Texas Freight Mobility Plan (presentation) Staff will present an overview of the Texas Freight Mobility Plan outlining key freight transportation challenges as well as key policy, program, and project recommendations.
Aviation Various Counties - Award federal grant funding for airport improvement projects at various locations (MO) Federal law authorizes the award of federal funding to preserve and improve the state's general aviation system. The airports listed in Exhibit A are eligible for award of these grant funds and the department seeks approval of the awards.
Advisory Committee Appointments Appoint four new members to the Bicycle Advisory Committee (MO) The Bicycle Advisory Committee advises the commission on bicycle issues and matters of mutual concern between the department and the bicycling community. By involving representatives of the public, including bicyclists and other interested parties, the department helps ensure effective communication with the bicycle community, and that the bicyclist's perspective will be considered in the development of departmental policies affecting bicycle use, including the design, construction, and maintenance of highways.
Transportation Alternatives Program Various Counties - Approve federal funding for projects submitted in the department's 2015 Transportation Alternatives Program (TAP) Call for Projects (MO) Moving Ahead for Progress in the 21st Century Act (MAP-21) authorized the TAP to reserve funds equal to 2 percent of the total amount authorized from the Highway Account of the Highway Trust Fund for Federal-Aid highways each year. This minute order approves federal TAP funds for selected bicycle and pedestrian projects in small urban areas with a population of 5,001-200,000. The project awards will provide alternative modes of transportation, contribute to congestion relief improving air quality, and provide safer accommodations for all roadway users.
Promulgation of Administrative Rules Under Title 43, Texas Administrative Code, and the Administrative Procedure Act, Government Code, Chapter 2001: Proposed Adoption Chapter 4 - Employment Practices Amendments to §4.51, Definitions, §4.54, Contributions, §4.55, Contribution Returns, and §4.56, Withdrawals (Sick Leave Pool Program) (MO) These rules amend the department’s Sick Leave Pool Program to implement House Bill 1771, 84th Legislature, which authorizes a state employee to donate sick leave to another employee within the same agency, and revise terminology related to the program.
Chapter 28 - Oversize and Overweight Vehicles and Loads Amendments to §28.100, Purpose, §28.102, Authority’s Powers and Duties, §28.104, Permit Issuance Requirements and Procedures, and §28.106, Movement Requirements and Restrictions (Hidalgo County Regional Mobility Authority Permits) (MO) The amendments implement the new bonding requirements for the issuance of oversize/overweight permits by Hidalgo County Regional Mobility Authority, as enacted by the 84th Legislature, Regular Session, in H.B. 1969.
Compliance Office Compliance Office report State law requires the commission to establish a compliance program, which must include a compliance office to oversee the program. The compliance office is responsible for acting to prevent and detect serious breaches of department policy, fraud, waste, and abuse of office, including any acts of criminal conduct within the department. The compliance office is required to provide a monthly report to the commission regarding investigations and a summary of information relating to trends and recommendations.
Financial Assistance for Projects a. Tarrant County - Consider (1) rescinding part of Minute Order 112391 to cancel the authority to enter into a $14,400,000 pass-through agreement with the City of Colleyville for the construction of SH 26; and (2) removing $14,400,000 from the allocation of funds in the pass-through program call approved in Minute Order 112305 (MO) This minute order rescinds part of Minute Order 112391 to cancel the commission’s approval of a pass through agreement for the SH 26 project and removes from the pass-through program the $14,400,000 that was allocated to this project so that it may be used for other projects.
Financial Assistance for Projects (continued) b. Bexar County - Consider approving a request from the Alamo Regional Mobility Authority (ARMA) for: (1) cancellation of $1,143,752 of the $19,800,000 grant for development of the US 281 North Improvement Project that was authorized by Minute Order 111359 dated May 29, 2008; and (2) preliminary approval of a grant in the amount of $1,143,752 to be used for the development costs of the Loop 1604 Managed Lanes Project (MO) The commission has previously provided financial assistance for the US 281 North Improvement Project and for the Loop 1604 Managed Lanes Project. ARMA is nearing completion of the environmental study for each project and anticipates a surplus of grant funds from the US 281 North Improvement Project and a shortfall of $1,143,752 for the development costs of the Loop 1604 Managed Lanes Project. ARMA has requested that it be allowed to use $1,143,752 of surplus grant funds from the US 281 North Project for development costs on the Loop 1604 Managed Lanes Project.
Removal of Toll Designation Bexar County - Approve the removal of the toll project designation from the tolled mainlanes of the US 281 North Project from Loop 1604 to the Bexar/Comal County line, including the direct connections to and from Loop 1604, and rescind Minute Order 111257, which will rescind the transfer of the US 281 North Project, comprising the roadway and associated right of way from Loop 1604 to the Bexar/Comal County line, to the Alamo Regional Mobility Authority, and the removal of that roadway from the state highway system (MO) In Minute Order 110111, dated June 30, 2005, the commission designated the tolled main lanes on US 281 from Loop 1604 to Marshall Road, including the direct connections to and from Loop 1604, as a toll project on the state highway system, and in Minute Order 110301, dated November 17, 2005, the commission designated the tolled main lanes on US 281 from Evans Road to the Bexar/Comal County line as a toll project on the state highway system. After consultations between the department and the Alamo Regional Mobility Authority, and in accordance with the desires of the region evidenced in a resolution by the Alamo Area Metropolitan Planning Organization, it has been determined that the interests of the state are better served by not constructing the US 281 North Project as a toll project, as had been originally planned, but as a nontolled project. Moreover, the conditions in Minute Order 111257 to transfer of the US 281 North Project, including that the project was being transferred for the purpose of designing, financing, constructing, operating, and maintaining a turnpike project, have not been met.
Regional Mobility Authority Travis County - Central Texas Regional Mobility Authority - Approve the connection of the US 183 South - Bergstrom Expressway toll project to the State Highway System (MO) This minute order approves the Central Texas Regional Mobility Authority’s construction of a new tolled facility that will connect to the State Highway System. The US 183 South - Bergstrom Expressway is approximately 8 miles in length and includes three new tolled lanes and three new non-tolled general purpose lanes in each direction between US 290 and SH 71 with direct connectors at US 183 and SH 71, and improvements on SH 71 adjacent to US 183. The project also includes proposed sidewalks, bike lanes, and a shared-use path within the right of way.
Audit Plan Approve the Audit Plan for Fiscal Year 2016 and determine whether adequate resources have been dedicated to the internal audit program (MO) State law requires the internal auditor to create an annual audit plan that is prepared using risk assessment techniques and that identifies the individual audits to be conducted during the year. The audit plan must be approved by the commission. In addition, the commission must review the resources dedicated to the internal audit program and determine if adequate resources exist to ensure that risks identified in the annual risk assessment are covered in a reasonable timeframe
Audit Subcommittee Charter Approve changes to the Audit Subcommittee Charter (MO) The subcommittee was created to oversee and ensure compliance with the intent of Sarbanes-Oxley as to reliability and transparency in financial reporting, as well as to ensure the independence of the department’s internal audit program by providing oversight of the internal auditor and evaluating the implementation of audit recommendations. The subcommittee charter was approved by Minute Order 112196 on March 25, 2010, and was revised by Minute Order 112661 on April 28, 2011. TxDOT Spirit of Sarbanes-Oxley requirements were revised by Minute Order 113939, dated May 29, 2014. These revisions have been incorporated into this charter that also includes a title change of the internal auditor to Chief Audit and Compliance Officer (from Chief Audit Executive).
Contracts Award or reject contracts for maintenance, highway, and building construction These proposed minute orders contain information concerning the receipt of bids for highway improvement contracts. The department may reschedule receipt of bids for those projects where the commission rejects all bids. Those bids accepted by the commission will result in conditional contract awards to the low bidders. Contract award conditions may involve securing funding from other sources, the contractor's ability to satisfy federal DBE subcontracting requirements, or other requirements as outlined in the project bid proposal a. Eminent Domain Proceedings Various Counties - Authorize the filing of condemnation proceedings to acquire real property by eminent domain for non-controlled and controlled access highways (see attached itemized list) (MO) Commission findings, determinations, and authorizations for the state, by motion made in accordance with Senate Bill 18 (82nd Legislature), to acquire by eminent domain, upon the payment of adequate and just compensation, various ownership interests in specific parcels of real property that are needed to develop or improve both non-controlled and controlled access state highways, to include requesting the state attorney general to bring and pursue condemnation suits relating to those specific parcels of real property described in the attached itemized list.
Routine Minute Orders and Reports a. Donations to the Department Various Districts - Consider the acknowledgment of donations made to the department to include: (a) donations in any form, including realty, personalty, money, materials, or services, which are made to the department for the purpose of carrying out its functions and duties; and (b) donations from landowners, with land adjacent to a highway that is part of the state highway system, to construct an improvement on the highway right-of-way that is directly related to improving access to or from the owner’s land. (See attached itemized list) (MO) The donations will ensure the safety of the traveling public. b. Real Estate Dispositions The commission must approve the sales, transfers, and exchanges of state rights of way and other real properties that are no longer needed for a state highway purpose. It must also approve, accept and acknowledge donations to the state of real property that is valued at $500 or more. (1) Johnson County - SH 174 north of W. Hidden Creek Parkway in Burleson - Consider the transfer and sale of right of way to the city of Burleson (MO) The district has determined that the land is no longer needed for highway purposes. The city has requested that Part 1 be transferred to the city and has requested to purchase Part 2. The cost of future maintenance on Part 1 exceeds the value of the land. Part 1 may be transferred to the city and the commission may waive payment. Part 2 may be sold to the city. (2) Lubbock County - SL 289 at SH 114 in Lubbock - Consider the sale of two tracts of right of way to the abutting landowners (2 MOs) The district has determined that the tracts are no longer needed for highway purposes. The respective abutting landowners have requested to purchase the tracts, and they may be sold to the abutting owners. (3) Travis County - FM 973, northeast corner of SH 71 in Del Valle - Consider the sale of access rights to abutting landowners (MO) Owners of property abutting the north side of SH 71 have requested a break in the control-of-access line for a driveway location on their south property line. The district has determined that access may be allowed to and from the highway facility at the requested location, and the access rights may be sold to the abutting landowners. c. Transportation Planning Various Counties - Certify eligible counties for the 2016 Economically Disadvantaged Counties Program and establish local match adjustments for each county and certain cities (MO) This minute order certifies the counties to participate in the Economically Disadvantaged Counties Program for Fiscal Year 2016 and sets forth the local match adjustment for each county and certain cities participating in the program. State law requires the commission to annually certify economically disadvantaged counties as soon as possible after the comptroller reports on the relevant economic indicators d. Highway Designations (1) Grimes and Montgomery Counties - Extend the designation of SH 249 from FM 1774 at FM 149 northwestward to SH 105 (MO) This minute order extends the designation of SH 249 from FM 1774 at FM 149 near the community of Pinehurst northwestward to SH 105 near the community of Stoneham, a distance of approximately 24.4 miles. (2) Hidalgo County - In and near the cities of La Joya and Penitas, designate US 83 along a new location, redesignate a portion of existing US 83 as Business US Highway 83-S and redesignate the remaining portion of existing US 83 as US Highway Spur 83 (MO) This minute order designates US 83 on the state highway system along a new location from 1.7 miles east of FM 886 (El Faro Road) to 0.8 miles west of Showers Road, a distance of approximately 7.9 miles; redesignates existing US 83 as Business US Highway 83-S from 1.7 miles east of FM 886 (El Faro Road) to the intersection of existing Business US Highway 83-S, a distance of approximately 6.3 miles; and redesignates the remaining portion of US 83 as US Highway Spur 83 from the intersection of existing Business US Highway 83-S eastward to existing US 83, a distance of approximately 0.4 miles. e. Designation of Access Control Dallas County - I-20, west of JJ Lemmon Road - Consider the designation of one location on the frontage road at which access will be permitted to the abutting property (MO) The designation of one 36-foot break in the control-of-access line will allow the abutting landowner to open one proposed driveway location for access to and from the westbound frontage road. The district has determined that access may be permitted at the designated location. f. Consultation and Review - Department of Motor Vehicles, Chapter 219 Consultation on Department of Motor Vehicles rules regarding overweight/oversize vehicles (MO) Transportation Code, Sections 623.145 and 623.195 require that the Department of Motor Vehicles Board consult with the commission on the adoption of certain rules regarding overweight/oversize vehicle permits issued by DMV. Staff has reviewed the Chapter 219 rule changes proposed by the DMV Board. This Minute Order confirms the commission’s consultation and review of the DMV proposed rules. g. Speed Zones Various Counties - Establish or alter regulatory and construction speed zones on various sections of highways in the state (MO) This minute order establishes or alters regulatory and construction speed zones on various sections of highways in the state.

(2) Hidalgo County - In and near the cities of La Joya and Penitas, designate US 83 along a new location, redesignate a portion of existing US 83 as Business US Highway 83-S and redesignate the remaining portion of existing US 83 as US Highway Spur 83 (MO) This minute order designates US 83 on the state highway system along a new location from 1.7 miles east of FM 886 (El Faro Road) to 0.8 miles west of Showers Road, a distance of approximately 7.9 miles; redesignates existing US 83 as Business US Highway 83-S from 1.7 miles east of FM 886 (El Faro Road) to the intersection of existing Business US Highway 83-S, a distance of approximately 6.3 miles; and redesignates the remaining portion of US 83 as US Highway Spur 83 from the intersection of existing Business US Highway 83-S eastward to existing US 83, a distance of approximately 0.4 miles. e. Designation of Access Control Dallas County - I-20, west of JJ Lemmon Road - Consider the designation of one location on the frontage road at which access will be permitted to the abutting property (MO) The designation of one 36-foot break in the control-of-access line will allow the abutting landowner to open one proposed driveway location for access to and from the westbound frontage road. The district has determined that access may be permitted at the designated location. f. Consultation and Review - Department of Motor Vehicles, Chapter 219 Consultation on Department of Motor Vehicles rules regarding overweight/oversize vehicles (MO) Transportation Code, Sections 623.145 and 623.195 require that the Department of Motor Vehicles Board consult with the commission on the adoption of certain rules regarding overweight/oversize vehicle permits issued by DMV. Staff has reviewed the Chapter 219 rule changes proposed by the DMV Board. This Minute Order confirms the commission’s consultation and review of the DMV proposed rules. g.
