Hidalgo County - Award federal and state grant funding for airport improvement projects at one location (MO) State law authorizes the award of state funding for capital improvement projects. The airport listed in Exhibit A is eligible for award of these grant funds and the department seeks approval of the award.
Bexar County - Award Transportation Development Credits to VIA Metropolitan Transit (MO) This minute order awards transportation development credits to assist with the match of federal funds for public transit capital projects in the San Antonio area.

Appoint members to the Bicycle Advisory Committee (MO) The Bicycle Advisory Committee advises the commission on bicycle issues and matters of mutual concern between the department and the bicycling community. By involving representatives of the public, including bicyclists and other interested parties, the department helps ensure effective communication with the bicycle community, and that the bicyclist's perspective will be considered in the development of departmental policies affecting bicycle use, including the design, construction, and maintenance of highways.

Promulgation of Administrative Rules Under Title 43, Texas Administrative Code, and the Administrative Procedure Act, Government Code, Chapter 2001: Chapter 23 - Travel Information (MO) Repeal of §§23.1 - 23.2, General Provisions, §23.10 and §§23.12 - 23.14, Travel Information, §§23.28 - 23.29, Texas Highways Magazine, §§23.51 - 23.59, Promotional Product Program, and §§23.101 - 23.105, Merchandising Program; and simultaneously proposing new §§23.1 - 23.2, General Provisions, §§23.11 - 23.20, Travel Information, §§23.41 - 23.50, Travel mInformation Centers, §§23.61 - 23.73, Promotional Product Program, and §§23.81 - 23.85, Subscriber and Purchaser Information These new rules concern changes to policies and procedures of the Travel Information Division. Chapter 25 - Traffic Operations (MO) New §25.28, Reducing Speeds on Roadways with a Greater Than Average Crash Rate (Procedures for Establishing Speed Zones) These rules create a streamlined speed zone process to allow the commission to more quickly address safety concerns by altering speed limits on a section of roadway that has a crash rate greater than the statewide crash rate for similar roadways. The emergency rules dealing with similar issues that took effect October 30, 2014 will expire before these permanent rules are adopted.

Office of Compliance, Ethics, and Investigations Report State law requires the commission to establish a compliance program, which must include a compliance office to oversee the program. The compliance office is responsible for acting to prevent and detect serious breaches of department policy, fraud, waste, and abuse of office, including any acts of criminal conduct within the department. The compliance office is required to provide a monthly report to the commission regarding investigations and a summary of information relating to trends and recommendations
Harris County - Authorize the executive director of the department to amend the agreement with Harris County for the further development and operation of the Katy Managed Lanes Project, a managed lanes facility within the limits of I-10 from SH 6 to I-610, to extend the date for transferring the Katy Managed Lanes Project to the department until December 2015 (MO) In August 2014, the executive director of the department entered into an agreement with Harris County for development of the US 290 Project, a proposed managed lane facility on US 290 from I-610 to SH 99, further development and operation of the Katy Managed Lanes Project, a managed lanes facility within the limits of I-10 from SH 6 to I-610, and potential development of the Hempstead Tollway Project. The agreement contemplates the transfer of ownership and all responsibility for the Katy Managed Lanes to the department by December 31, 2014. The transfer will include all responsibility for operation, maintenance, and enforcement of the Katy Managed Lanes and associated diamond lanes. The amendment will defer that transfer for one year
Various Counties - Approval to exceed contract term restrictions for the procurement of indefinite deliverable contracts for engineering services associated with traffic and revenue for transportation projects throughout the state (MO) The expeditious delivery of projects developed through the use of comprehensive development agreements, design-build agreements, and other innovatively financed methods will require the assistance and support of consulting engineering contracts. This minute order authorizes indefinite deliverable consultant contracts to be procured that will support the delivery and implementation of these projects. Three professional services contracts lasting up to five years are required to complete the work.
Authorize the department to enter into negotiations for a Lease Agreement with the Yucca Council of Boy Scouts of America (Local El Paso Area) and to enter into a Lease Agreement to lease land on the Loop 375 Border West Expressway (MO) This minute order authorizes the department to enter into negotiations for and execute a lease to the Yucca Council of Boy Scouts of America in the El Paso area for their use. The minute order waives the fair market value requirement for social mitigation purposes should the department proceed with entering into a lease for this property.
Travis County - Bull Creek Road in Austin - Consider the sale of real property by sealed bid (MO) The district has determined that the land is no longer needed for highway purposes. Governmental entities declined to purchase the land. It was advertised for sale by sealed bid, and it may be sold to the highest bidder.

Various Counties - Authorize the filing of condemnation proceedings to acquire real property by eminent domain for non-controlled and controlled access highways (seem attached list) (MO) Commission findings, determinations, and authorizations for the state, by motion made in accordance with Senate Bill 18 (82nd Legislature), to acquire by eminent domain, upon the payment of adequate and just compensation, various ownership interests in specific parcels of real property that are needed to develop or improve both non-controlled and controlled access state highways, to include requesting the state attorney general to bring and pursue condemnation suits relating to those specific parcels of real property described in the attached itemized list

Routine Minute Orders and Reports a. Donations to the Department Various Districts - Consider the acknowledgment of donations made to the department to include: (a) donations in any form, including realty, personalty, money, materials, or services, which are made to the department for the purpose of carrying out its functions and duties; and (b) donations from landowners, with land adjacent to a highway that is part of the state highway system, to construct an improvement on the highway right-of-way that is directly related to improving access to or from the owner’s land. The donations will ensure the safety of the traveling public. b. Real Estate Dispositions and Donations The commission must approve the sales, transfers, and exchanges of state rights of way and other real properties that are no longer needed for a state highway purpose. It must also approve, accept and acknowledge donations to the state of real property that is valued at $500 or more. (1) Bexar County - FM 2696 from Comal County line to San Antonio city limits - Consider removal from the system, transfer of control, jurisdiction, and maintenance to the county and quitclaim of the state’s accrued interest in real property to the county (MO) The right of way was acquired by the county in its own name for a county road and was incorporated into the state highway system. The district has determined that this segment is no longer needed as part of the highway system. The county has agreed to assume jurisdiction, control, and maintenance. The interest in the real property that the state accrued by use of the land may be quitclaimed to the county. (2) Bexar County - Various highways in San Antonio - Consider removal from the system, transfer of control, jurisdiction, and maintenance to the city, and transfer of real property to the city (9 MOs) The district and city have determined that these segments of highways function more as city streets than as highways. The district and city have agreed that the highways should be removed from the system and that control, jurisdiction, and maintenance should be transferred to the city. The real property may be quitclaimed to the city to remain in use for public road purposes. (3) Dallas County - SP 366 at Pearl Street in Dallas - Consider the quitclaim of right of way to honor a reversionary clause (MO) The district has determined that the land is no longer needed for highway purposes due to the redesign of a ramp. The judgment by which the land was acquired provides that if the land is no longer needed for state highway purposes, it reverts to the city. (4) Denton County - SH 114 at Cleveland Gibbs Road in Northlake - Consider the sale of right of way to the abutting landowner (MO) The district has determined that the land is no longer needed for highway purposes. The abutting landowner has requested to purchase the land, and it may be sold to the requester. (5) Stephens County - FM 717, old alignment east of Breckenridge, five miles north of US 180 - Consider the sale and quitclaim of right of way to the abutting landowner (MO) c. Reports of Environmental Review of Projects Accept the semiannual report on projects being processed under the department’s environmental review process (Report) This report is being submitted under Transportation Code, §201.762(a), which requires the department to submit to the commission twice a year a report that identifies projects being processed under the department’s environmental review process. d. Transportation Planning (1) San Angelo Metropolitan Planning Organization Tom Green County - Approve revisions to the San Angelo Metropolitan Planning Organization (MPO) metropolitan planning area boundary (MO) Federal law requires that a metropolitan planning area boundary cover the existing urbanized area and the contiguous geographic area expected to become urbanized within a 20-year forecast period covered by the MPO’s metropolitan transportation plan. The boundary may be expanded to encompass the entire metropolitan statistical area. Revisions to metropolitan planning area boundaries must be approved by the governor who has delegated the authority to approve such changes to the Texas Transportation Commission. The San Angelo MPO Policy Board has agreed to include the additional areas identified as urbanized by the U.S. Census Bureau into the San Angelo metropolitan planning area. The district and city have agreed that the highways should be removed from the system and that control, jurisdiction, and maintenance should be transferred to the city. The real property may be quitclaimed to the city to remain in use for public road purposes. (3) Dallas County - SP 366 at Pearl Street in Dallas - Consider the quitclaim of right of way to honor a reversionary clause (MO) The district has determined that the land is no longer needed for highway purposes due to the redesign of a ramp. The judgment by which the land was acquired provides that if the land is no longer needed for state highway purposes, it reverts to the city. (4) Denton County - SH 114 at Cleveland Gibbs Road in Northlake - Consider the sale of right of way to the abutting landowner (MO) The district has determined that the land is no longer needed for highway purposes. The abutting landowner has requested to purchase the land, and it may be sold to the requester. (5) Stephens County - FM 717, old alignment east of Breckenridge, five miles north of US 180 - Consider the sale and quitclaim of right of way to the abutting landowner (MO) c. Reports of Environmental Review of Projects Accept the semiannual report on projects being processed under the department’s environmental review process (Report) This report is being submitted under Transportation Code, §201.762(a), which requires the department to submit to the commission twice a year a report that identifies projects being processed under the department’s environmental review process. d. Transportation Planning (1) San Angelo Metropolitan Planning Organization Tom Green County - Approve revisions to the San Angelo Metropolitan Planning Organization (MPO) metropolitan planning area boundary (MO) Federal law requires that a metropolitan planning area boundary cover the existing urbanized area and the contiguous geographic area expected to become urbanized within a 20-year forecast period covered by the MPO’s metropolitan transportation plan. The boundary may be expanded to encompass the entire metropolitan statistical area. Revisions to metropolitan planning area boundaries must be approved by the governor who has delegated the authority to approve such changes to the Texas Transportation Commission. The San Angelo MPO Policy Board has agreed to include the additional areas identified as urbanized by the U.S. Census Bureau into the San Angelo metropolitan planning area.
