State law authorizes the award of state funding for capital improvement projects. The airports listed in Exhibit A are eligible for award of these grant funds and the department seeks approval of the awards.

Various Counties - Award federal §5311 funds, Formula Grants for Rural Areas Program for FY 2014 (MO) The awards identified in this minute order reflect the allocation of federal grant funds from the Federal Transit Administration §5311, Formula Grants for Rural Areas Program to rural public transportation providers. b. Various Counties - Award federal §5339 capital investment program funds and transportation development credits to transportation providers for capital projects (MO) The awards identified in this minute order reflect the allocation of federal grant funds from the Federal Transit Administration §5339, Bus and Bus Facilities Program to various public transportation providers. Transportation development credits are awarded to various transportation agencies to assist with the match of federal funds for capital projects. c. Various Counties - Award federal §5317 New Freedom grant program funds to the Texas State Independent Living Council (MO) This minute order awards $5,000 of §5317 funds to the Texas State Independent Living Council funding an initiative of outreach and education to be provided to the rural Centers for Independent Living (CILS) regarding local public transportation providers and practices to assist the CILS in meeting their transportation related program goals. d. Galveston County - Award STP-MM funds through the §5311 grant program to the City of Galveston for a transit preventative maintenance project. (MO) The Houston-Galveston Area Council authorized the transfer of $500,000 in Surface Transportation Program Metropolitan Mobility funding for a preventative maintenance project in the City of Galveston. The flexed funding will be administered under the Federal Transit Administration grant program, Formula Grants for Rural Areas (49 U.S.C. §5311).

Promulgation of Administrative Rules Under Title 43, Texas Administrative Code,and the Administrative Procedure Act, Government Code, Chapter 2001: a. Final Adoption (1) Chapter 2 - Environmental (MO) Amendments to §§2.1, 2.2, 2.5 - 2.8, 2.11, 2.12 and 2.14 (General Provisions), §§2.41 - 2.44, 2.46 -2.52 (Environmental Review Process for Highway Projects); §§2.81, 2.83 - 2.86 (Requirements for Classes of Projects); and §§2.131 and 2.134 (Requirements for Specific Projects and Programs); Repeal of §2.82 (Blanket and Programmatic Categorical Exclusions). Repeal of §§2.101 - 2.110 (Public Participation) and replacement with new §§2.101 - 2.110 (Public Participation). This proposed rulemaking would permit additional flexibility, add clarity, and further streamline the environmental process. It would also make revisions to support implementation of Senate Bill 466, which was passed by the 83rd Legislature and allows the department to accept delegation of NEPA responsibilities from FHWA; provide consistency with the federal transportation reauthorization bill, MAP-21; and remove references to the department’s regions, among other changes. (2) Chapter 5 - Finance (MO) Amendments to §5.11, Charges for Dishonored Checks (Collection of Debts), §5.43, Methods of Payment and §5.44, Exceptions (Payment of Fees for Department Goods and Services) These amendments provide rule changes related to charges for dishonored checks and to credit card acceptance limits and fees. They provide clarity to policy and remove barriers associated to the public using credit card as a payment method. Agency fiscal impact is minimal. (3) Chapter 12 – Public Donation and Participation Programs (MO) Amendments to§12.5, Landscape Cost Sharing Program, and §12.7, Landscape Partnership Program (Public Participation Programs) These amendments update existing rules to allow individuals to participate as a type of eligible entity in the Landscape Cost Sharing Program and the Landscape Partnership Program in order to comply with House Bill 3422 from the 83rd Legislature. These amendments also standardize sign requirements through compliance with the Texas Manual on Uniform Traffic Control Devices. (4) Chapter 21 – Right of Way (MO) Amendment to §21.23, State Participation in Toll-Related Relocations (Utility Adjustment, Relocation, or Removal) House Bill 2585, 83rd Legislature, amended Sections 203.092(a-1), (a-2), and (a-3), Transportation Code, that deal with shared responsibility for the cost of relocating utility facilities on toll projects, to remove the September 1, 2013, expiration dates and make those provisions permanent. This amendment conforms the rule to changes in the statute. (5) Chapter 28 - Oversize and Overweight Vehicles and Loads (MO) Amendments to §§28.20-28.22 (Port of Brownsville Permits) These amendments alter the overweight corridor route used by the Port of Brownsville for the issuance of overweight permits as authorized by House Bill 3125 of the 83 Legislative Session. This change will allow the Port of Brownsville to accommodate the permitting needs of additional businesses that are located in the port area.
Item 10 - Office of Compliance, Ethics, and Investigations
Office of Compliance, Ethics, and Investigations Office of Compliance, Ethics, and Investigations Report State law requires the commission to establish a compliance program, which must include a compliance office to oversee the program. The compliance office is responsible for acting to prevent and detect serious breaches of department policy, fraud, waste, and abuse of office, including any acts of criminal conduct within the department. The compliance office is required to provide a monthly report to the commission regarding investigations and a summary of information relating to trends and recommendations.
Item 11 - Unified Transportation Program (UTP)
Unified Transportation Program (UTP) Approve updates to the 2014 UTP (MO) (Presentation) The Unified Transportation Program (UTP) is a 10-year statewide plan for transportation project development. The commission approved the 2014 UTP in August 2013 and revisions to the 2014 UTP in December 2013. This minute order updates allocations based on funds transfer requests in multiple categories and revises project specific program lists. In addition, this minute order addresses initial designations of major transportation projects in accordance with criteria established in 43 TAC §16.106, incorporates information regarding transportation development credit awards and remaining balances, and includes minor revisions and technical corrections.
Toll Roads Travis and Williamson Counties - Issue an order prohibiting the operation of certain motor vehicles on TxDOT toll projects (MO) SB 1792, enacted by the 83rd Texas Legislature, created new enforcement remedies targeted at certain motorists with unpaid toll violations. Transportation Code, Section 372.110, authorizes the commission to issue an order prohibiting the operation of a motor vehicle on a TxDOT toll project if the registered owner of the vehicle has been finally determined to be a habitual violator, subject to certain notice requirements. A person commits an offense if the person operates a motor vehicle on a toll project in violation of the order. Subsequent offenses may result in impoundment of the vehicle.
Contracts Award or reject contracts for maintenance, highway and building construction These proposed minute orders contain information concerning the receipt of bids for highway improvement contracts. The department may reschedule receipt of bids for those projects where the commission rejects all bids. Those bids accepted by the commission will result in conditional contract awards to the low bidders. Contract award conditions may involve securing funding from other sources, the contractor's ability to satisfy federal DBE subcontracting requirements, or other requirements as outlined in the project bid proposal. Eminent Domain Proceedings Various Counties - Authorize the filing of condemnation proceedings to acquire real property by eminent domain for non-controlled and controlled access highways (see attached list) (MO) Commission findings, determinations, and authorizations for the state, by motion made in accordance with Senate Bill 18 (82nd Legislature), to acquire by eminent domain, upon the payment of adequate and just compensation, various ownership interests in specific parcels of real property that are needed to develop or improve both non-controlled and controlled access state highways, to include requesting the state attorney general to bring and pursue condemnation suits relating to those specific parcels of real property described in the attached itemized list.

Routine Minute Orders a. Donations to the Department Various Districts - Consider the acknowledgment of donations made to the department to include: (a) donations in any form, including realty, personalty, money, materials, or services, which are made to the department for the purpose of carrying out its functions and duties; and (b) donations from landowners, with land adjacent to a highway that is part of the state highway system, to construct an improvement on the highway right-of-way that is directly related to improving access to or from the owner's land (See attached itemized list) (MO) The donations will ensure the safety of the traveling public. b. Right of Way Dispositions and Donations The commission must approve the sales, transfers and exchanges of state rights of way and other real properties that are no longer needed for a state highway purpose. It must also approve, accept and acknowledge donations to the state of real property that is valued at $500 or more. (1) Collin County - FM 2514 from Brown Street south to SH 78 in Wylie - Consider the removal from the system, transfer of control, jurisdiction and maintenance to the city, and quitclaim of right of way to the city (MO) The district has determined that the segment of highway functions as a city street and is no longer needed as part of the highway system. The city has requested that it be removed from the system and that control, jurisdiction, and maintenance be transferred to the city. There is no record title in the state’s or city’s name, and the land may be quitclaimed to the city. (2) Coryell County - FM 931 from SH 36 to Fort Hood Boundary - Consider the removal from the system and transfer to the county (MO) The district has advised that the highway functions primarily as access to Fort Hood and is no longer needed for state highway purposes. The county has requested that it be transferred to the county and has agreed to maintain it for use for public road purposes. (3) Dallas County - US 75 at Watkins Avenue in Dallas - Consider the sale of right of way to the abutting landowner (MO) The district has determined that a tract of land is no longer needed for highway purposes. The abutting landowner has requested to purchase the land, and it may be sold to the abutting landowner. (4) Galveston County - I-45 from 0.452 miles south of FM 518 to north of FM 517 - Consider the acceptance of a donation of land for a highway improvement project (MO) The property being donated to the department is necessary for construction of a highway improvement on IH 45. The property being donated is in lieu of payment for the acquisition and is valued at more than $500. (5) Midland County - BS 349C from 0.6 miles north of Loop 250 (Solomon Lane) to 0.2 miles north of Loop 250 - Consider the acceptance of a donation of land for a landscape development project (MO) The property being donated to the department is necessary for construction of a landscape development project on BS 349C. The property being donated is in lieu of payment for the acquisition and is valued at more than $500. (6) Robertson County - FM 2293, old alignment at Peach Joe Road - Consider the sale of right of way to the abutting landowner (MO) The district has determined that a tract of land is no longer needed for highway purposes. The abutting landowner has requested to purchase the land, and it may be sold to the abutting landowner. (7) Sabine County - SS 35 north of SH 103 - Consider the sale of right of way to the abutting landowner (MO) The district has determined that a tract of land used as a roadside park is no longer needed for highway purposes. The abutting landowner has requested to purchase the land, and it may be sold to the abutting landowner. (8) Travis County - US 290, old alignment of SH 20 west of Oak Hill - Consider the quitclaim of right of way to the abutting landowners (MO) There is no record title to the land in the state’s or county’s name. The abutting landowners have requested to acquire the land, and it may be quitclaimed to the abutting landowner at the request of the county. The county is not interested in acquiring the land and has requested that it be quitclaimed to the abutting landowners. c. Transportation Planning Various Counties - Authorize the submission of applications to the American Association of State Highway and Transportation Officials (AASHTO) to establish segments of I-69 (MO) In accordance with the procedures established by the Federal Highway Administration and AASHTO, this minute order authorizes the department to petition AASHTO to include various route segments in Texas as part of the Interstate Highway System as I-69. d. Designation of Access Control (1) Brazoria County - SH 288, approximately 471 feet north of SH 332 - Consider the designation of a location on the highway at which access will be permitted to the abutting property (MO) The designation of a 50-foot break in the control-of-access line will allow the abutting landowner to open a proposed driveway location for access to and from the southbound frontage road. The district has determined that access may be permitted at the designated location. (2) Brazoria County - SH 288, approximately 1000 feet south of FM 2234 - Consider the designation of a location on the highway at which access will be permitted to the abutting property (MO) The designation of a 60-foot break in the control-of-access line will allow the abutting landowner to open a proposed driveway location for access to and from the northbound frontage road. The district has determined that access may be permitted at the designated location. (3) Dallas County - I-20, east of Houston School Road - Consider the designation of one location on the frontage road at which access will be permitted to the abutting property (MO) The designation of one 34-foot break in the control-of-access line will allow the abutting landowner to open a proposed driveway location for access to and from the eastbound frontage road. The district has determined that access may be permitted at the designated location. (4) Dallas County - I-635, east of Josey Lane - Consider the designation of one location on the frontage road at which access will be permitted to the abutting property (MO) The designation of one 39-foot break in the control-of-access line will allow the abutting landowner to open a proposed driveway location for access to and from the eastbound frontage road. The district has determined that access may be permitted at the designated location. e. Highway Designation Chambers County - Extend the designation of FM 1409 along a new location from FM 565 in Old River-Winfree, southward to FM 565 west of Cove (MO) Local officials have requested that the designation of FM 1409 be extended along a new location from FM 565 in Old River-Winfree, southward to FM 565 west of Cove, a distance of approximately 4.6 miles. f. (4) Galveston County - I-45 from 0.452 miles south of FM 518 to north of FM 517 - Consider the acceptance of a donation of land for a highway improvement project (MO) The property being donated to the department is necessary for construction of a highway improvement on IH 45. The property being donated is in lieu of payment for the acquisition and is valued at more than $500. (5) Midland County - BS 349C from 0.6 miles north of Loop 250 (Solomon Lane) to 0.2 miles north of Loop 250 - Consider the acceptance of a donation of land for a landscape development project (MO) The property being donated to the department is necessary for construction of a landscape development project on BS 349C. The property being donated is in lieu of payment for the acquisition and is valued at more than $500. (6) Robertson County - FM 2293, old alignment at Peach Joe Road - Consider the sale of right of way to the abutting landowner (MO) The district has determined that a tract of land is no longer needed for highway purposes. The abutting landowner has requested to purchase the land, and it may be sold to the abutting landowner. (7) Sabine County - SS 35 north of SH 103 - Consider the sale of right of way to the abutting landowner (MO) The district has determined that a tract of land used as a roadside park is no longer needed for highway purposes. The abutting landowner has requested to purchase the land, and it may be sold to the abutting landowner. (8) Travis County - US 290, old alignment of SH 20 west of Oak Hill - Consider the quitclaim of right of way to the abutting landowners (MO) There is no record title to the land in the state’s or county’s name. The abutting landowners have requested to acquire the land, and it may be quitclaimed to the abutting landowner at the request of the county. The county is not interested in acquiring the land and has requested that it be quitclaimed to the abutting landowners. c. Transportation Planning Various Counties - Authorize the submission of applications to the American Association of State Highway and Transportation Officials (AASHTO) to establish segments of I-69 (MO) In accordance with the procedures established by the Federal Highway Administration and AASHTO, this minute order authorizes the department to petition AASHTO to include various route segments in Texas as part of the Interstate Highway System as I-69. d. Designation of Access Control (1) Brazoria County - SH 288, approximately 471 feet north of SH 332 - Consider the designation of a location on the highway at which access will be permitted to the abutting property (MO) The designation of a 50-foot break in the control-of-access line will allow the abutting landowner to open a proposed driveway location for access to and from the southbound frontage road. The district has determined that access may be permitted at the designated location. (2) Brazoria County - SH 288, approximately 1000 feet south of FM 2234 - Consider the designation of a location on the highway at which access will be permitted to the abutting property (MO) The designation of a 60-foot break in the control-of-access line will allow the abutting landowner to open a proposed driveway location for access to and from the northbound frontage road. The district has determined that access may be permitted at the designated location. (3) Dallas County - I-20, east of Houston School Road - Consider the designation of one location on the frontage road at which access will be permitted to the abutting property (MO) The designation of one 34-foot break in the control-of-access line will allow the abutting landowner to open a proposed driveway location for access to and from the eastbound frontage road. The district has determined that access may be permitted at the designated location. (4) Dallas County - I-635, east of Josey Lane - Consider the designation of one location on the frontage road at which access will be permitted to the abutting property (MO) The designation of one 39-foot break in the control-of-access line will allow the abutting landowner to open a proposed driveway location for access to and from the eastbound frontage road. The district has determined that access may be permitted at the designated location. e. Highway Designation Chambers County - Extend the designation of FM 1409 along a new location from FM 565 in Old River-Winfree, southward to FM 565 west of Cove (MO) Local officials have requested that the designation of FM 1409 be extended along a new location from FM 565 in Old River-Winfree, southward to FM 565 west of Cove, a distance of approximately 4.6 miles. f. Speed Zones Various Counties - Establish or alter regulatory and construction speed zones on various sections of highways in the state (MO) This minute order establishes or alters regulatory and construction speed zones on various sections of highways in the state.
