperability between the department and the North Texas Tollway Authority, Harris County, the Central Texas Regional Mobility Authority, the Fort Bend Grand Parkway Toll Road Authority, the Kansas Turnpike Authority and the Oklahoma Turnpike Authority.
Aviation Various Counties - Award federal and state grant funding for airport improvement projects at various locations (MO) Federal law authorizes the award of federal funding to preserve and improve the state's general aviation system. State law authorizes the award of state funding for capital improvement projects. The airports listed in Exhibit A are eligible for award of these grant funds and the department seeks approval of the awards.
Final Adoption (1) Chapter 9 - Contract and Grant Management Amendments to §9.81, Definitions, §9.83, Notice and Letter of Interest, §9.85, Evaluation, §9.87, Selection, and §9.89, Qualification Requirements for Appraisers (Contracts for Scientific, Real Estate Appraisal, Right of Way Acquisition, and Landscape Architectural Services) (MO) These amendments respond to the identified need for additional capacity in the contracting for Professional Real Estate Appraisal Services and Right of Way Professional Acquisition Provider Services in order to meet the demand for timely, cost effective and transparent delivery of right of way projects. (2) Chapter 30 - Aviation New §§30.501-30.503 (Meteorological Evaluation Towers) (MO) The new sections implement Senate Bill 505, which was enacted during the 84th Legislative Session. The proposed rules require a person who owns, operates, or erects a meteorological evaluation tower to provide notice to the department of the existence of or intent to erect such a tower and register the tower with the department.
Proposed Adoption Chapter 9 - Contract and Grant Management Amendments to §9.102, §9.107, §9.111, §9.113, and §9.114 (Highway Improvement Contract Sanctions) (MO) These amendments modify the definition of an “affiliated entity” with regard to highway improvement contract sanction rules and create sanctions for a contractor’s failure to timely complete projects.
Accept the Quarterly Investment Report (MO) This minute order recognizes the commission's acceptance of the quarterly investment report or investments of funds relating to financing of the Central Texas Turnpike System and held by the Bank of New York Mellon, acting as trustee, and funds relating to the TxTAG custodial account held by BONY, acting as custodian.
Texas Mobility Fund Bonds Approve a Twelfth Supplemental Resolution authorizing the issuance of refunding obligations of the Texas Mobility Fund in one or more series; approve documents relating to the issuance of such obligations and the refunding of certain outstanding Texas Mobility Fund revenue bonds, including official statements, purchase contracts, and escrow agreements; designate certain department officials to take all action necessary to deliver the bonds; and approve an application to the Texas Bond Review Board, if necessary, for authority to issue such obligations (MO) This action provides final authorization for the chief financial officer and other designated department officials to move forward with the issuance and delivery of Texas Mobility Fund refunding obligations in one or more series, as authorized under Article III, Section 49-k of the Texas Constitution, Chapter 201 Subchapter M, of the Texas Transportation Code and Chapters 1207 and 1371 of the Texas Government Code. Contracts Award or reject contracts for maintenance, highway and building construction These proposed minute orders contain information concerning the receipt of bids for highway improvement contracts. The department may reschedule receipt of bids for those projects where the commission rejects all bids. Those bids accepted by the commission will result in conditional contract awards to the low bidders. Contract award conditions may involve securing funding from other sources, the contractor's ability to satisfy federal DBE subcontracting requirements, or other requirements as outlined in the project bid proposal. Eminent Domain Proceedings Various Counties - Authorize the filing of condemnation proceedings to acquire real property by eminent domain for non-controlled and controlled access highways (see attached itemized list) (MO) Commission findings, determinations, and authorizations for the state, by motion made in accordance with Senate Bill 18 (82nd Legislature), to acquire by eminent domain, upon the payment of adequate and just compensation, various ownership interests in specific parcels of real property that are needed to develop or improve both non-controlled and controlled access state highways, to include requesting the state attorney general to bring and pursue condemnation suits relating to those specific parcels of real property described in the attached itemized list.

Donations to the Department Various Districts - Consider the acknowledgment of donations made to the department to include: (a) donations in any form, including realty, personalty, money, materials, or services, which are made to the department for the purpose of carrying out its functions and duties; and (b) donations from landowners, with land adjacent to a highway that is part of the state highway system, to construct an improvement on the highway right-of-way that is directly related to improving access to or from the owner’s land. Real Estate Dispositions The commission must approve the sales, transfers, and exchanges of state rights of way and other real properties that are no longer needed for a state highway purpose. Real Estate Dispositions (continued) (3) Harris County - I-10, northeast corner at Barker Cypress Road in Houston - Consider the sale of right of way to the city of Houston (MO) The district has determined that the land is no longer needed for highway purposes. The city has requested to purchase the property, and it may be sold to the city. (4) Hidalgo County - US 281, northeast corner at Owassa Road in Edinburg - Consider the sale of right of way to the abutting landowner (MO) The district has determined that the land is no longer needed for highway purposes. The abutting landowner has requested to purchase the land, and it may be sold to the abutting owner. (5) Hays County - Consider the release of a deed restriction on Hays County Road 320 in the City of Dripping Springs (formerly part of US 290) (MO) The state previously relinquished its interest in a portion of right of way that was previously part of US 290 to the City of Dripping Springs. Based on statutory provisions, the transfer included a restriction that if said property ceased to be used for public road purposes, title to the property would immediately and automatically revert to the state. Section 202.021(e)(2) of the Texas Transportation Code, added in the 84th Legislative Session, provides a procedure whereby the restriction may be released. The City of Dripping Springs has requested the release of the reversionary interest as provided by Section 202.021(e)(2), and the Right of Way Division has concurred with the proposed action. (6) Lee County - US 77, east of Middle School Road in Giddings - Consider the sale of a former maintenance site and improvements (MO) The district has determined that the site is no longer needed for highway purposes. Giddings Independent School District has requested to purchase the property, and it may be sold to the school district. (7) Smith County - SH 64, west of Old Chandler Highway in Tyler - Consider the sale of right of way to the abutting landowner (MO) The district has determined that the land is no longer needed for highway purposes. The abutting landowner has requested to purchase the land, and it may be sold to the abutting owner. c. Finance (1) Obligation Limit Report Quarterly status report on the FY 2016 Obligation Limit, the actual obligations utilized through the current month, proposed remaining highway maintenance and construction contract letting for the fiscal year and an update on motor fuel tax receipts (Report) This report will provide the current overall obligation status, by district and metropolitan planning organization, of the FY 2016 Obligation Limit and will also provide the anticipated effect on the obligation limit of remaining proposed highway maintenance and construction letting. The report will also provide an update on motor fuel tax receipts, including estimated versus actual receipts fiscal year to date, and any potential impact on letting volume. (2) Quarterly report on FY 2016 State Highway Fund 6 cash status (Report) This report updates the commission on the year-to-date cash balance and activity of Fund 6. The report will include original projections and actual revenues/inflows and expenditures/outflows on a cash basis. c. Finance (continued) (3) Travis and Williamson Counties - Accept the audited financial statements of the Central Texas Turnpike System (CTTS), as required by the CTTS Indenture of Trust (MO) The Indenture of Trust that prescribes the terms for bonds and obligations issued to finance the 2002 Project of the CTTS, a toll project comprised of the SH 130, Segments1-4, SH 45N, and Loop 1 project elements, requires the preparation of a financial report of the results of operation of the system for each fiscal year. Audited financial statements meeting the requirements of the Indenture have been prepared for FY 2015. (4) Accept the audited financial statements of the Texas Mobility Fund (TMF) as required by the governing master resolution (MO) The Master Resolution governing the issuance of TMF bonds requires the preparation of an audited financial report of the TMF for each fiscal year. Audited financial statements have been prepared for FY 2015. d. Reports Compliance Office Compliance Office report State law requires the commission to establish a compliance program, which must include a compliance office to oversee the program. The compliance office is responsible for acting to prevent and detect serious breaches of department policy, fraud, waste, and abuse of office, including any acts of criminal conduct within the department. The compliance office is required to provide a monthly report to the commission regarding investigations and a summary of information relating to trends and recommendations. e. Highway Designations Hunt County - Designate State Highway Spur 1570 on a new location west of the city of Greenville (MO) This minute order designates State Highway Spur 1570 on a new location on the state highway system from SH 66 at FM 1570 northward to US 380, a distance of approximately 2.0 miles. f. Finance (1) Obligation Limit Report Quarterly status report on the FY 2016 Obligation Limit, the actual obligations utilized through the current month, proposed remaining highway maintenance and construction contract letting for the fiscal year and an update on motor fuel tax receipts (Report) This report will provide the current overall obligation status, by district and metropolitan planning organization, of the FY 2016 Obligation Limit and will also provide the anticipated effect on the obligation limit of remaining proposed highway maintenance and construction letting. The report will also provide an update on motor fuel tax receipts, including estimated versus actual receipts fiscal year to date, and any potential impact on letting volume. (2) Quarterly report on FY 2016 State Highway Fund 6 cash status (Report) This report updates the commission on the year-to-date cash balance and activity of Fund 6. The report will include original projections and actual revenues/inflows and expenditures/outflows on a cash basis. c. Finance (continued) (3) Travis and Williamson Counties - Accept the audited financial statements of the Central Texas Turnpike System (CTTS), as required by the CTTS Indenture of Trust (MO) The Indenture of Trust that prescribes the terms for bonds and obligations issued to finance the 2002 Project of the CTTS, a toll project comprised of the SH 130, Segments1-4, SH 45N, and Loop 1 project elements, requires the preparation of a financial report of the results of operation of the system for each fiscal year. Audited financial statements meeting the requirements of the Indenture have been prepared for FY 2015. (4) Accept the audited financial statements of the Texas Mobility Fund (TMF) as required by the governing master resolution (MO) The Master Resolution governing the issuance of TMF bonds requires the preparation of an audited financial report of the TMF for each fiscal year. Audited financial statements have been prepared for FY 2015. d. Reports Compliance Office Compliance Office report State law requires the commission to establish a compliance program, which must include a compliance office to oversee the program. The compliance office is responsible for acting to prevent and detect serious breaches of department policy, fraud, waste, and abuse of office, including any acts of criminal conduct within the department. The compliance office is required to provide a monthly report to the commission regarding investigations and a summary of information relating to trends and recommendations. e. Highway Designations Hunt County - Designate State Highway Spur 1570 on a new location west of the city of Greenville (MO) This minute order designates State Highway Spur 1570 on a new location on the state highway system from SH 66 at FM 1570 northward to US 380, a distance of approximately 2.0 miles. f.
