Presentation from Keep Texas Beautiful on their accomplishments in supporting the department’s litter prevention programs and presentation of the Keep America Beautiful/US State Department of Transportation Partnership Award to the Texas Department of Transportation. (Presentation) Keep Texas Beautiful (KTB) is a non-profit organization that educates and engages Texans to take responsibility for improving their community environment. The department has a contract with KTB to provide litter prevention support programs and services to assist TxDOT in maintaining and meeting the objectives of the statewide litter reduction/prevention program. Aviation Various Counties - Award federal and state grant funding for airport improvement projects at various locations (MO) Federal law authorizes the award of federal funding to preserve and improve the state's general aviation system. State law authorizes the award of state funding for capital improvement projects. The airports listed in Exhibit A are eligible for award of these grant funds and the department seeks approval of the awards.

Various Counties - Award federal and state funds to designated lead agencies and fiscal agents to support continuation of coordinated regional public transportation planning for FY 2015 (MO) The awards identified in this minute order are financed with federal grant funds from the Federal Transit Administration and state matching funds. Various Counties - Award federal Rural Transportation Assistance Program funds to the Capital Area Rural Transportation System (MO) This minute order awards funds to the Capital Area Rural Transportation System to provide training and tools to update their training program for bus operators, mechanics, front line supervisors, and staff. c. Various Counties - Rescind Minute Order 113932 dated May 29, 2014, awarding transportation development credits to various agencies (MO) Under Minute Order 113932 the commission awarded transportation development credits to various transit providers. Due to changes to the projects approved in the May minute order, it is necessary to rescind the previous awards. d. Various Counties - Award transportation development credits to transit agencies for public transportation projects (MO) This minute order awards transportation development credits to numerous transit agencies to assist with the match of federal funds for capital assistance projects. e. Various Counties - Award federal Job Access Reverse Commute Funds and transportation development credits to Central Texas Rural Transit District (MO) The funds and transportation development credits awarded in this minute order will provide public transportation to individuals participating in workforce training at Tarleton State University. f. Various Counties - Award federal and state funds, and transportation development credits to Rural Economic Assistance League (MO) The awards identified in this minute order reflect the award of the balance of federal and state funds and transportation development credits originally awarded to Jim Wells County under several prior actions of the commission. Item 7 - Promulgation of Administrative Rules
Promulgation of Administrative Rules Under Title 43, Texas Administrative Code, and the Administrative Procedure Act, Government Code, Chapter 2001: a. Proposed Adoption (1) Chapter 26 - Regional Mobility Authorities (MO) Amendments to §26.2, Definitions (General Provisions), and new §26.36, Projects of Another Governmental Entity (Approval of a Transportation Project). Senate Bill 1489, 83rd Legislature, Regular Session, 2013, expanded the definition of a transportation project a regional mobility authority (RMA) is authorized to acquire, plan, design, construct, maintain, repair, or operate, and authorized an RMA to enter into an agreement under which the RMA may acquire, plan, design, construct, maintain, repair, or operate a transportation project on behalf of another governmental entity in this state. Except as for a transportation project described in Transportation Code, §370.033(f)(1) and (2), the department must approve an RMA’s acquisition, planning, design, construction, maintenance, repair, or operation of a transportation project on behalf of another governmental entity. The proposed rules implement the changes in the definition of transportation project, and prescribe the procedures by which the commission will consider approval of a transportation project.
Item 8 - Legislative Appropriations Request
Legislative Appropriations Request Receive the Texas Department of Transportation's Proposed Fiscal Year 2016-2017 Legislative Appropriations Request (LAR) (Presentation) Every two years the department is required to submit a Legislative Appropriations Request (LAR) for the upcoming biennium to be considered by the Texas Legislature. The proposed LAR describes the level of funding, method of finance, and FTEs associated with the department's strategies for the fiscal year 2016-2017 biennium. State law requires the department to deliver the LAR to the commission in an open meeting not later than the 30th day before the date the department submits the LAR to the Legislative Budget Board and the Governor’s Office of Budget and Planning.
Item 9 - Office of Compliance, Ethics, and Investigations
Office of Compliance, Ethics, and Investigations Office of Compliance, Ethics, and Investigations Report State law requires the commission to establish a compliance program, which must include a compliance office to oversee the program. The compliance office is responsible for acting to prevent and detect serious breaches of department policy, fraud, waste, and abuse of office, including any acts of criminal conduct within the department. The compliance office is required to provide a monthly report to the commission regarding investigations and a summary of information relating to trends and recommendations.
Toll Equity Smith County - North East Texas Regional Mobility Authority - Consider final approval of a request from North East Texas Regional Mobility Authority (NET RMA) to convert a toll equity loan in the outstanding principal amount of approximately $55,000,000 to a grant for project costs primarily relating to Segment 3B of Loop 49, locally known as Toll 49 (LP 49) and evidenced by a Financial Assistance Agreement dated as of March 1, 2011 (MO) The NET RMA is requesting that the commission authorize the conversion of the accreted principal value of the approximately $55,000,000 toll equity loan to a grant. The loan proceeds were used by NET RMA primarily for the development and construction of Segment 3B of LP 49, from SH 31 north to I-20. The 10-mile toll facility for which financial assistance is being provided includes two lanes of an ultimate four-lane toll road, with connections to the existing LP 49 facility at SH 31, and ramp connections to I-20.
Item 11 - State Infrastructure Bank
State Infrastructure Bank Delta County - West Delta Water Supply Corporation - Consider granting final approval of an application from the West Delta Water Supply Corporation (WSC) to borrow up to $1,237,000 from the State Infrastructure Bank (SIB) to pay for the relocation of water lines necessary for the Texas Department of Transportation’s widening of SH 24 from FM 904 to FM 64 (MO) The West Delta WSC is requesting a SIB loan to pay for West Delta WSC’s costs of relocation of water lines from the widening of SH 24. The SIB loan will be secured by a pledge of the Texas Department of Transportation’s reimbursements under a utility agreement, existing construction capital reserves, and revenues of the water system.
Texas Mobility Fund El Paso County - Camino Real Regional Mobility Authority - Approve a request from Camino Real Regional Mobility Authority (CRRMA) for a reduction in the amount of the grant being funded from the proceeds of Texas Mobility Fund general obligation bonds issued under Transportation Code, Chapter 201, Subchapter M, to pay for capital costs relating to the delivery of the Loop 375 Border Highway West Extension project from Racetrack Drive near Doniphan Road and New Mexico 273 (west of downtown) to U.S. 54 (east of downtown) in the city of El Paso (project); authorize the executive director or his designee to enter into agreements and execute documents as necessary to carry out the purposes of this minute order (MO) This minute order will reduce the amount of funds for an award to the CRRMA for costs of design and construction work and other capital costs related to the delivery of the Border Highway West Extension project as a consequence of a reduction in the project’s estimated capital costs.
Toll Roads a. Travis and Williamson Counties - Issue an order prohibiting the operation of certain motor vehicles on TxDOT toll projects (MO) SB 1792, enacted by the 83rd Texas Legislature, created new enforcement remedies targeted at certain motorists with unpaid toll violations. Transportation Code, Section 372.110, authorizes the commission to issue an order prohibiting the operation of a motor vehicle on a TxDOT toll project if the registered owner of the vehicle has been finally determined to be a habitual violator, subject to certain notice requirements. A person commits an offense if the person operates a motor vehicle on a toll project in violation of the order. Subsequent offenses may result in impoundment of the vehicle. b. Various Counties - Designate the SH 360 Project, providing for the construction of toll lanes and other improvements from approximately 2 miles south of I-20 near East Sublett Road/Camp Wisdom Road to US 287 in Ellis, Tarrant, and Johnson Counties, as a toll project on the state highway system; authorize the department to issue a request for proposals for the development, design, construction, and maintenance of the SH 360 Project; and approve a stipulated amount as payment for the work product of unsuccessful proposers (MO) The department received a finding of no significant impact on January 16, 2014. This minute order designates the SH 360 Project from approximately 2 miles south of I-20 near East Sublett Road/Camp Wisdom to US 287 as a toll project on the state highway system. On February 27, 2014, in Minute Order 113861, the commission authorized the department to issue a request for qualifications for the development, design, construction, and maintenance of the project. This minute order continues the procurement process by authorizing the issuance of a request for proposals for the project, and approves a stipulated amount for the payment of work product of responsive, unsuccessful proposers.
Contracts Award or reject contracts for maintenance, highway and building construction These proposed minute orders contain information concerning the receipt of bids for highway improvement contracts. The department may reschedule receipt of bids for those projects where the commission rejects all bids. Those bids accepted by the commission will result in conditional contract awards to the low bidders. Contract award conditions may involve securing funding from other sources, the contractor's ability to satisfy federal DBE subcontracting requirements, or other requirements as outlined in the project bid proposal. Item 15 - Eminent Domain Proceedings
Eminent Domain Proceedings Various Counties - Authorize the filing of condemnation proceedings to acquire real property by eminent domain for non-controlled and controlled access highways (see attached list) (MO) Commission findings, determinations, and authorizations for the state, by motion made in accordance with Senate Bill 18 (82nd Legislature), to acquire by eminent domain, upon the payment of adequate and just compensation, various ownership interests in specific parcels of real property that are needed to develop or improve both non-controlled and controlled access state highways, to include requesting the state attorney general to bring and pursue condemnation suits relating to those specific parcels of real property described in the attached itemized list.
Item 16 - Routine Minute Orders and Reports
Routine Minute Orders and Reports a. Donations to the Department Various Districts - Consider the acknowledgment of donations made to the department to include: (a) donations in any form, including realty, personalty, money, materials, or services, which are made to the department for the purpose of carrying out its functions and duties; and (b) donations from landowners, with land adjacent to a highway that is part of the state highway system, to construct an improvement on the highway right-of-way that is directly related to improving access to or from the owner's land (See attached itemized list) (MO) The donations will ensure the safety of the traveling public. b. Right of Way Dispositions and Donations The commission must approve the sales, transfers, and exchanges of state rights of way and other real properties that are no longer needed for a state highway purpose. It must also approve, accept and acknowledge donations to the state of real property that is valued at $500 or more. (1) Anderson County - SL 256 at Old Elkhart Road in Palestine - Consider the sale of right of way to the city of Palestine (MO) The district has determined that the land is no longer needed for a highway purpose. The city has requested to purchase the land, and it may be sold to the city. (2) Harris County - SH 99 at SH 249 in Houston - Consider an exchange of right of way (MO) The property owner of land needed for a highway project is willing to exchange the land for existing right of way no longer needed for highway purposes. The district has recommended the exchange. (3) Randall County - US 60 in Canyon - Consider the sale of the addition to the Canyon maintenance site to the city of Canyon (MO) The district has determined that the land is no longer needed for highway purposes. The city has requested to purchase the land. Other local governmental entities have declined interest in purchasing the land, and it may be sold to the city. (4) Reagan County - US 67 at Louisiana Street in Big Lake - Consider the exchange of drainage easements (MO) The owner of the property desires to relocate the drainage facility to better accommodate proposed development of the property. The district has determined that the drainage facility may be relocated, and the owner has granted a new drainage easement in exchange for the existing drainage easement. (5) Terry County - US 62, south of E. Magnolia Street in Brownfield - Consider the sale of right of way to the abutting landowner (MO) The district has determined that the land is no longer needed for highway purposes. The abutting landowner has requested to purchase the land, and it may be sold to the abutting landowner. (6) Terry County - US 385 at David Bailey Road in Brownfield - Consider the sale of right of way to an abutting landowner (MO) The district has determined that the land is no longer needed for highway purposes. An abutting landowner has requested to purchase the land, and it may be sold to the abutting landowner. Another abutting landowner has no interest in acquiring any portion of the land. c. Finance (1) Obligation Limit Report Quarterly status report on the FY 2014 Obligation Limit, the actual obligations utilized through the current month, proposed remaining highway maintenance and construction contract letting for the fiscal year and an update on motor fuel tax receipts (Report) This report will provide the current overall obligation status, by district and metropolitan planning organization, of the FY 2014 Obligation Limit and will also provide the anticipated effect on the obligation limit of remaining proposed highway maintenance and construction letting. The report will also provide an update on motor fuel tax receipts, including estimated versus actual receipts fiscal year to date, and any potential impact on letting volume. (2) Quarterly report on FY 2014 State Highway Fund 6 cash status (Report) This report updates the commission on the year-to-date cash balance and activity of Fund 6. The report will include original projections and actual revenues/inflows and expenditures/outflows on a cash basis. (3) Accept the Quarterly Investment Report (MO) This minute order accepts the quarterly investment report for investments of funds relating to financing of the Central Texas Turnpike System and held by the Bank of New York Mellon, acting as trustee. d. Reports (1) Travis and Williamson Counties - Accept the Report of Actual Traffic and Revenue for the Central Texas Turnpike System (CTTS) (Report) Report of actual traffic and revenue for the CTTS as of May 31, 2014. (2) Environmental Hearings Report Accept public hearing reports for the US 181 Harbor Bridge Project; US 281 Loop 1604 to Borgfeld Drive; and US 69 / Loop 49 Lindale Reliever Route (Reports) Per Transportation Code §201.811(b) and 43 TAC §2.107(e)(2), this report lists the number of positive, negative, and neutral public comments received at a public hearing held for an Environmental Impact Statement (EIS). The projects include: US 181 Harbor Bridge Project (CSJ: 0101-06-095), US 281 (CSJs: 0253-04-138, 0253-04-146) and US 69/ Loop 49 Lindale Reliever Route (CSJ: 0190-04-033). e. Highway Designation Webb County - Designate State Loop 20 (SL 20) on the state highway system concurrent with US 59 from the entrance to the World Trade Bridge to the junction of SL 20 and US 59 in the city of Laredo (MO) Minute Order 113852 redesignated a portion of SL 20 as US 59 from the entrance of the World Trade Bridge to the junction of SL 20 and US 59 in Laredo, which began the process of designating applicable portions of US 59 as part of the I-69 system. However, the minute order did not reference maintaining the LP 20 signage so that addresses would not need to be changed. This minute order corrects that oversight and designates a portion of SL 20 on the state highway system, concurrent with US 59. f. Designation of Access Control Dallas County - I-20, between South Lancaster Road and Bonnie View Road - Consider the designation of two locations on the frontage road at which access will be permitted to the abutting property (MO) The designation of two 42.68-foot breaks in the control-of-access line will allow the abutting landowner to open two proposed driveway locations for access to and from the eastbound frontage road. The district has determined that access may be permitted at the designated locations. g. Speed Zones Various Counties - Establish or alter regulatory and construction speed zones on various sections of highways in the state (MO) This minute order establishes or alters regulatory and construction speed zones on various sections of highways in the state.

Transportation Code, Section 372.110, authorizes the commission to issue an order prohibiting the operation of a motor vehicle on a TxDOT toll project if the registered owner of the vehicle has been finally determined to be a habitual violator, subject to certain notice requirements. A person commits an offense if the person operates a motor vehicle on a toll project in violation of the order. Subsequent offenses may result in impoundment of the vehicle. b. Various Counties - Designate the SH 360 Project, providing for the construction of toll lanes and other improvements from approximately 2 miles south of I-20 near East Sublett Road/Camp Wisdom Road to US 287 in Ellis, Tarrant, and Johnson Counties, as a toll project on the state highway system; authorize the department to issue a request for proposals for the development, design, construction, and maintenance of the SH 360 Project; and approve a stipulated amount as payment for the work product of unsuccessful proposers (MO) The department received a finding of no significant impact on January 16, 2014. This minute order designates the SH 360 Project from approximately 2 miles south of I-20 near East Sublett Road/Camp Wisdom to US 287 as a toll project on the state highway system. On February 27, 2014, in Minute Order 113861, the commission authorized the department to issue a request for qualifications for the development, design, construction, and maintenance of the project. This minute order continues the procurement process by authorizing the issuance of a request for proposals for the project, and approves a stipulated amount for the payment of work product of responsive, unsuccessful proposers.
Contracts Award or reject contracts for maintenance, highway and building construction These proposed minute orders contain information concerning the receipt of bids for highway improvement contracts. The department may reschedule receipt of bids for those projects where the commission rejects all bids. Those bids accepted by the commission will result in conditional contract awards to the low bidders. Contract award conditions may involve securing funding from other sources, the contractor's ability to satisfy federal DBE subcontracting requirements, or other requirements as outlined in the project bid proposal. Eminent Domain Proceedings Various Counties - Authorize the filing of condemnation proceedings to acquire real property by eminent domain for non-controlled and controlled access highways (see attached list) (MO) Commission findings, determinations, and authorizations for the state, by motion made in accordance with Senate Bill 18 (82nd Legislature), to acquire by eminent domain, upon the payment of adequate and just compensation, various ownership interests in specific parcels of real property that are needed to develop or improve both non-controlled and controlled access state highways, to include requesting the state attorney general to bring and pursue condemnation suits relating to those specific parcels of real property described in the attached itemized list.

Routine Minute Orders and Reports a. Donations to the Department Various Districts - Consider the acknowledgment of donations made to the department to include: (a) donations in any form, including realty, personalty, money, materials, or services, which are made to the department for the purpose of carrying out its functions and duties; and (b) donations from landowners, with land adjacent to a highway that is part of the state highway system, to construct an improvement on the highway right-of-way that is directly related to improving access to or from the owner's land (See attached itemized list) (MO) The donations will ensure the safety of the traveling public. b. Right of Way Dispositions and Donations The commission must approve the sales, transfers, and exchanges of state rights of way and other real properties that are no longer needed for a state highway purpose. It must also approve, accept and acknowledge donations to the state of real property that is valued at $500 or more. (1) Anderson County - SL 256 at Old Elkhart Road in Palestine - Consider the sale of right of way to the city of Palestine (MO) The district has determined that the land is no longer needed for a highway purpose. The city has requested to purchase the land, and it may be sold to the city. (2) Harris County - SH 99 at SH 249 in Houston - Consider an exchange of right of way (MO) The property owner of land needed for a highway project is willing to exchange the land for existing right of way no longer needed for highway purposes. The district has recommended the exchange. (3) Randall County - US 60 in Canyon - Consider the sale of the addition to the Canyon maintenance site to the city of Canyon (MO) The district has determined that the land is no longer needed for highway purposes. The city has requested to purchase the land. Other local governmental entities have declined interest in purchasing the land, and it may be sold to the city. (4) Reagan County - US 67 at Louisiana Street in Big Lake - Consider the exchange of drainage easements (MO) The owner of the property desires to relocate the drainage facility to better accommodate proposed development of the property. The district has determined that the drainage facility may be relocated, and the owner has granted a new drainage easement in exchange for the existing drainage easement. (5) Terry County - US 62, south of E. Magnolia Street in Brownfield - Consider the sale of right of way to the abutting landowner (MO) The district has determined that the land is no longer needed for highway purposes. The abutting landowner has requested to purchase the land, and it may be sold to the abutting landowner. (6) Terry County - US 385 at David Bailey Road in Brownfield - Consider the sale of right of way to an abutting landowner (MO) The district has determined that the land is no longer needed for highway purposes. An abutting landowner has requested to purchase the land, and it may be sold to the abutting landowner. Another abutting landowner has no interest in acquiring any portion of the land. c. Finance (1) Obligation Limit Report Quarterly status report on the FY 2014 Obligation Limit, the actual obligations utilized through the current month, proposed remaining highway maintenance and construction contract letting for the fiscal year and an update on motor fuel tax receipts (Report) This report will provide the current overall obligation status, by district and metropolitan planning organization, of the FY 2014 Obligation Limit and will also provide the anticipated effect on the obligation limit of remaining proposed highway maintenance and construction letting. The report will also provide an update on motor fuel tax receipts, including estimated versus actual receipts fiscal year to date, and any potential impact on letting volume. (2) Quarterly report on FY 2014 State Highway Fund 6 cash status (Report) This report updates the commission on the year-to-date cash balance and activity of Fund 6. The report will include original projections and actual revenues/inflows and expenditures/outflows on a cash basis. (3) Accept the Quarterly Investment Report (MO) This minute order accepts the quarterly investment report for investments of funds relating to financing of the Central Texas Turnpike System and held by the Bank of New York Mellon, acting as trustee. d. Reports (1) Travis and Williamson Counties - Accept the Report of Actual Traffic and Revenue for the Central Texas Turnpike System (CTTS) (Report) Report of actual traffic and revenue for the CTTS as of May 31, 2014. (2) Environmental Hearings Report Accept public hearing reports for the US 181 Harbor Bridge Project; US 281 Loop 1604 to Borgfeld Drive; and US 69 / Loop 49 Lindale Reliever Route (Reports) Per Transportation Code §201.811(b) and 43 TAC §2.107(e)(2), this report lists the number of positive, negative, and neutral public comments received at a public hearing held for an Environmental Impact Statement (EIS). The projects include: US 181 Harbor Bridge Project (CSJ: 0101-06-095), US 281 (CSJs: 0253-04-138, 0253-04-146) and US 69/ Loop 49 Lindale Reliever Route (CSJ: 0190-04-033). e. Highway Designation Webb County - Designate State Loop 20 (SL 20) on the state highway system concurrent with US 59 from the entrance to the World Trade Bridge to the junction of SL 20 and US 59 in the city of Laredo (MO) Minute Order 113852 redesignated a portion of SL 20 as US 59 from the entrance of the World Trade Bridge to the junction of SL 20 and US 59 in Laredo, which began the process of designating applicable portions of US 59 as part of the I-69 system. However, the minute order did not reference maintaining the LP 20 signage so that addresses would not need to be changed. This minute order corrects that oversight and designates a portion of SL 20 on the state highway system, concurrent with US 59. f. Designation of Access Control Dallas County - I-20, between South Lancaster Road and Bonnie View Road - Consider the designation of two locations on the frontage road at which access will be permitted to the abutting property (MO) The designation of two 42.68-foot breaks in the control-of-access line will allow the abutting landowner to open two proposed driveway locations for access to and from the eastbound frontage road. The district has determined that access may be permitted at the designated locations. g. Speed Zones Various Counties - Establish or alter regulatory and construction speed zones on various sections of highways in the state (MO) This minute order establishes or alters regulatory and construction speed zones on various sections of highways in the state.
OPEN COMMENT PERIOD - At the conclusion of all other agenda items, the commission will allow an open comment period, not to exceed one hour, to receive public comment on any other matter that is under the jurisdiction of the department. No action will be taken. Each speaker will be allowed a maximum of three minutes. Speakers must be signed up prior to the beginning of the open comment period. ADJOURN
